       The Committee on Fiscal Policy (Harrell) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Paragraph (f) of subsection (8) of section
    6  320.08056, Florida Statutes, is amended to read:
    7         320.08056 Specialty license plates.—
    8         (8)
    9         (f) Notwithstanding paragraph (a), on January 1 of each
   10  year, the department shall discontinue the specialty license
   11  plate with the fewest number of plates in circulation, including
   12  license plates exempt from a statutory sales requirement. The
   13  department shall mail a warning letter to the sponsoring
   14  organizations of the 10 percent of specialty license plates with
   15  the lowest number of valid, active registrations as of December
   16  1 of each year. This paragraph does not apply to collegiate
   17  license plates established under s. 320.08058(3).
   18         Section 2. Subsections (3) and (47) and paragraph (c) of
   19  subsection (101) of section 320.08058, Florida Statutes, are
   20  amended, and subsections (127) through (135) are added to that
   21  section, to read:
   22         320.08058 Specialty license plates.—
   23         (3) COLLEGIATE LICENSE PLATES.—
   24         (a) The department shall develop a collegiate license plate
   25  as provided in this section for state and independent
   26  universities domiciled in this state. However, any collegiate
   27  license plate created or established after October 1, 2002, must
   28  comply with all of the requirements of s. 320.08053 except the
   29  presale requirements in s. 320.08053(2)(b) and be specifically
   30  authorized by an act of the Legislature. Collegiate license
   31  plates must bear the colors and design approved by the
   32  department as appropriate for each state and independent
   33  university. The word “Florida” must be stamped across the bottom
   34  of the plate in small letters.
   35         (b) A collegiate plate annual use fee is to be distributed
   36  to the state or independent university foundation designated by
   37  the purchaser for deposit in an unrestricted account. The Board
   38  of Governors of the State University System shall require each
   39  state university to submit a plan for approval of the
   40  expenditure of all funds so designated. These funds may be used
   41  only for academic enhancement, including scholarships and
   42  private fundraising activities.
   43         (c)If a collegiate license plate has previously been
   44  discontinued pursuant to s. 320.08056(8)(f), the college or
   45  university represented by the discontinued plate or the state in
   46  which the college or university is located may resubmit the
   47  collegiate license plate to the department for reauthorization.
   48         (47) LIVE THE DREAM LICENSE PLATES.—
   49         (a) The department shall develop a Live the Dream license
   50  plate as provided in this section. Live the Dream license plates
   51  must bear the colors and design approved by the department. The
   52  word “Florida” must appear at the top of the plate, and the
   53  words “Live the Dream” must appear at the bottom of the plate.
   54         (b) The proceeds of the annual use fee shall be distributed
   55  to the Dream Foundation, Inc., to be used in the following
   56  manner:
   57         1.Up to 5 percent may be distributed by the department to
   58  the Martin Luther King, Jr. Center for Nonviolent Social Change,
   59  Inc., as a royalty for the use of the image of Dr. Martin Luther
   60  King, Jr.
   61         2.All remaining annual proceeds from the sale of the plate
   62  shall be deposited into a separate account within the Operating
   63  Trust Fund within the Department of State and must be used to
   64  support the Historic Cemeteries Program established in s.
   65  267.21. Such funds must be used to research, identify, and
   66  record abandoned African-American cemeteries and provide grants
   67  to eligible entities pursuant to s. 267.21.
   68         1. Up to 5 percent may be used to administer, promote, and
   69  market the license plate.
   70         2. At least 25 percent shall be distributed equally among
   71  the sickle cell organizations that are Florida members of the
   72  Sickle Cell Disease Association of America, Inc., for programs
   73  that provide research, care, and treatment for sickle cell
   74  disease.
   75         3. At least 8 percent shall be used for programs and
   76  services provided directly by the Dream Foundation, Inc., which
   77  assist inmates released from the custody of a county jail in
   78  this state or a Department of Corrections facility in
   79  successfully reentering the community.
   80         4. At least 15 percent shall be distributed as grants for
   81  programs and services throughout this state which assist inmates
   82  released from the custody of a county jail in this state or a
   83  Department of Corrections facility in successfully reentering
   84  the community.
   85         5. At least 20 percent shall be distributed as scholarships
   86  to graduating high school seniors in this state who have at
   87  least one parent or legal guardian who is incarcerated, for the
   88  purpose of attending a state university, a Florida College
   89  System institution, a career center operated by a school
   90  district under s. 1001.44, or a charter technical career center
   91  under s. 1002.34. Scholarships shall be awarded through a
   92  competitive application process. Fiscal oversight of the
   93  scholarship program shall be performed by a certified public
   94  accounting firm.
   95         6. At least 22 percent shall be distributed to Chapman
   96  Partnership, Inc., for programs that provide relief from
   97  poverty, hunger, and homelessness.
   98         7. Up to 5 percent may be distributed by the department on
   99  behalf of the Dream Foundation, Inc., to The Martin Luther King,
  100  Jr. Center for Nonviolent Social Change, Inc., as a royalty for
  101  the use of the image of Dr. Martin Luther King, Jr.
  102         (101) DIVINE NINE LICENSE PLATES.—
  103         (c)1. As used in this paragraph, the term “immediate
  104  relative” means a spouse, domestic partner, or child.
  105         2. To be eligible for issuance of a Divine Nine license
  106  plate representing an organization listed in sub-subparagraphs
  107  (b)3.a.-i., a person must be a resident of this state who is the
  108  registered owner or lessee of a motor vehicle and who is either
  109  a member or an immediate relative of a member of the applicable
  110  organization. The person must also present the following:
  111         a. Proof of membership in the organization, which may be
  112  established by:
  113         (I)a. A card distributed by the organization indicating the
  114  person’s membership in the organization; or
  115         (II)b. A written letter on the organization’s letterhead
  116  which is signed by the organization’s national president or his
  117  or her designated official and which states that the person was
  118  inducted into the organization.
  119         b.If the person is a lessee of a motor vehicle, a lease
  120  agreement and the vehicle identification number for the motor
  121  vehicle being leased.
  122         c.If the person is an immediate relative of a member of
  123  the organization, a marriage license, a domestic partnership
  124  agreement, a birth certificate, or a record of adoption, and
  125  proof of membership as described in sub-subparagraph a. of the
  126  person’s immediate relative.
  127         3.2. Proof of membership in an organization listed in sub
  128  subparagraphs (b)3.a.-i. is required only for initial issuance
  129  of a Divine Nine license plate. A person need not present such
  130  proof for renewal of the license plate.
  131  
  132  License plates created pursuant to this subsection shall have
  133  their plate sales combined for the purpose of meeting the
  134  minimum license plate sales threshold in s. 320.08056(8)(a) and
  135  for determining the license plate limit in s. 320.08053(3)(b).
  136  License plates created pursuant to this subsection must be
  137  ordered directly from the department.
  138         (127) MARGARITAVILLE LICENSE PLATES.—
  139         (a)The department shall develop a Margaritaville license
  140  plate as provided in this section and in s. 320.08053. The plate
  141  must bear the colors and design approved by the department. The
  142  word “Florida” must appear at the top of the plate, and the word
  143  “Margaritaville” must appear at the bottom of the plate.
  144         (b)The annual use fees from the sale of the plate must be
  145  distributed to the SFC Charitable Foundation, Inc., also known
  146  as Singing For Change, which may use up to 10 percent of such
  147  fees for administrative costs and marketing of the plate. The
  148  balance of the fees shall be used by the SFC Charitable
  149  Foundation, Inc., and shall be distributed with the approval of
  150  and accountability to the board of directors of the SFC
  151  Charitable Foundation, Inc., to provide grants to nonprofit
  152  organizations in communities impacted by natural or manmade
  153  disasters for recovery, rebuilding, and future sustainability in
  154  those communities, and to promote and inspire local grassroots
  155  leadership that will work to improve the quality of life in
  156  those communities and others in this state.
  157         (128)GENERAL AVIATION LICENSE PLATES.—
  158         (a)The department shall develop a General Aviation license
  159  plate as provided in this section and s. 320.08053. The plate
  160  must bear the colors and design approved by the department. The
  161  word “Florida” must appear at the top of the plate, and the
  162  words “Support General Aviation” must appear at the bottom of
  163  the plate.
  164         (b)The annual use fees from the sale of the plate must be
  165  distributed to the Aerospace Center for Excellence located in
  166  Lakeland to fund scholarships for students in this state who are
  167  pursuing careers in the field of aviation. The Aerospace Center
  168  for Excellence may use up to 10 percent of such fees for
  169  administrative costs and marketing of the plate. The balance of
  170  the fees shall be used by the Aerospace Center for Excellence
  171  for the organization’s operations, activities, programs, or
  172  projects.
  173         (129) CLEARWATER MARINE AQUARIUM LICENSE PLATES.—
  174         (a)The department shall develop a Clearwater Marine
  175  Aquarium license plate as provided in this section and s.
  176  320.08053. The plate must bear the colors and design approved by
  177  the department. The word “Florida” must appear at the top of the
  178  plate, and the words “Clearwater Marine Aquarium” must appear at
  179  the bottom of the plate.
  180         (b)The annual use fees from the sale of the plate shall be
  181  distributed to Clearwater Marine Aquarium, Inc., a Florida
  182  nonprofit corporation under s. 501(c)(3) of the Internal Revenue
  183  Code, which may use up to 10 percent of the fees for the
  184  administration, promotion, and marketing of the plate. The
  185  remaining fees must be used by Clearwater Marine Aquarium, Inc.,
  186  to fund its efforts to rescue, rehabilitate, and release marine
  187  life; provide environmental education; conduct research; and
  188  promote conservation strategies.
  189         (130) UNITED SERVICE ORGANIZATIONS (USO) LICENSE PLATES.—
  190         (a)The department shall develop a United Service
  191  Organizations (USO) license plate as provided in this section
  192  and s. 320.08053. The plate must bear the colors and design
  193  approved by the department. The word “Florida” must appear at
  194  the top of the plate, and the acronym “USO” must appear at the
  195  bottom of the plate.
  196         (b)The annual use fees from the sale of the plate shall be
  197  distributed to USO Florida, Inc., a nonprofit corporation under
  198  s. 501(c)(3) of the Internal Revenue Code, which may use up to
  199  10 percent of the fees for administrative costs and marketing of
  200  the plate. USO Florida, Inc., shall distribute the remainder of
  201  the fees equally among its 10 locations in this state to be used
  202  to promote the USO’s mission of supporting members of the United
  203  States Armed Forces and their families through its various
  204  programs, services, and events.
  205         (131) RECYCLE FLORIDA LICENSE PLATES.—
  206         (a)The department shall develop a Recycle Florida license
  207  plate as provided in this section and s. 320.08053. The plate
  208  must bear the colors and design approved by the department. The
  209  word “Florida” must appear at the top of the plate, and the
  210  words “Recycle Florida” must appear at the bottom of the plate.
  211         (b)The annual use fees from the sale of the plate must be
  212  distributed to the Recycle Florida Today Foundation, Inc., which
  213  may use up to 10 percent of such fees for administrative costs
  214  and marketing of the plate. The balance of the fees shall be
  215  used by the Recycle Florida Today Foundation, Inc., to increase
  216  public awareness about the importance of recycling, resource
  217  conservation, and environmental stewardship; to promote robust,
  218  comprehensive, and sustainable recycling programs; and to
  219  support the professional development of persons employed in
  220  fields relating to recycling, conservation, and sustainability.
  221         (132)BOATING CAPITAL OF THE WORLD LICENSE PLATES.—
  222         (a)The department shall develop a Boating Capital of the
  223  World license plate as provided in this section and s.
  224  320.08053. The plate must bear the colors and design approved by
  225  the department. The word “Florida” must appear at the top of the
  226  plate, and the words “Boating Capital of the World” must appear
  227  at the bottom of the plate.
  228         (b)The annual use fees from the sale of the plate must be
  229  distributed to Captain Sandy Yawn, Inc., which may use up to 10
  230  percent of such fees for administrative costs and marketing of
  231  the plate. The balance of the fees shall be used by Captain
  232  Sandy Yawn, Inc., to increase public awareness of employment
  233  opportunities in the maritime industry; to fund maritime
  234  workforce instruction and training; to promote professional
  235  development and job placement in all sectors of employment; and
  236  to support the advancement of education of trainees in the
  237  maritime industry, both at sea and on land.
  238         (133) CURE DIABETES LICENSE PLATES.—
  239         (a)The department shall develop a Cure Diabetes license
  240  plate as provided in this section and s. 320.08053. The plate
  241  must bear the colors and design approved by the department. The
  242  word “Florida” must appear at the top of the plate, and the
  243  words “Cure Diabetes” must appear at the bottom of the plate.
  244         (b)The annual use fees from the sale of the plate must be
  245  distributed equally to the following organizations:
  246         1.The Diabetes Research Institute Foundation, which
  247  supports the Diabetes Research Institute at the University of
  248  Miami Miller School of Medicine;
  249         2.The Juvenile Diabetes Research Foundation; and
  250         3.The University of Florida Foundation, Inc., which
  251  supports the University of Florida Diabetes Institute.
  252         (c)Each organization may use up to 10 percent of the
  253  proceeds received by the organization to promote and market the
  254  plate. All remaining proceeds must be used for the purpose of
  255  funding research to cure Type 1 diabetes.
  256         (134)PROJECT ADDICTION: REVERSING THE STIGMA LICENSE
  257  PLATES.—
  258         (a)The department shall develop a Project Addiction:
  259  Reversing the Stigma license plate as provided in this section
  260  and s. 320.08053. The plate must bear the colors and design
  261  approved by the department. The word “Florida” must appear at
  262  the top of the plate, and the words “Overdose Awareness” must
  263  appear at the bottom of the plate.
  264         (b) The annual use fees from the sale of the plate shall be
  265  distributed to Project Addiction: Reversing the Stigma, Inc., a
  266  Florida nonprofit corporation, as follows:
  267         1. Up to 10 percent of the annual use fees may be used for
  268  the promotion and marketing costs of the license plate.
  269         2. The remaining funds shall be distributed with the
  270  approval of and accountability to the board of directors of
  271  Project Addiction: Reversing the Stigma, Inc., and must be used
  272  to promote and support awareness of and education about
  273  substance use disorder and mental illness.
  274         (135)THE VILLAGES: MAY ALL YOUR DREAMS COME TRUE LICENSE
  275  PLATES.—
  276         (a)The department shall develop a The Villages: May All
  277  Your Dreams Come True license plate as provided in this section
  278  and s. 320.08053. The plate must bear the colors and design
  279  approved by the department. The word “Florida” must appear at
  280  the top of the plate, and the words “The Villages: May All Your
  281  Dreams Come True” must appear at the bottom of the plate.
  282         (b)The annual use fees from the sale of the plate shall be
  283  distributed to The Villages Charter School, Inc., a Florida
  284  nonprofit corporation. Up to 10 percent of such fees may be used
  285  for administrative costs and marketing of the plate. The balance
  286  of the fees must be distributed with the approval of, and
  287  accountability to, the board of directors of The Villages
  288  Charter School, Inc., and must be used to provide support to The
  289  Villages Charter School, as it provides K-12 education.
  290         Section 3. This act shall take effect October 1, 2024.
