Florida Senate - 2024 SB 766 By Senator Stewart 17-00933-24 2024766__ 1 A bill to be entitled 2 An act relating to luring or enticing children; 3 amending s. 787.025, F.S.; increasing criminal 4 penalties for adults who intentionally lure or entice, 5 or who attempt to lure or entice, children under the 6 age of 12 into a structure, dwelling, or conveyance 7 for other than a lawful purpose; increasing criminal 8 penalties for committing a second or subsequent 9 violations of such offense; increasing criminal 10 penalties for persons with specified previous 11 convictions who commit a violation of such offense; 12 providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Subsection (2) of section 787.025, Florida 17 Statutes, is amended to read: 18 787.025 Luring or enticing a child.— 19 (2)(a) A person 18 years of age or older who intentionally 20 lures or entices, or attempts to lure or entice, a child under 21 the age of 12 into a structure, dwelling, or conveyance for 22 other than a lawful purpose commits a felonymisdemeanorof the 23 thirdfirstdegree, punishable as provided in s. 775.082,ors. 24 775.083, or s. 775.084. 25 (b) A person 18 years of age or older who, having been 26 previously convicted of a violation of paragraph (a), 27 intentionally lures or entices, or attempts to lure or entice, a 28 child under the age of 12 into a structure, dwelling, or 29 conveyance for other than a lawful purpose commits a felony of 30 the secondthirddegree, punishable as provided in s. 775.082, 31 s. 775.083, or s. 775.084. 32 (c) A person 18 years of age or older who, having been 33 previously convicted of a violation of chapter 794, s. 800.04, 34 or s. 847.0135(5), or a violation of a similar law of another 35 jurisdiction, intentionally lures or entices, or attempts to 36 lure or entice, a child under the age of 12 into a structure, 37 dwelling, or conveyance for other than a lawful purpose commits 38 a felony of the secondthirddegree, punishable as provided in 39 s. 775.082, s. 775.083, or s. 775.084. 40 Section 2. This act shall take effect October 1, 2024.
