House Comm: RCS . 01/29/2024 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Judiciary (Berman) recommended the following: 1 Senate Amendment 2 3 Delete lines 53 - 87 4 and insert: 5 (a) Calling for, aiding, or justifying the killing or 6 harming of Jewish individuals. 7 (b) Making mendacious, dehumanizing, demonizing, or 8 stereotypical allegations about Jewish individuals as such or 9 the power of Jewish people as a collective, such as, the myth of 10 a worldwide Jewish conspiracy or of Jewish individuals 11 controlling the media, economy, government, or other societal 12 institutions. 13 (c) Accusing Jewish people as a collective of being 14 responsible for real or imagined wrongdoing committed by a 15 single Jewish person or group or for acts committed by non 16 Jewish individuals. 17 (d) Denying the fact, scope, and mechanisms, such as gas 18 chambers, or the intentionality of the genocide of the Jewish 19 people at the hands of Nazi Germany and its supporters and 20 accomplices during the Holocaust. 21 (e) Accusing Jewish people as a collective, or Israel as a 22 state, of inventing or exaggerating the Holocaust. 23 (f) Accusing Jewish citizens of being more loyal to Israel, 24 or to the alleged priorities of Jewish individuals worldwide, 25 than to the interests of their respective nations. 26 (g) Denying the Jewish people their right to self 27 determination, such as claiming that the existence of a State of 28 Israel is a racist endeavor. 29 (h) Applying double standards by requiring of the Jewish 30 state of Israel a standard of behavior not expected or demanded 31 of any other democratic nation. 32 (i) Using the symbols and images associated with classic 33 antisemitism, such as blood libel, to characterize Israel or 34 Israelis. 35 (j) Drawing comparisons of contemporary Israeli policy to 36 that of the Nazis. 37 (k) Holding Jewish individuals collectively responsible for 38 actions of the state of Israel. 39 (3) The term “antisemitism” does not include criticism of 40 Israel that is similar to criticism of any other country. 41 (4) This section may not be construed to diminish or 42 infringe upon any right protected under the First Amendment to 43 the United States Constitution or to conflict with federal or 44 state antidiscrimination laws.
