The Committee on Fiscal Policy (Martin) recommended the
following:

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 800.045, Florida Statutes, is created to
6 read:
7 800.045 Lewd or lascivious grooming.—
8 (1) As used in this section, the term:
9 (a) “Child” means a person less than 16 years of age.
10 (b) “Inappropriate communication or conduct” means any
11 verbal, written, or electronic communication or any conduct in
12 which a person describes, depicts, or demonstrates sexual
13 conduct or sexual excitement.
14 (c) “Sexual activity” has the same meaning as in s.
15 800.04(1).
16 (d) “Sexual conduct” and the term “sexual excitement” have
17 the same meanings as in s. 847.001.
18 (e) “Sexual performance” has the same meaning as in s.
19 827.071(1).
20 (f) “Unlawful sexual behavior” means any unlawful sexual
21 activity, unlawful sexual conduct, or unlawful sexual
22 performance.
23 (2) A person 18 years of age or older who, with lewd or
24 lascivious intent, engages in a pattern of inappropriate
25 communication or conduct directed toward a child for the purpose
26 of enticing such child to engage in any unlawful sexual behavior
27 with that person or the exploitation of such child for human
28 trafficking as provided in s. 787.06, commits lewd or lascivious
29 grooming, a felony of the third degree, punishable as provided
30 in s. 775.082, s. 775.083, or s. 775.084.
31 Section 2. Paragraphs (c), (e), (f), and (g) of subsection
32 (3) of section 921.0022, Florida Statutes, are amended to read:
