    1                        A bill to be entitled                      
    2         An act relating to sheriffs in consolidated
    3         governments; amending s. 30.49, F.S.; authorizing
    4         sheriffs in a consolidated government, as well as all
    5         other sheriffs, to transfer funds after their budgets
    6         are approved by the board of county commissioners,
    7         city council, or budget commission; amending s. 30.53,
    8         F.S.; preserving the independence of a sheriff in a
    9         consolidated government concerning certain powers;
   10         providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (12) of section 30.49, Florida
   15  Statutes, is amended to read:
   16         30.49 Budgets.—
   17         (12) Notwithstanding any other law, and in order to
   18  effectuate, fulfill, and preserve the independence of sheriffs
   19  as specified in s. 30.53, a sheriff may transfer funds between
   20  the fund and functional categories and object and subobject code
   21  levels after his or her budget has been approved by the board of
   22  county commissioners, city council, or budget commission. This
   23  subsection shall apply to a sheriff in a consolidated
   24  government, consolidated pursuant to s. 3 or s. 6(e), Art. VIII
   25  of the State Constitution.
   26         Section 2. Section 30.53, Florida Statutes, is amended to
   27  read:
   28         30.53 Independence of constitutional officials.—The
   29  independence of the sheriffs, including a sheriff in a
   30  consolidated government, consolidated pursuant to s. 3 or s.
   31  6(e), Art. VIII of the State Constitution, shall be preserved
   32  concerning the purchase of supplies and equipment, selection of
   33  personnel, and the hiring, firing, and setting of salaries of
   34  such personnel; provided that nothing herein contained shall
   35  restrict the establishment or operation of any civil service
   36  system or civil service board created pursuant to s. 14, Art.
   37  III, of the State Constitution, provided, further that nothing
   38  contained in ss. 30.48-30.53 shall be construed to alter, modify
   39  or change in any manner any civil service system or board, state
   40  or local, now in existence or hereafter established.
   41         Section 3. This act shall take effect July 1, 2024.
