Florida Senate - 2024 SB 470 By Senator Ingoglia 11-00780A-24 2024470__ 1 A bill to be entitled 2 An act relating to postsecondary education students; 3 amending s. 1006.61, F.S.; requiring public 4 postsecondary educational institutions to report 5 certain student information to the United States 6 Department of Homeland Security; defining the term 7 “foreign terrorist organization”; amending s. 1009.01, 8 F.S.; defining the term “foreign terrorist 9 organization”; amending s. 1009.23, F.S.; requiring a 10 Florida College System institution to assess the out 11 of-state fee for students who promote a foreign 12 terrorist organization; amending s. 1009.24, F.S.; 13 requiring a state university to assess the out-of 14 state fee for students who promote a foreign terrorist 15 organization; amending s. 1009.26, F.S.; providing 16 that students who promote a foreign terrorist 17 organization are ineligible for a fee waiver; creating 18 s. 1009.8963, F.S.; providing that students who 19 promote a foreign terrorist organization are 20 ineligible for any institutional or state grants, 21 financial aid, scholarships, or tuition assistance; 22 providing an effective date. 23 24 Be It Enacted by the Legislature of the State of Florida: 25 26 Section 1. Subsection (3) is added to section 1006.61, 27 Florida Statutes, to read: 28 1006.61 Participation by students in disruptive activities 29 at public postsecondary educational institution; penalties.— 30 (3) A public postsecondary educational institution must 31 report through the Student and Exchange Visitor Program of the 32 United States Department of Homeland Security, pursuant to 8 33 C.F.R. s. 214.3(g)(2)(ii), information relating to the current 34 status of a student who is attending the institution on an F-1 35 student visa if that student promotes any foreign terrorist 36 organization. For the purposes of this section, the term 37 “foreign terrorist organization” has the same meaning as in s. 38 1009.01(4). 39 Section 2. Subsection (4) is added to section 1009.01, 40 Florida Statutes, to read: 41 1009.01 Definitions.—The term: 42 (4) “Foreign terrorist organization” includes those 43 organizations designated by the United States Department of 44 State as a foreign organization that engages in or has the 45 capability and intent to engage in terrorist activity and 46 threatens the defense, foreign relations, or economic interests 47 of the United States. The designation includes, but is not 48 limited to, Hamas and Palestine Islamic Jihad. 49 Section 3. Subsection (22) is added to section 1009.23, 50 Florida Statutes, to read: 51 1009.23 Florida College System institution student fees.— 52 (22) A student who promotes a foreign terrorist 53 organization during any term of his or her enrollment must be 54 assessed the out-of-state fee established in subsections (3) and 55 (4) during that term and any subsequent term of enrollment. 56 Section 4. Subsection (22) is added to section 1009.24, 57 Florida Statutes, to read: 58 1009.24 State university student fees.— 59 (22) A student who promotes a foreign terrorist 60 organization during any term of his or her enrollment must be 61 assessed the out-of-state fee established in subsection (4) 62 during that term and any subsequent term of enrollment. 63 Section 5. Subsection (22) is added to section 1009.26, 64 Florida Statutes, to read: 65 1009.26 Fee waivers.— 66 (22) A student who promotes a foreign terrorist 67 organization during any term of his or her enrollment is 68 ineligible for any fee waiver under this section during that 69 term and any subsequent term of enrollment. 70 Section 6. Section 1009.8963, Florida Statutes, is created 71 to read: 72 1009.8963 Prohibition on awarding of scholarships, grants, 73 and other aid.—A student who promotes a foreign terrorist 74 organization during any term of his or her enrollment may not be 75 awarded any institutional or state grants, financial aid, 76 scholarships, or tuition assistance under this chapter during 77 that term and any subsequent term of enrollment. 78 Section 7. This act shall take effect July 1, 2024.
