Florida Senate - 2024 SB 1358 By Senator Martin 33-01416-24 20241358__ 1 A bill to be entitled 2 An act relating to Medicaid billing for behavioral 3 health services; amending s. 409.908, F.S.; 4 authorizing advanced practice registered nurse and 5 physician assistant services to be billed under a 6 supervising physician’s Medicaid provider number under 7 certain circumstances; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (27) is added to section 409.908, 12 Florida Statutes, to read: 13 409.908 Reimbursement of Medicaid providers.—Subject to 14 specific appropriations, the agency shall reimburse Medicaid 15 providers, in accordance with state and federal law, according 16 to methodologies set forth in the rules of the agency and in 17 policy manuals and handbooks incorporated by reference therein. 18 These methodologies may include fee schedules, reimbursement 19 methods based on cost reporting, negotiated fees, competitive 20 bidding pursuant to s. 287.057, and other mechanisms the agency 21 considers efficient and effective for purchasing services or 22 goods on behalf of recipients. If a provider is reimbursed based 23 on cost reporting and submits a cost report late and that cost 24 report would have been used to set a lower reimbursement rate 25 for a rate semester, then the provider’s rate for that semester 26 shall be retroactively calculated using the new cost report, and 27 full payment at the recalculated rate shall be effected 28 retroactively. Medicare-granted extensions for filing cost 29 reports, if applicable, shall also apply to Medicaid cost 30 reports. Payment for Medicaid compensable services made on 31 behalf of Medicaid-eligible persons is subject to the 32 availability of moneys and any limitations or directions 33 provided for in the General Appropriations Act or chapter 216. 34 Further, nothing in this section shall be construed to prevent 35 or limit the agency from adjusting fees, reimbursement rates, 36 lengths of stay, number of visits, or number of services, or 37 making any other adjustments necessary to comply with the 38 availability of moneys and any limitations or directions 39 provided for in the General Appropriations Act, provided the 40 adjustment is consistent with legislative intent. 41 (27) The services provided by an advanced practice 42 registered nurse or a physician assistant acting within his or 43 her scope of practice who is providing behavioral health 44 services under the general supervision of a physician may be 45 billed under the supervising physician’s Medicaid provider 46 number when the supervising physician is not in the building, 47 but is available to render assistance to the advanced practice 48 registered nurse or physician assistant. 49 Section 2. This act shall take effect July 1, 2024.
