House Comm: RS . 02/28/2024 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Fiscal Policy (Ingoglia) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 26 - 39 4 and insert: 5 proceeding under federal or state law. 6 (2) A person who has been deported or removed from the 7 United States under federal immigration proceedings, or has 8 departed the United States while such an order of deportation or 9 removal is outstanding, shall have the penalty for committing a 10 felony after unlawfully reentering the United States 11 reclassified in the following manner: 12 (a) A felony of the third degree is reclassified to a 13 felony of the second degree. 14 (b) A felony of the second degree is reclassified to a 15 felony of the first degree. 16 (c) A felony of the first degree is reclassified to a life 17 felony. 18 (3) Any record of the United States Department of Homeland 19 Security, the United States Executive Office for Immigration 20 Review, or the United States Citizenship and Immigration 21 Services concerning the legal status of a person, including, but 22 not limited to, any conviction, deportation, removal, or reentry 23 order or document, is presumed to be prima facie genuine, and 24 must be received as evidence in all courts of this state without 25 further authentication, provided it bears the signature, name, 26 and title of an officer of the United States. 27 28 ================= T I T L E A M E N D M E N T ================ 29 And the title is amended as follows: 30 Delete lines 5 - 12 31 and insert: 32 penalty for the commission of a felony committed by a 33 person who unlawfully reenters the United States, and 34 while remaining unlawfully present, after having been 35 deported or removed from the United States under 36 federal immigration proceedings, or who has departed 37 the United States while such an order of deportation 38 or removal was outstanding; specifying that any record 39 of specified federal entities concerning the legal 40 status of a person is presumed to be prima facie 41 genuine and must be received as evidence in all courts 42 of this state without further authentication under 43 certain circumstances; creating s. 908.12, F.S.; 44 defining the
