       The Appropriations Committee on Agriculture, Environment, and
       General Government (Martin) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 16.717, Florida Statutes, is created to
    6  read:
    7         16.717Florida Gaming Control Commission; authority to
    8  purchase necessary property.—The Florida Gaming Control
    9  Commission is specifically exempt from chapter 255 and shall
   10  have the authority to purchase, lease, exchange, or otherwise
   11  acquire land, property interests, buildings, or other
   12  improvements, including personal property within such buildings
   13  or on such lands that is necessary to or useful in securing or
   14  storing any seized slot machines or devices or any other
   15  contraband. Any such property shall be held in the name of the
   16  state.
   17         Section 2. Paragraph (a) of subsection (1) and paragraph
   18  (a) of subsection (2) of section 772.102, Florida Statutes, is
   19  amended to read:
   20         772.102 Definitions.—As used in this chapter, the term:
   21         (1) “Criminal activity” means to commit, to attempt to
   22  commit, to conspire to commit, or to solicit, coerce, or
   23  intimidate another person to commit:
   24         (a) Any crime that is chargeable by indictment or
   25  information under the following provisions:
   26         1. Section 210.18, relating to evasion of payment of
   27  cigarette taxes.
   28         2. Section 414.39, relating to public assistance fraud.
   29         3. Section 440.105 or s. 440.106, relating to workers’
   30  compensation.
   31         4. Part IV of chapter 501, relating to telemarketing.
   32         5. Chapter 517, relating to securities transactions.
   33         6. Section 550.235 or s. 550.3551, relating to dogracing
   34  and horseracing.
   35         7. Chapter 550, relating to jai alai frontons.
   36         8. Chapter 552, relating to the manufacture, distribution,
   37  and use of explosives.
   38         9. Chapter 562, relating to beverage law enforcement.
   39         10. Section 624.401, relating to transacting insurance
   40  without a certificate of authority, s. 624.437(4)(c)1., relating

   83         (2) “Unlawful debt” means any money or other thing of value
   84  constituting principal or interest of a debt that is legally
   85  unenforceable in this state in whole or in part because the debt
   86  was incurred or contracted:
   87         (a) In violation of any one of the following provisions of
   88  law:
   89         1. Section 550.235 or s. 550.3551, relating to dogracing
   90  and horseracing.
   91         2. Chapter 550, relating to jai alai frontons.
   92         3. Section 687.071, relating to criminal usury and loan
   93  sharking.
   94         4. Section 849.09, s. 849.14, s. 849.15, s. 849.23, or s.
   95  849.25, relating to gambling.
   96         Section 3. Section 843.08, Florida Statutes, is amended to
   97  read:
   98         843.08 False personation.—A person who falsely assumes or
   99  pretends to be a firefighter, a sheriff, an officer of the
  100  Florida Highway Patrol, an officer of the Fish and Wildlife
  101  Conservation Commission, an officer of the Department of
  102  Environmental Protection, an officer of the Department of
  103  Financial Services, any personnel or representative of the
  104  Division of Investigative and Forensic Services, any personnel
  105  or representative of the Florida Gaming Control Commission, an
  106  officer of the Department of Corrections, a correctional
  107  probation officer, a deputy sheriff, a state attorney or an
  108  assistant state attorney, a statewide prosecutor or an assistant
  109  statewide prosecutor, a state attorney investigator, a coroner,
  110  a police officer, a lottery special agent or lottery
  111  investigator, a beverage enforcement agent, a school guardian as
  112  described in s. 30.15(1)(k), a security officer licensed under
  113  chapter 493, any member of the Florida Commission on Offender
  114  Review or any administrative aide or supervisor employed by the
  115  commission, any personnel or representative of the Department of
  116  Law Enforcement, or a federal law enforcement officer as defined
  117  in s. 901.1505, and takes upon himself or herself to act as
  118  such, or to require any other person to aid or assist him or her
  119  in a matter pertaining to the duty of any such officer, commits
  120  a felony of the third degree, punishable as provided in s.
  121  775.082, s. 775.083, or s. 775.084. However, a person who
  122  falsely personates any such officer during the course of the
  123  commission of a felony commits a felony of the second degree,
  124  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
  125  If the commission of the felony results in the death or personal
  126  injury of another human being, the person commits a felony of
  127  the first degree, punishable as provided in s. 775.082, s.
  128  775.083, or s. 775.084. In determining whether a defendant has
  129  violated this section, the court or jury may consider any
  130  relevant evidence, including, but not limited to, whether the
  131  defendant used lights in violation of s. 316.2397 or s. 843.081.
  132         Section 4. Section 849.01, Florida Statutes, is amended to
  133  read:
  134         849.01 Keeping gambling houses, etc.—Whoever by herself or
  135  himself, her or his servant, clerk or agent, or in any other
  136  manner knowingly has, keeps, exercises or maintains a gaming
  137  table or room, or gaming implements or apparatus, or house,
  138  booth, tent, shelter or other place for the purpose of gaming or
  139  gambling or in any place of which she or he may directly or
  140  indirectly have charge, control or management, either
  141  exclusively or with others, procures, suffers or permits any
  142  person to play for money or other valuable thing at any game
  143  whatever, whether heretofore prohibited or not, commits a felony
  144  of the third misdemeanor of the second degree, punishable as
  145  provided in s. 775.082, or s. 775.083, or s. 775.084.
  146         Section 5. Section 849.09, Florida Statutes, is amended to
  147  read:
  148         849.09 Lottery prohibited; exceptions.—
  149         (1) It is unlawful for any person in this state to do any
  150  of the following:
  151         (a) Set up, promote, or conduct any lottery for money or
  152  for anything of value.;
  153         (b) Dispose of any money or other property of any kind
  154  whatsoever by means of any lottery.;
  155         (c) Conduct any lottery drawing for the distribution of a
  156  prize or prizes by lot or chance, or advertise any such lottery
  157  scheme or device in any newspaper or by circulars, posters,
  158  pamphlets, radio, telegraph, telephone, or otherwise.;
  159         (d) Aid or assist in the setting up, promoting, or
  160  conducting of any lottery or lottery drawing, whether by
  161  writing, printing, or in any other manner whatsoever, or be
  162  interested in or connected in any way with any lottery or
  163  lottery drawing.;
  164         (e) Attempt to operate, conduct, or advertise any lottery
  165  scheme or device.;
  166         (f) Have in her or his possession any lottery wheel,
  167  implement, or device whatsoever for conducting any lottery or
  168  scheme for the disposal by lot or chance of anything of value.;
  169         (g) Sell, offer for sale, or transmit, in person or by mail
  170  or in any other manner whatsoever, any lottery ticket, coupon,
  171  or share, or any share in or fractional part of any lottery
  172  ticket, coupon, or share, whether such ticket, coupon, or share
  173  represents an interest in a live lottery not yet played or
  174  whether it represents, or has represented, an interest in a
  175  lottery that has already been played.;
  176         (h) Have in her or his possession any lottery ticket, or
  177  any evidence of any share or right in any lottery ticket, or in
  178  any lottery scheme or device, whether such ticket or evidence of
  179  share or right represents an interest in a live lottery not yet
  180  played or whether it represents, or has represented, an interest
  181  in a lottery that has already been played.;
  182         (i) Aid or assist in the sale, disposal, or procurement of
  183  any lottery ticket, coupon, or share, or any right to any
  184  drawing in a lottery.;
  185         (j) Have in her or his possession any lottery
  186  advertisement, circular, poster, or pamphlet, or any list or
  187  schedule of any lottery prizes, gifts, or drawings.; or
  188         (k) Have in her or his possession any so-called “run down
  189  sheets,” tally sheets, or other papers, records, instruments, or
  190  paraphernalia designed for use, either directly or indirectly,
  191  in, or in connection with, the violation of the laws of this
  192  state prohibiting lotteries and gambling.
  193         (2) This section does not prohibit participation in any
  194  nationally advertised contest, drawing, game, or puzzle of skill
  195  or chance for a prize or prizes unless it can be construed as a
  196  lottery under this section. Exemptions for national contests do
  197  not apply to any such contest based upon the outcome or results
  198  of any horserace, harness race, dograce, or jai alai game.
  199  
  200  Provided, that nothing in this section shall prohibit
  201  participation in any nationally advertised contest, drawing,
  202  game or puzzle of skill or chance for a prize or prizes unless
  203  it can be construed as a lottery under this section; and,
  204  provided further, that this exemption for national contests
  205  shall not apply to any such contest based upon the outcome or
  206  results of any horserace, harness race, dograce, or jai alai
  207  game.
  208         (3)(2) Any person who is convicted of violating paragraph
  209  (1)(a), paragraph (1)(b), paragraph (1)(c), or paragraph (1)(d)
  210  commits any of the provisions of paragraph (a), paragraph (b),
  211  paragraph (c), or paragraph (d) of subsection (1) is guilty of a
  212  felony of the second third degree, punishable as provided in s.
  213  775.082, s. 775.083, or s. 775.084.
  214         (4)(3) Any person who is convicted of violating paragraph
  215  (1)(e), paragraph (1)(f), paragraph (1)(g), or paragraph (1)(k)
  216  commits any of the provisions of paragraph (e), paragraph (f),
  217  paragraph (g), paragraph (i), or paragraph (k) of subsection (1)
  218  is guilty of a misdemeanor of the first degree, punishable as
  219  provided in s. 775.082 or s. 775.083. Any person who, having
  220  been convicted of violating any provision thereof, thereafter
  221  violates any provision thereof is guilty of a felony of the
  222  third degree, punishable as provided in s. 775.082, s. 775.083,
  223  or s. 775.084. The provisions of this section do not apply to
  224  bingo as provided for in s. 849.0931.
  225         (5)(4) Any person who is convicted of violating paragraph
  226  (1)(h), paragraph (1)(i), or paragraph (1)(j) commits any of the
  227  provisions of paragraph (h) or paragraph (j) of subsection (1)
  228  is guilty of a felony misdemeanor of the third first degree,
  229  punishable as provided in s. 775.082, or s. 775.083, or s.
  230  775.084. Any person who, having been convicted of violating any
  231  provision thereof, thereafter violates any provision thereof is
  232  guilty of a felony of the second third degree, punishable as
  233  provided in s. 775.082, s. 775.083, or s. 775.084.
  234         Section 6. Section 849.15, Florida Statutes, is amended to
  235  read:
  236         849.15 Manufacture, sale, possession, etc., of slot
  237  machines or devices prohibited.—
  238         (1) As used in this section, the term:
  239         (a) “Conviction” means a determination of guilt that is the
  240  result of a plea or a trial, regardless of whether adjudication
  241  is withheld or a plea of nolo contendere is entered.
  242         (b) “Manager” means a person who, at any business,
  243  establishment, premises, or other location at which a slot
  244  machine or device is offered for play, has:
  245         1. Authorization to operate or hold open the business,
  246  establishment, premises, or other location without any other
  247  employee present;
  248         2. Authorization to supervise another employee or
  249  employees; or
  250         3. Any ownership interest in the business, establishment,
  251  premises, or other location.
  252         (2) It is unlawful:
  253         (a) To manufacture, own, store, keep, possess, sell, rent,
  254  lease, let on shares, lend or give away, transport, or expose
  255  for sale or lease, or to offer to sell, rent, lease, let on
  256  shares, lend or give away, or permit the operation of, or for
  257  any person to permit to be placed, maintained, or used or kept
  258  in any room, space, or building owned, leased or occupied by the
  259  person or under the person’s management or control, any slot
  260  machine or device or any part thereof; or
  261         (b) To make or to permit to be made with any person any
  262  agreement with reference to any slot machine or device, pursuant
  263  to which the user thereof, as a result of any element of chance
  264  or other outcome unpredictable to him or her, may become
  265  entitled to receive any money, credit, allowance, or thing of
  266  value or additional chance or right to use such machine or
  267  device, or to receive any check, slug, token or memorandum
  268  entitling the holder to receive any money, credit, allowance or
  269  thing of value.
  270         (3)(a) Except as provided in paragraphs (b) and (c), a
  271  person who violates subsection (2) commits a misdemeanor of the
  272  first degree, punishable as provided in s. 775.082 or s.
  273  775.083.
  274         (b)A person commits a felony of the third degree,
  275  punishable as provided in s. 775.082, s. 775.083, or s. 775.084,
  276  if he or she violates subsection (2) and:
  277         1. At the time of the violation the person is acting as a
  278  manager; or
  279         2. Has one prior conviction for a violation of this
  280  section.
  281         (c) A person commits a felony of the second degree,
  282  punishable as provided in s. 775.082, s. 775.083, or s. 775.084,
  283  if he or she violates subsection (2) and:
  284         1.a.At the time of the violation the person is acting as a
  285  manager; and
  286         b. The violation involves five or more slot machines or
  287  devices; or
  288         2.Has two or more prior convictions for a violation of
  289  this section.
  290         (4)(2) Pursuant to section 2 of that chapter of the
  291  Congress of the United States entitled “An act to prohibit
  292  transportation of gaming devices in interstate and foreign
  293  commerce,” approved January 2, 1951, being ch. 1194, 64 Stat.
  294  1134, and also designated as 15 U.S.C. ss. 1171-1177, the State
  295  of Florida, acting by and through the duly elected and qualified
  296  members of its Legislature, does hereby in this section, and in
  297  accordance with and in compliance with the provisions of section
  298  2 of such chapter of Congress, declare and proclaim that any
  299  county of the State of Florida within which slot machine gaming
  300  is authorized pursuant to chapter 551 is exempt from the
  301  provisions of section 2 of that chapter of the Congress of the
  302  United States entitled “An act to prohibit transportation of
  303  gaming devices in interstate and foreign commerce,” designated
  304  as 15 U.S.C. ss. 1171-1177, approved January 2, 1951. All
  305  shipments of gaming devices, including slot machines, into any
  306  county of this state within which slot machine gaming is
  307  authorized pursuant to chapter 551 and the registering,
  308  recording, and labeling of which have been duly performed by the
  309  manufacturer or distributor thereof in accordance with sections
  310  3 and 4 of that chapter of the Congress of the United States
  311  entitled “An act to prohibit transportation of gaming devices in
  312  interstate and foreign commerce,” approved January 2, 1951,
  313  being ch. 1194, 64 Stat. 1134, and also designated as 15 U.S.C.
  314  ss. 1171-1177, shall be deemed legal shipments thereof into this
  315  state provided the destination of such shipments is an eligible
  316  facility as defined in s. 551.102 or the facility of a slot
  317  machine manufacturer or slot machine distributor as provided in
  318  s. 551.109(2)(a).
  319         Section 7. Section 849.155, Florida Statutes, is created to
  320  read:
  321         849.155Trafficking in slot machines or devices or any
  322  parts thereof.—Any person who knowingly sells, purchases,
  323  manufactures, transports, delivers, or brings into this state
  324  more than 15 slot machines or devices or any part thereof,
  325  commits a felony of the first degree, punishable as provided in
  326  s. 775.082, s. 775.083, or s. 775.084. If the quantity of slot
  327  machines or devices or any part thereof involved:
  328         (1) Is more than 15 slot machines or devices or any part
  329  thereof, but less than 25 slot machines or devices or any part
  330  thereof, such person must be ordered to pay a fine of $100,000.
  331         (2)Is 25 slot machines or devices or any part thereof or
  332  more, but less than 50 slot machines or devices or any part
  333  thereof, such person must be ordered to pay a fine of $250,000.
  334         (3) Is 50 slot machines or devices or any part thereof or
  335  more, such person must be ordered to pay a fine of $500,000.

  337  All fines imposed and collected pursuant to this section must be
  338  deposited into the Pari-mutuel Wagering Trust Fund and may be
  339  used for the enforcement of chapters 546, 550, 551, and this
  340  chapter by the Florida Gaming Control Commission.
  341         Section 8. Section 849.157, Florida Statutes, is created to
  342  read:
  343         849.157Making a false or misleading statement regarding
  344  the legality of slot machines or devices to facilitate sale.—
  345         (1)Except as provided in subsection (2), a person who
  346  knowingly and willfully makes a materially false or misleading
  347  statement or who knowingly and willfully disseminates false or
  348  misleading information regarding the legality of a slot machine
  349  or device for the purpose of facilitating the sale or delivery
  350  of a slot machine or device for any money or other valuable
  351  consideration commits a felony of the third degree, punishable
  352  as provided in s. 775.082, s. 775.083, or s. 775.084.
  353         (2) A person who violates subsection (1) when such a
  354  violation involves the sale or delivery, or attempted sale or
  355  delivery, of five or more slot machines or devices commits a
  356  felony of the second degree, punishable as provided in s.
  357  775.082, s. 775.083, or s. 775.084.
  358         Section 9. Section 849.23, Florida Statutes, is repealed.
  359         Section 10. Section 849.47, Florida Statutes, is created to
  360  read:
  361         849.47Transporting or procuring the transportation of
  362  persons to facilitate illegal gambling.—
  363         (1) Except as provided in subsection (2), a person who
  364  knowingly and willfully for profit or hire transports, or
  365  procures the transportation of, five or more other persons into
  366  or within this state when he or she knows or reasonably should
  367  know such transportation is for the purpose of facilitating
  368  illegal gambling commits a misdemeanor of the first degree,
  369  punishable as provided in s. 775.082 or s. 775.083.
  370         (2)(a) A person who transports, or procures the
  371  transportation of, a minor or a person 65 years of age or older
  372  in violation of subsection (1) commits a felony of the third
  373  degree, punishable as provided in s. 775.082, s. 775.083, or s.
  374  775.084.
  375         (b)A person who transports, or procures the transportation
  376  of, 12 or more persons in violation of subsection (1) commits a
  377  felony of the third degree, punishable as provided in s.
  378  775.082, s. 775.083, or s. 775.084.
  379         (3) As used in this section, the term “illegal gambling”
  380  means any criminal violation of chapter 546, chapter 550,
  381  chapter 551, or this chapter that occurs at any business,
  382  establishment, premises, or other location which operates for
  383  profit.
  384         Section 11. Section 849.48, Florida Statutes, is created to
  385  read:
  386         849.48Gambling or gaming advertisements; prohibited.—
  387         (1)(a)Except as otherwise specifically authorized by law,
  388  a person may not knowingly and intentionally make, publish,
  389  disseminate, circulate or place before the public, or cause,
  390  directly or indirectly, to be made, published, disseminated or
  391  circulated or placed before the public in this state, in any
  392  manner, any advertisement, circular, bill, poster, pamphlet,
  393  list, schedule, announcement, or notice for the purpose of
  394  promoting or facilitating illegal gambling.
  395         (b) Except as otherwise specifically authorized by law, a
  396  person may not set up any type or plate for any type of
  397  advertisement, circular, bill, poster, pamphlet, list, schedule,
  398  announcement, or notice when he or she knows or reasonably
  399  should know that such material will be used for the purpose of
  400  promoting or facilitating illegal gambling.
  401         (2)A person who violates subsection (1) commits a
  402  misdemeanor of the first degree, punishable as provided in s.
  403  775.082 or s. 775.083.
  404         (3) Nothing in this section prohibits the printing or
  405  producing of any advertisement, circular, bill, poster,
  406  pamphlet, list, schedule, announcement, or notice to be used for
  407  the purpose of promoting or facilitating gambling conducted in
  408  any other state or nation where such gambling is not prohibited.
  409         (4) As used in this section, the term “illegal gambling”
  410  means any criminal violation of chapter 546, chapter 550,
  411  chapter 551, or this chapter that occurs at any business,
  412  establishment, premises, or other location which operates for
  413  profit.
  414         Section 12. Section 849.49, Florida Statutes, is created to
  415  read:
  416         849.49Preemption.—No county, municipality, or other
  417  political subdivision of the state shall enact or enforce any
  418  ordinance or local rule relating to gaming, gambling, lotteries,
  419  and any activities described in s. 546.10 or this chapter except
  420  as otherwise expressly provided by the State Constitution or
  421  general law.
  422         Section 13. Paragraph (a) of subsection (12) of section
  423  895.02, Florida Statutes, is amended to read:
  424         895.02 Definitions.—As used in ss. 895.01-895.08, the term:
  425         (12) “Unlawful debt” means any money or other thing of
  426  value constituting principal or interest of a debt that is
  427  legally unenforceable in this state in whole or in part because
  428  the debt was incurred or contracted:
  429         (a) In violation of any one of the following provisions of
  430  law:
  431         1. Section 550.235 or s. 550.3551, relating to dogracing
  432  and horseracing.
  433         2. Chapter 550, relating to jai alai frontons.
  434         3. Section 551.109, relating to slot machine gaming.
  435         4. Chapter 687, relating to interest and usury.
  436         5. Section 849.09, s. 849.14, s. 849.15, s. 849.23, or s.
  437  849.25, relating to gambling.
  438         Section 14. Present paragraphs (i) through (m) of
  439  subsection (2) of section 903.046, Florida Statutes, are
  440  redesignated as paragraphs (j) through (n), respectively, and a
  441  new paragraph (i) is added to that subsection, to read:
  442         903.046 Purpose of and criteria for bail determination.—
  443         (2) When determining whether to release a defendant on bail
  444  or other conditions, and what that bail or those conditions may
  445  be, the court shall consider:
  446         (i) The amount of currency seized that is connected to or
  447  involved in a violation of chapter 546, chapter 550, chapter
  448  551, or chapter 849.
  449         Section 15. Paragraphs (a), (c), (e), and (g) of subsection
  450  (3) of section 921.0022, Florida Statutes, are amended to read:
