The Committee on Fiscal Policy (Thompson) recommended the
following:

4 and insert:
5 verify the integrity of all components that are recommended or
6 specified by the manufacturer or metal fatigue at least
7 annually. The nondestructive testing for metal fatigue must be
8 conducted more often than annually if required by any rule
9 adopted under this section, by the manufacturer of the amusement
10 ride, or by the professional engineer or qualified inspector
11 executing the affidavit of nondestructive testing. The
12 nondestructive testing for metal fatigue must consist at least
13 of visual nondestructive testing, as well as nonvisual
14 nondestructive testing for metal fatigue, which must be
15 conducted on the components of the amusement ride as required by
16 any rule adopted under this section, by the manufacturer of the
17 amusement ride, or by the professional engineer or qualified
18 inspector executing the affidavit of nondestructive testing.
19 (b) When specified by the manufacturer, nonvisual
20 nondestructive testing must be used to verify the integrity of
21 components that, due to their design, location, installation, or
22 a combination thereof, cannot be adequately evaluated by other
23 means.
24 (c)(b) Nondestructive testing testings must be performed by
25 a technician who meets the requirements prescribed by department
26 rule.
27 (d)(c) An affidavit of nondestructive testing, on a form
28 prescribed by department rule, must state, at a minimum, all of
29 the following:
30 1. That the amusement ride was inspected in person by the
31 affiant.
32 2. That all of the manufacturer’s nondestructive testing
33 requirements and recommendations are current.
34 3. That the nondestructive testing was performed by a
35 qualified nondestructive testing technician.
36 4. The components of the amusement ride for which the
37 manufacturer has recommended or required nondestructive testing.
38 5. The type of nondestructive testing required or
39 recommended by the manufacturer.
40 6. The frequency of the nondestructive testing required or
41 recommended by the manufacturer.
42 7. The components of the amusement ride for which the
43 affiant, in addition to the manufacturer’s requirements and
44 recommendations, has recommended or required nondestructive
45 testing.
46 8. The type of nondestructive testing required or
47 recommended by the affiant in addition to the manufacturer’s
48 requirements and recommendations. If the affiant does not
49 require or recommend additional nondestructive testing, the
50 affiant must affirm that the manufacturer’s requirements are
51 sufficient for the safe operation of the amusement ride.
52 9. The frequency of the nondestructive testing as required
53 or recommended by the affiant.
54 10. That visual nondestructive testing is adequate for the
55 amusement ride to be in general conformance with the
56 requirements of this section and all applicable rules, only if
57 only visual nondestructive testing is required or recommended by
58 the manufacturer or the affiant.
59 11. That the amusement ride is in conformance with the
60 requirements of this section and all applicable department
61 rules.
62 12. Whether the amusement ride has undergone a major
63 modification and, if so, the name of the manager, owner, or
64 operator who authorized the modification and the date the
65 modification took place.
66 13. That the amusement ride and its components are in
67 conformance with the service life, if the manufacturer has
68 provided a service life for such ride and its components.
