       Senator Trumbull moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 227 - 556
    4  and insert:
    5  aggregated within a 120-day 30-day period to determine the value
    6  of the property stolen and such value is $750 or more;
    7         (b) Conspires with another person to commit retail theft
    8  with the intent to sell the stolen property for monetary or
    9  other gain, and subsequently takes or causes such property to be
   10  placed in the control of another person in exchange for
   11  consideration, in which the stolen property taken or placed
   12  within a 120-day 30-day period is aggregated to determine the
   13  value of the stolen property and such value is $750 or more;
   14         (c) Individually, or in concert with one or more other
   15  persons, commits theft from more than one location within a 120
   16  day 30-day period, in which the amount of each individual theft
   17  is aggregated to determine the value of the property stolen and
   18  such value is $750 or more;
   19         (d) Acts in concert with one or more other individuals
   20  within one or more establishments to distract the merchant,
   21  merchant’s employee, or law enforcement officer in order to
   22  carry out the offense, or acts in other ways to coordinate
   23  efforts to carry out the offense and such value is $750 or more;
   24         (e) Commits the offense through the purchase of merchandise
   25  in a package or box that contains merchandise other than, or in
   26  addition to, the merchandise purported to be contained in the
   27  package or box and such value is $750 or more; or
   28         (f) Individually, or in concert with one 1 or more other
   29  persons, commits three 5 or more retail thefts within a 120-day
   30  30-day period and in committing such thefts obtains or uses 10
   31  or more items of merchandise, and the number of items stolen
   32  during each theft is aggregated within the 120-day 30-day period
   33  to determine the total number of items stolen, regardless of the
   34  value of such merchandise, and two 2 or more of the thefts occur
   35  at different physical merchant locations; or
   36         (g)Acts in concert with five or more other persons within
   37  one or more establishments for the purpose of overwhelming the
   38  response of a merchant, merchant’s employee, or law enforcement
   39  officer in order to carry out the offense or avoid detection or
   40  apprehension for the offense.
   41         (9) Except as provided in subsection (11), a person commits
   42  a felony of the second degree, punishable as provided in s.
   43  775.082, s. 775.083, or s. 775.084, if the person:
   44         (a) Violates subsection (8) and has previously been
   45  convicted of a violation of subsection (8) or of this
   46  subsection;
   47         (b) Individually, or in concert with one or more other
   48  persons, coordinates the activities of one or more persons in
   49  committing the offense of retail theft, in which the amount of
   50  each individual theft within a 120-day 30-day period is
   51  aggregated to determine the value of the stolen property and
   52  such value is in excess of $3,000;
   53         (c) Conspires with another person to commit retail theft
   54  with the intent to sell the stolen property for monetary or
   55  other gain, and subsequently takes or causes such property to be
   56  placed in control of another person in exchange for
   57  consideration, in which the stolen property taken or placed
   58  within a 120-day 30-day period is aggregated to have a value in
   59  excess of $3,000; or
   60         (d) Individually, or in concert with one 1 or more other
   61  persons, commits three 5 or more retail thefts within a 120-day
   62  30-day period and in committing such thefts obtains or uses 20
   63  or more items of merchandise, and the number of items stolen
   64  during each theft is aggregated within the 120-day 30-day period
   65  to determine the total number of items stolen, regardless of the
   66  value of such merchandise, and two 2 or more of the thefts occur
   67  at a different physical retail merchant location; or
   68         (e)Acts in concert with five or more other persons within
   69  one or more establishments for the purpose of overwhelming the
   70  response of a merchant, merchant’s employee, or law enforcement
   71  officer in order to carry out the offense or avoid detection or
   72  apprehension for the offense and, in the course of organizing or
   73  committing the offense, solicits the participation of another
   74  person in the offense through the use of a social media
   75  platform.
   76         (10) If a person commits retail theft in more than one
   77  judicial circuit within a 120-day 30-day period, the value of
   78  the stolen property resulting from the thefts in each judicial
   79  circuit may be aggregated, and the person must be prosecuted by
   80  the Office of the Statewide Prosecutor in accordance with s.
   81  16.56.
   82         (11)A person commits a felony of the first degree,
   83  punishable as provided in s. 775.082, s. 775.083, or s. 775.084,
   84  if he or she violates subsection (8) or subsection (9) and:
   85         (a)Has two or more previous convictions of violations of
   86  either or both of those subsections; or
   87         (b)Possesses a firearm during the commission of such
   88  offense.
   89         (12)A court must order a person convicted of violating
   90  this section to pay restitution, which must include the value of
   91  merchandise that was damaged or stolen and the cost of repairing
   92  or replacing any other property that was damaged in the course
   93  of committing the offense.
   94         Section 3. Paragraphs (b) and (d) through (h) of subsection
   95  (3) of section 921.0022, Florida Statutes, are amended to read:
