       Senator Collins moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. This act may be cited as the “Kickstart My Heart
    6  Act.”
    7         Section 2. Section 1003.457, Florida Statutes, is created
    8  to read:
    9         1003.457Automated external defibrillators on school
   10  grounds.—
   11         (1)(a)No later than July 1, 2026, each public school,
   12  including charter schools, must have at least one operational
   13  automated external defibrillator on school grounds. The
   14  defibrillator must be available in a clearly marked and
   15  publicized location. Schools must maintain the defibrillator
   16  according to the manufacturer’s recommendations and maintain all
   17  verification records for such defibrillator.
   18         (b)The location of each defibrillator must be registered
   19  with a local emergency medical services medical director.
   20         (c)The use of defibrillators by school employees and
   21  volunteers is covered under ss. 768.13 and 768.1325.
   22         (2)Annually, beginning June 30, 2027, each school district
   23  and charter school must report to the Commissioner of Education
   24  the number of instances a defibrillator was used on school
   25  grounds and the survival rate of individuals experiencing
   26  cardiac arrest.
   27         (3)Compliance with the requirements of s. 1006.165 does
   28  not constitute compliance with this section.
   29         (4)Subject to an appropriation, the department may
   30  reimburse each school district and charter school up to 50
   31  percent of the total automated external defibrillator purchase
   32  price.
   33         (5)The State Board of Education shall adopt rules to
   34  administer this section.
   35         Section 3. This act shall take effect July 1, 2024.

   42         An act relating to automated external defibrillators
   43         on school grounds; providing a short title; creating
   44         s. 1003.457, F.S.; requiring public schools, including
   45         charter schools, to have at least one automated
   46         external defibrillator on school grounds by a
   47         specified date; providing requirements for the
   48         placement and maintenance of the defibrillators;
   49         providing immunity from liability for school employees
   50         and volunteers under the Good Samaritan Act and the
   51         Cardiac Arrest Survival Act; requiring public schools,
   52         including charter schools, to annually report
   53         specified information to the Commissioner of
   54         Education; subject to appropriation, authorizing the
   55         Department of Education to reimburse school districts
   56         and charter schools for a portion of specified
   57         purchases; requiring the State Board of Education to
   58         adopt rules; providing an effective date.
