Florida Senate - 2024 SB 1322 By Senator Ingoglia 11-01092-24 20241322__ 1 A bill to be entitled 2 An act relating to millage rates; amending s. 200.065, 3 F.S.; prohibiting any increase in the millage rate 4 from going into effect until it has been approved by a 5 specified vote; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Paragraph (c) is added to subsection (5) of 10 section 200.065, Florida Statutes, to read: 11 200.065 Method of fixing millage.— 12 (5) In each fiscal year: 13 (c) The previous millage rate may only be increased if 14 approved by a two-thirds vote of the membership of the governing 15 body of the county, municipality, or independent district. 16 17 Any unit of government operating under a home rule charter 18 adopted pursuant to ss. 10, 11, and 24, Art. VIII of the State 19 Constitution of 1885, as preserved by s. 6(e), Art. VIII of the 20 State Constitution, which is granted the authority in the State 21 Constitution to exercise all the powers conferred now or 22 hereafter by general law upon municipalities and which exercises 23 such powers in the unincorporated area shall be recognized as a 24 municipality under this subsection. For a downtown development 25 authority established before the effective date of the State 26 Constitution which has a millage that must be approved by a 27 municipality, the governing body of that municipality shall be 28 considered the governing body of the downtown development 29 authority for purposes of this subsection. 30 Section 2. This act shall take effect July 1, 2024.
