Florida Senate - 2024 CS for SB 1528 By the Committee on Transportation; and Senator Collins 596-02954A-24 20241528c1 1 A bill to be entitled 2 An act relating to violations against vulnerable road 3 users; creating s. 318.195, F.S.; providing a short 4 title; requiring a person who commits a moving 5 violation that causes serious bodily injury to or the 6 death of a vulnerable road user to pay specified fines 7 and attend a specified driver improvement course; 8 requiring the court to revoke the person’s driver 9 license for a specified period; defining the term 10 “vulnerable road user”; providing construction; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 318.195, Florida Statutes, is created to 16 read: 17 318.195 Enhanced penalties for moving violations causing 18 injury or death to vulnerable road users.— 19 (1) This section may be cited as the “Vulnerable Road User 20 Act.” 21 (2) A person who commits a moving violation that causes 22 serious bodily injury, as defined in s. 316.1933(1)(b), to a 23 vulnerable road user shall pay a fine of not less than $1,500 24 and attend a department-approved driver improvement course 25 relating to the rights of vulnerable road users relative to 26 vehicles on the roadway as provided in s. 322.0261(2). The court 27 shall also revoke the person’s driver license for at least 30 28 days. 29 (3) A person who commits a moving violation that causes the 30 death of a vulnerable road user shall pay a fine of not less 31 than $5,000 and attend a department-approved driver improvement 32 course relating to the rights of vulnerable road users relative 33 to vehicles on the roadway as provided in s. 322.0261(2). The 34 court shall also revoke the person’s driver license for at least 35 1 year. 36 (4) As used in this section, the term “vulnerable road 37 user” has the same meaning as in s. 316.027(1). 38 (5) This section does not prohibit a person from being 39 charged with, convicted of, or punished for any other violation 40 of law. 41 Section 2. This act shall take effect July 1, 2024.
