       Senator Rodriguez moved the following:
       
    1         Senate Amendment to Amendment (635570) (with title
    2  amendment)
    3  
    4         Between lines 2763 and 2764
    5  insert:
    6         Section 48. Paragraph (f) is added to subsection (3) of
    7  section 420.0003, Florida Statutes, to read:
    8         420.0003 State housing strategy.—
    9         (3) IMPLEMENTATION.—The state, in carrying out the strategy
   10  articulated in this section, shall have the following duties:
   11         (f)Local assistance plans must authorize the termination
   12  of recorded and unrecorded easements or rights, interests, or
   13  servitudes in the nature of easements for use of or access to a
   14  manmade lake with respect to up to no more than one-third of the
   15  area of such lake and its upland banks for purposes of
   16  redeveloping the land to create affordable housing under this
   17  chapter and pursuant to s. 196.1978 within 90 days after the
   18  date of such authorization request. The authorization may apply
   19  to easements, interests, and servitudes in favor of the public
   20  or any other party, other than a public utility or governmental
   21  body or agency. Termination of interests is achieved through a
   22  quiet title action, for which service of process may be made to
   23  a party by certified mail, return receipt requested. At the time
   24  of filing a quiet title action, a notice must be recorded in the
   25  public records in the county in which the land is located. Such
   26  notice must identify the action seeking to terminate easements,
   27  rights, or servitudes to use or access the specified lake; the
   28  interests to be terminated; the names of the record owners of
   29  those interests and the owners of the land underlying the
   30  manmade lake and its banks; and a legal description of the
   31  manmade lake and its banks. Upon issuance of a final order
   32  quieting title to any interest, such order, together with an
   33  instrument describing all interests that have been extinguished
   34  and providing a legal description of the newly established
   35  boundaries of the manmade lake, must also be recorded in the
   36  public records in the county in which the land is located.

   46         specified purpose within a certain timeframe;
   47         providing that such authorization may apply to certain
   48         easements, interests, and servitudes; providing that
   49         termination of interests is achieved through a quiet
   50         title action; requiring a notice to be recorded in the
   51         public records under certain circumstances; providing
   52         that such notice identify certain items; requiring a
   53         specified order and instruments to be recorded in the
   54         public records under certain circumstances; amending
   55         s. 561.121, F.S.;
