       The Committee on Criminal Justice (Collins) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 26 - 49
    4  and insert:
    5         Section 2. Subsection (2) and paragraph (b) of subsection
    6  (3) of section 787.025, Florida Statutes, is amended to read
    7         787.025 Luring or enticing a child.—
    8         (2)(a) A person 18 years of age or older who intentionally
    9  lures or entices, or attempts to lure or entice, a child under
   10  the age of 16 12 into a structure, dwelling, or conveyance for
   11  other than a lawful purpose commits a felony misdemeanor of the
   12  third first degree, punishable as provided in s. 775.082, or s.
   13  775.083, or s. 775.084.
   14         (b) A person 18 years of age or older who, having been
   15  previously convicted of a violation of paragraph (a),
   16  intentionally lures or entices, or attempts to lure or entice, a
   17  child under the age of 16 12 into a structure, dwelling, or
   18  conveyance for other than a lawful purpose commits a felony of
   19  the second third degree, punishable as provided in s. 775.082,
   20  s. 775.083, or s. 775.084.
   21         (c) A person 18 years of age or older who, having been
   22  previously convicted of a violation of chapter 794, s. 800.04,
   23  or s. 847.0135(5), or a violation of a similar law of another
   24  jurisdiction, intentionally lures or entices, or attempts to
   25  lure or entice, a child under the age of 16 12 into a structure,
   26  dwelling, or conveyance for other than a lawful purpose commits
   27  a felony of the second third degree, punishable as provided in
   28  s. 775.082, s. 775.083, or s. 775.084.
   29         (3) It is an affirmative defense to a prosecution under
   30  this section that:
   31         (b) The person lured or enticed, or attempted to lure or
   32  entice, the child under the age of 16 12 into a structure,
   33  dwelling, or conveyance for a lawful purpose.

   38  and insert:
   39         revising the age requirements of the minor; revising
   40         the classification of specified offenses involving
   41         luring or enticing a child; providing an affirmative
