2 An act relating to specialty license plates; amending
3 s. 320.08056, F.S.; providing that a certain
4 discontinuation requirement for specialty license
5 plates does not apply to collegiate license plates;
6 amending s. 320.08058, F.S.; providing that collegiate
7 license plates are not subject to specified presale
8 requirements for specialty license plates; authorizing
9 certain entities to resubmit discontinued collegiate
10 license plates for reauthorization by the Department
11 of Highway Safety and Motor Vehicles; revising the
12 distribution of proceeds for the Live The Dream
13 license plate; defining the term “immediate relative”;
14 revising eligibility requirements for the Divine Nine
15 license plate; renaming the Give Kids the World
16 license plate; directing the department to develop
17 certain specialty license plates; providing for
18 distribution and use of fees collected from the sale
19 of the plates; providing an effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Paragraph (f) of subsection (8) of section
24 320.08056, Florida Statutes, is amended to read:
25 320.08056 Specialty license plates.—
26 (8)
27 (f) Notwithstanding paragraph (a), on January 1 of each
28 year, the department shall discontinue the specialty license
29 plate with the fewest number of plates in circulation, including
30 license plates exempt from a statutory sales requirement. The
31 department shall mail a warning letter to the sponsoring
32 organizations of the 10 percent of specialty license plates with
33 the lowest number of valid, active registrations as of December
34 1 of each year. This paragraph does not apply to collegiate
35 license plates established under s. 320.08058(3).
36 Section 2. Subsections (3) and (47), paragraph (c) of
37 subsection (101), and paragraph (a) of subsection (107) of
38 section 320.08058, Florida Statutes, are amended, and
39 subsections (127) through (135) are added to that section, to
40 read:
41 320.08058 Specialty license plates.—
42 (3) COLLEGIATE LICENSE PLATES.—
43 (a) The department shall develop a collegiate license plate
44 as provided in this section for state and independent
45 universities domiciled in this state. However, any collegiate
46 license plate created or established after October 1, 2002, must
47 comply with all of the requirements of s. 320.08053 except the
48 presale requirements in s. 320.08053(2)(b) and be specifically
49 authorized by an act of the Legislature. Collegiate license
50 plates must bear the colors and design approved by the
51 department as appropriate for each state and independent
52 university. The word “Florida” must be stamped across the bottom
53 of the plate in small letters.
54 (b) A collegiate plate annual use fee is to be distributed
55 to the state or independent university foundation designated by
56 the purchaser for deposit in an unrestricted account. The Board
57 of Governors of the State University System shall require each
58 state university to submit a plan for approval of the
59 expenditure of all funds so designated. These funds may be used
60 only for academic enhancement, including scholarships and
61 private fundraising activities.
62 (c) If a collegiate license plate has previously been
63 discontinued pursuant to s. 320.08056(8)(f), the college or
64 university represented by the discontinued plate or the state in
65 which the college or university is located may resubmit the
66 collegiate license plate to the department for reauthorization.
67 (47) LIVE THE DREAM LICENSE PLATES.—
68 (a) The department shall develop a Live the Dream license
69 plate as provided in this section. Live the Dream license plates
70 must bear the colors and design approved by the department. The
71 word “Florida” must appear at the top of the plate, and the
72 words “Live the Dream” must appear at the bottom of the plate.
73 (b) The proceeds of the annual use fee shall be distributed
74 to the Dream Foundation, Inc., to be used in the following
75 manner:
76 1. Up to 5 percent may be distributed by the department to
77 the Martin Luther King, Jr. Center for Nonviolent Social Change,
78 Inc., as a royalty for the use of the image of Dr. Martin Luther
79 King, Jr.
80 2. All remaining annual proceeds from the sale of the plate
81 shall be deposited into a separate account within the Operating
82 Trust Fund within the Department of State and must be used to
83 support the Historic Cemeteries Program established in s.
84 267.21. Such funds must be used to research, identify, and
85 record abandoned African-American cemeteries and provide grants
86 to eligible entities pursuant to s. 267.21.
87 1. Up to 5 percent may be used to administer, promote, and
88 market the license plate.
89 2. At least 25 percent shall be distributed equally among
90 the sickle cell organizations that are Florida members of the
91 Sickle Cell Disease Association of America, Inc., for programs
92 that provide research, care, and treatment for sickle cell
93 disease.
94 3. At least 8 percent shall be used for programs and
95 services provided directly by the Dream Foundation, Inc., which
96 assist inmates released from the custody of a county jail in
97 this state or a Department of Corrections facility in
98 successfully reentering the community.
99 4. At least 15 percent shall be distributed as grants for
100 programs and services throughout this state which assist inmates
101 released from the custody of a county jail in this state or a
102 Department of Corrections facility in successfully reentering
103 the community.
104 5. At least 20 percent shall be distributed as scholarships
105 to graduating high school seniors in this state who have at
106 least one parent or legal guardian who is incarcerated, for the
107 purpose of attending a state university, a Florida College
108 System institution, a career center operated by a school
109 district under s. 1001.44, or a charter technical career center
110 under s. 1002.34. Scholarships shall be awarded through a
111 competitive application process. Fiscal oversight of the
112 scholarship program shall be performed by a certified public
113 accounting firm.
114 6. At least 22 percent shall be distributed to Chapman
115 Partnership, Inc., for programs that provide relief from
116 poverty, hunger, and homelessness.
117 7. Up to 5 percent may be distributed by the department on
118 behalf of the Dream Foundation, Inc., to The Martin Luther King,
119 Jr. Center for Nonviolent Social Change, Inc., as a royalty for
120 the use of the image of Dr. Martin Luther King, Jr.
121 (101) DIVINE NINE LICENSE PLATES.—
122 (c)1. As used in this paragraph, the term “immediate
123 relative” means a spouse, domestic partner, or child.
124 2. To be eligible for issuance of a Divine Nine license
125 plate representing an organization listed in sub-subparagraphs
126 (b)3.a.-i., a person must be a resident of this state who is the
127 registered owner or lessee of a motor vehicle and who is either
128 a member or an immediate relative of a member of the applicable
129 organization. The person must also present the following:
130 a. Proof of membership in the organization, which may be
131 established by:
132 (I)a. A card distributed by the organization indicating the
133 person’s membership in the organization; or
134 (II)b. A written letter on the organization’s letterhead
135 which is signed by the organization’s national president or his
136 or her designated official and which states that the person was
137 inducted into the organization.
138 b. If the person is a lessee of a motor vehicle, a lease
139 agreement and the vehicle identification number for the motor
140 vehicle being leased.
141 c. If the person is an immediate relative of a member of
142 the organization, a marriage license, a domestic partnership
143 agreement, a birth certificate, or a record of adoption, and
144 proof of membership as described in sub-subparagraph a. of the
145 person’s immediate relative.
146 3.2. Proof of membership in an organization listed in sub
147 subparagraphs (b)3.a.-i. is required only for initial issuance
148 of a Divine Nine license plate. A person need not present such
149 proof for renewal of the license plate.

151 License plates created pursuant to this subsection shall have
152 their plate sales combined for the purpose of meeting the
153 minimum license plate sales threshold in s. 320.08056(8)(a) and
154 for determining the license plate limit in s. 320.08053(3)(b).
155 License plates created pursuant to this subsection must be
156 ordered directly from the department.
157 (107) UNIVERSAL ORLANDO RESORT GIVE KIDS THE WORLD LICENSE
158 PLATES.—
159 (a) The department shall develop a Universal Orlando Resort
160 Give Kids The World license plate as provided in this section
161 and s. 320.08053. The plate must bear the colors and design
162 approved by the department. The word “Florida” must appear at
163 the top of the plate, and the words “Universal Orlando Resort”
164 “Give Kids The World” must appear at the bottom of the plate.
165 (127) MARGARITAVILLE LICENSE PLATES.—
166 (a) The department shall develop a Margaritaville license
167 plate as provided in this section and in s. 320.08053. The plate
168 must bear the colors and design approved by the department. The
169 word “Florida” must appear at the top of the plate, and the word
170 “Margaritaville” must appear at the bottom of the plate.
171 (b) The annual use fees from the sale of the plate must be
172 distributed to the SFC Charitable Foundation, Inc., also known
173 as Singing For Change, which may use up to 10 percent of such
174 fees for administrative costs and marketing of the plate. The
175 balance of the fees shall be used by the SFC Charitable
176 Foundation, Inc., and shall be distributed with the approval of
177 and accountability to the board of directors of the SFC
178 Charitable Foundation, Inc., to provide grants to nonprofit
179 organizations in communities impacted by natural or manmade
180 disasters for recovery, rebuilding, and future sustainability in
181 those communities, and to promote and inspire local grassroots
182 leadership that will work to improve the quality of life in
183 those communities and others in this state.
184 (128) GENERAL AVIATION LICENSE PLATES.—
185 (a) The department shall develop a General Aviation license
186 plate as provided in this section and s. 320.08053. The plate
187 must bear the colors and design approved by the department. The
188 word “Florida” must appear at the top of the plate, and the
189 words “Support General Aviation” must appear at the bottom of
190 the plate.
191 (b) The annual use fees from the sale of the plate must be
192 distributed to the Aerospace Center for Excellence located in
193 Lakeland to fund scholarships for students in this state who are
194 pursuing careers in the field of aviation. The Aerospace Center
195 for Excellence may use up to 10 percent of such fees for
196 administrative costs and marketing of the plate. The balance of
197 the fees shall be used by the Aerospace Center for Excellence
198 for the organization’s operations, activities, programs, or
199 projects.
200 (129) CLEARWATER MARINE AQUARIUM LICENSE PLATES.—
201 (a) The department shall develop a Clearwater Marine
202 Aquarium license plate as provided in this section and s.
203 320.08053. The plate must bear the colors and design approved by
204 the department. The word “Florida” must appear at the top of the
205 plate, and the words “Clearwater Marine Aquarium” must appear at
206 the bottom of the plate.
207 (b) The annual use fees from the sale of the plate shall be
208 distributed to Clearwater Marine Aquarium, Inc., a Florida
209 nonprofit corporation under s. 501(c)(3) of the Internal Revenue
210 Code, which may use up to 10 percent of the fees for the
211 administration, promotion, and marketing of the plate. The
212 remaining fees must be used by Clearwater Marine Aquarium, Inc.,
213 to fund its efforts to rescue, rehabilitate, and release marine
214 life; provide environmental education; conduct research; and
215 promote conservation strategies.
216 (130) UNITED SERVICE ORGANIZATIONS (USO) LICENSE PLATES.—
217 (a) The department shall develop a United Service
218 Organizations (USO) license plate as provided in this section
219 and s. 320.08053. The plate must bear the colors and design
220 approved by the department. The word “Florida” must appear at
221 the top of the plate, and the acronym “USO” must appear at the
222 bottom of the plate.
223 (b) The annual use fees from the sale of the plate shall be
224 distributed to USO Florida, Inc., a nonprofit corporation under
225 s. 501(c)(3) of the Internal Revenue Code, which may use up to
226 10 percent of the fees for administrative costs and marketing of
227 the plate. USO Florida, Inc., shall distribute the remainder of
228 the fees equally among its 10 locations in this state to be used
229 to promote the USO’s mission of supporting members of the United
230 States Armed Forces and their families through its various
231 programs, services, and events.
232 (131) RECYCLE FLORIDA LICENSE PLATES.—
233 (a) The department shall develop a Recycle Florida license
234 plate as provided in this section and s. 320.08053. The plate
235 must bear the colors and design approved by the department. The
236 word “Florida” must appear at the top of the plate, and the
237 words “Recycle Florida” must appear at the bottom of the plate.
238 (b) The annual use fees from the sale of the plate must be
239 distributed to the Recycle Florida Today Foundation, Inc., which
240 may use up to 10 percent of such fees for administrative costs
241 and marketing of the plate. The balance of the fees shall be
242 used by the Recycle Florida Today Foundation, Inc., to increase
243 public awareness about the importance of recycling, resource
244 conservation, and environmental stewardship; to promote robust,
245 comprehensive, and sustainable recycling programs; and to
246 support the professional development of persons employed in
247 fields relating to recycling, conservation, and sustainability.
248 (132) BOATING CAPITAL OF THE WORLD LICENSE PLATES.—
249 (a) The department shall develop a Boating Capital of the
250 World license plate as provided in this section and s.
251 320.08053. The plate must bear the colors and design approved by
252 the department. The word “Florida” must appear at the top of the
253 plate, and the words “Boating Capital of the World” must appear
254 at the bottom of the plate.
255 (b) The annual use fees from the sale of the plate must be
256 distributed to Captain Sandy Yawn, Inc., which may use up to 10
257 percent of such fees for administrative costs and marketing of
258 the plate. The balance of the fees shall be used by Captain
259 Sandy Yawn, Inc., to increase public awareness of employment
260 opportunities in the maritime industry; to fund maritime
261 workforce instruction and training; to promote professional
262 development and job placement in all sectors of employment; and
263 to support the advancement of education of trainees in the
264 maritime industry, both at sea and on land.
265 (133) CURE DIABETES LICENSE PLATES.—
266 (a) The department shall develop a Cure Diabetes license
267 plate as provided in this section and s. 320.08053. The plate
268 must bear the colors and design approved by the department. The
269 word “Florida” must appear at the top of the plate, and the
270 words “Cure Diabetes” must appear at the bottom of the plate.
271 (b) The annual use fees from the sale of the plate must be
272 distributed equally to the following organizations:
273 1. The Diabetes Research Institute Foundation, which
274 supports the Diabetes Research Institute at the University of
275 Miami Miller School of Medicine;
276 2. The JDRF International, Incorporated, which supports the
277 JDRF Northern Florida Chapter; and
278 3. The University of Florida Foundation, Inc., which
279 supports the University of Florida Diabetes Institute.
280 (c) Each organization may use up to 10 percent of the
281 proceeds received by the organization to promote and market the
282 plate. All remaining proceeds must be used for the purpose of
283 funding research to cure Type 1 diabetes.
284 (134) PROJECT ADDICTION: REVERSING THE STIGMA LICENSE
285 PLATES.—
286 (a) The department shall develop a Project Addiction:
287 Reversing the Stigma license plate as provided in this section
288 and s. 320.08053. The plate must bear the colors and design
289 approved by the department. The word “Florida” must appear at
290 the top of the plate, and the words “Overdose Awareness” must
291 appear at the bottom of the plate.
292 (b) The annual use fees from the sale of the plate shall be
293 distributed to Project Addiction: Reversing the Stigma, Inc., a
294 Florida nonprofit corporation, as follows:
295 1. Up to 10 percent of the annual use fees may be used for
296 the promotion and marketing costs of the license plate.
297 2. The remaining funds shall be distributed with the
298 approval of and accountability to the board of directors of
299 Project Addiction: Reversing the Stigma, Inc., and must be used
300 to promote and support awareness of and education about
301 substance use disorder and mental illness.
302 (135) THE VILLAGES: MAY ALL YOUR DREAMS COME TRUE LICENSE
303 PLATES.—
304 (a) The department shall develop a The Villages: May All
305 Your Dreams Come True license plate as provided in this section
306 and s. 320.08053. The plate must bear the colors and design
307 approved by the department. The word “Florida” must appear at
308 the top of the plate, and the words “The Villages: May All Your
309 Dreams Come True” must appear at the bottom of the plate.
310 (b) The annual use fees from the sale of the plate shall be
311 distributed to The Villages Charter School, Inc., a Florida
312 nonprofit corporation. Up to 10 percent of such fees may be used
313 for administrative costs and marketing of the plate. The balance
314 of the fees must be distributed with the approval of, and
315 accountability to, the board of directors of The Villages
316 Charter School, Inc., and must be used to provide support to The
317 Villages Charter School, as it provides K-12 education.
318 Section 3. This act shall take effect October 1, 2024.
