       The Committee on Health Policy (Bradley) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 13 - 35
    4  and insert:
    5  through mail; penalty.—
    6         (1) It is unlawful for any person to sell or distribute
    7  prescription hearing aids through the mail to the ultimate
    8  consumer. Any person who violates this section commits a
    9  misdemeanor of the second degree, punishable as provided in s.
   10  775.082 or s. 775.083.
   11         (2)Notwithstanding subsection (1), a consumer 18 years of
   12  age or older may receive prescription hearing aids through the
   13  mail if all of the following conditions are met:
   14         (a)Before the sale, all required testing procedures
   15  specified under s. 468.1225 or s. 484.0501 are conducted by an
   16  audiologist licensed under s. 468.1185 or a hearing aid
   17  specialist licensed under s. 484.045, respectively.
   18         (b)Upon delivery of the hearing aid, all subsequent
   19  testing and fitting procedures are performed in full by the same
   20  audiologist or hearing aid specialist who conducted the required
   21  testing procedures as specified in paragraph (a).
   22         (c)The prescription hearing aid provider complies with the
   23  consumer protection standards of this part, including ss.
   24  468.1246 and 468.1255, or part II of chapter 484, including ss.
   25  484.0512 and 484.0513, as applicable.
   26         Section 2. Section 484.054, Florida Statutes, is amended to
   27  read:
   28         484.054 Sale or distribution of prescription hearing aids
   29  through mail; penalty.—
   30         (1) It is unlawful for any person to sell or distribute
   31  prescription hearing aids through the mail to the ultimate
   32  consumer. Any violation of this section constitutes a
   33  misdemeanor of the second degree, punishable as provided in s.
   34  775.082 or s. 775.083.
   35         (2)Notwithstanding subsection (1), a consumer 18 years of
   36  age or older may receive prescription hearing aids through the
   37  mail if all of the following conditions are met:
   38         (a)Before the sale, all required testing procedures
   39  specified under s. 468.1225 or s. 484.0501 are conducted by an

   41  specialist licensed under s. 484.045, respectively.

   48  including ss. 468.1246 and 468.1255, or this part, including ss.
   49  484.0512 and 484.0513, as applicable.
