Senator Rouson moved the following:

3 Delete lines 131 - 187
4 and insert:
5 (5)(a) A minor who violates subsection (3):
6 1. For a first offense, commits a misdemeanor of the first
7 degree; for a first offense, shall may serve a period of
8 detention of up to 5 days in a secure detention facility, with
9 credit for time served in secure detention prior to disposition,
10 and; and, in addition to any other penalty provided by law,
11 shall be required to perform 100 hours of community service or
12 paid work as determined by the department.; and:
13 1. If the minor is eligible by reason of age for a driver
14 license or driving privilege, the court may direct the
15 Department of Highway Safety and Motor Vehicles to revoke or to
16 withhold issuance of the minor’s driver license or driving
17 privilege for up to 1 year.
18 2. If the minor’s driver license or driving privilege is
19 under suspension or revocation for any reason, the court may
20 direct the Department of Highway Safety and Motor Vehicles to
21 extend the period of suspension or revocation by an additional
22 period of up to 1 year.
23 3. If the minor is ineligible by reason of age for a driver
24 license or driving privilege, the court may direct the
25 Department of Highway Safety and Motor Vehicles to withhold
26 issuance of the minor’s driver license or driving privilege for
27 up to 1 year after the date on which the minor would otherwise
28 have become eligible.
29 2.(b) For a second or subsequent offense, a minor who
30 violates subsection (3) commits a felony of the third degree.
31 For a second offense, the minor and shall serve a period of
32 detention of up to 21 days in a secure detention facility, with
33 credit for time served in secure detention prior to disposition,
34 and shall be required to perform not less than 100 nor more than
35 250 hours of community service or paid work as determined by the
36 department. For a third or subsequent offense, the minor shall
37 be adjudicated delinquent and committed to a residential
38 program., and:
39 (b) In addition to the penalties for a violation of
40 subsection (3):
41 1. If the minor is eligible by reason of age for a driver
42 license or driving privilege, the court may direct the
43 Department of Highway Safety and Motor Vehicles to revoke or to
44 withhold issuance of the minor’s driver license or driving
45 privilege for up to 1 year for a first offense and up to 2 years
46 for a second or subsequent offense.
47 2. If the minor’s driver license or driving privilege is
48 under suspension or revocation for any reason, the court may
49 direct the Department of Highway Safety and Motor Vehicles to
50 extend the period of suspension or revocation by an additional
51 period of up to 1 year for a first offense and up to 2 years for
52 a second or subsequent offense.
53 3. If the minor is ineligible by reason of age for a driver
54 license or driving privilege, the court may direct the
55 Department of Highway Safety and Motor Vehicles to withhold
56 issuance of the minor’s driver license or driving privilege for
57 up to 1 year 2 years after the date on which the minor would
58 otherwise have become eligible and up to 2 years for a second or
59 subsequent offense.
