       The Committee on Fiscal Policy (Avila) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 145 - 155
    4  and insert:
    5         e. The agency head or a designee delegated the authority to
    6  execute contracts on behalf of the agency makes a public finding
    7  that, absent the provision of such commodities by the company,
    8  the agency would be unable to obtain the commodities for which
    9  the contract is offered.
