1 A bill to be entitled
2 An act relating to spirituous beverages; amending s.
3 565.10, F.S.; increasing the maximum allowable size of
4 distilled spirits containers; making a technical
5 change; amending s. 565.17, F.S.; authorizing certain
6 distilleries and primary sources of American supply to
7 conduct beverage tastings upon certain licensed
8 premises under certain circumstances; making technical
9 changes; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 565.10, Florida Statutes, is amended to
14 read:
15 565.10 Distilled spirits container limit.—It is unlawful
16 for any distributor or vendor to sell or distribute distilled
17 spirits in any size container in excess of 1.8 1.75 liters or
18 60.87 59.18 ounces. The division is authorized to make
19 reasonable rules in accordance with chapter 120 governing the
20 standards of fill of distilled spirits containers, which rules
21 may shall not conflict with or be more stringent than the
22 federal regulations pertaining to such standards of fill of
23 distilled spirits containers.
24 Section 2. Subsection (1) of section 565.17, Florida
25 Statutes, is amended to read:
26 565.17 Beverage tastings by distributors, craft
27 distilleries, and vendors.—
28 (1) A licensed distributor of spirituous beverages;, a
29 distillery or craft distillery as defined in s. 565.03 or which
30 is licensed in any other state to manufacture distilled spirits;
31 a primary source of American supply licensed under s. 565.095;,
32 or any vendor may is authorized to conduct spirituous beverage
33 tastings upon any licensed premises authorized to sell
34 spirituous beverages by package or for consumption on premises
35 without being in violation of s. 561.42; however, provided that
36 the conduct of the spirituous beverage tasting must shall be
37 limited to and directed toward the general public of the age of
38 legal consumption.
39 Section 3. This act shall take effect July 1, 2024.
