Florida Senate - 2025 SB 1194 By Senator DiCeglie 18-01125-25 20251194__ 1 A bill to be entitled 2 An act relating to mail theft; creating s. 812.136, 3 F.S.; defining terms; prohibiting a person from taking 4 certain actions regarding unlawfully obtained mail and 5 the unauthorized reproduction of a mail depository key 6 or lock; providing criminal penalties; providing an 7 effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 812.136, Florida Statutes, is created to 12 read: 13 812.136 Mail theft.— 14 (1) As used in this section, the term: 15 (a) “Mail” means any letter, postal card, parcel, envelope, 16 package, bag, or any other sealed article addressed to another, 17 along with its contents. 18 (b) “Mail depository” means a mail box, letter box, mail 19 route, or mail receptacle of a postal service, or an office, a 20 mail carrier, or a vehicle of a postal service. 21 (c) “Postal service” means the United States Postal Service 22 or its contractors, or any commercial courier that delivers 23 mail. 24 (2) A person may not: 25 (a) Remove mail from a mail depository or take mail from a 26 mail carrier of a postal service with an intent to steal. 27 (b) Obtain custody of mail by fraud or deception with an 28 intent to steal. 29 (c) Sell, receive, possess, transfer, buy, or conceal mail 30 obtained by acts described in paragraph (a) or paragraph (b), 31 while knowing or having reason to know the mail was obtained 32 illegally. 33 (d) Steal or obtain by false pretense any key or lock 34 adopted by a postal service for a mail depository or other 35 authorized receptacle for the deposit or delivery of mail. 36 (e) Knowingly and unlawfully make, forge, or counterfeit 37 any such key or possess any such key or lock adopted by a postal 38 service with the intent to unlawfully or improperly use, sell, 39 or otherwise dispose of the key or lock, or to cause the key or 40 lock to be unlawfully or improperly used, sold, or otherwise 41 disposed. 42 (3) A person who violates this section commits a felony of 43 the third degree, punishable as provided in s. 775.082 or s. 44 775.083. 45 Section 2. This act shall take effect October 1, 2025.
