House Comm: RCS . 02/16/2024 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Fiscal Policy (DiCeglie) recommended the following: 1 Senate Substitute for Amendment (499090) (with title 2 amendment) 3 4 Delete everything after the enacting clause 5 and insert: 6 Section 1. Subsection (3) is added to section 366.075, 7 Florida Statutes, to read: 8 366.075 Experimental and transitional rates; experimental 9 mechanisms.— 10 (3) The commission may establish an experimental mechanism 11 to facilitate energy infrastructure investment in gas consistent 12 with the structure set forth in s. 366.96(7) and (8) and the 13 intent of s. 366.91(1). Such gas infrastructure investment may 14 include only such investments that collect, prepare, clean, 15 process, transport, or inject gas for pipeline distribution. The 16 commission shall have discretion to determine whether such 17 mechanism is conducted in an annual proceeding. As used in this 18 subsection, the term “gas” has the same meaning as the 19 definition provided in s. 366.91(2)(f). The commission shall 20 adopt rules to implement and administer this subsection and 21 shall propose such rules for adoption as soon as practicable but 22 no later than January 1, 2025. 23 Section 2. This act shall take effect July 1, 2024. 24 25 ================= T I T L E A M E N D M E N T ================ 26 And the title is amended as follows: 27 Delete everything before the enacting clause 28 and insert: 29 A bill to be entitled 30 An act relating to energy infrastructure investment; 31 amending s. 366.075, F.S.; authorizing the Public 32 Service Commission to establish an experimental 33 mechanism that meets certain requirements to 34 facilitate certain energy infrastructure investment in 35 gas; providing requirements for gas infrastructure 36 investments; authorizing the commission to make 37 certain determinations regarding the experimental 38 mechanism; defining the term “gas”; requiring the 39 commission to adopt rules and propose such rules by a 40 specified date; providing an effective date.
