    1                        A bill to be entitled                      
    2         An act relating to trust funds; re-creating the
    3         Resilient Florida Trust Fund within the Department of
    4         Environmental Protection; amending s. 380.0935, F.S.;
    5         abrogating provisions relating to the termination of
    6         the trust fund; providing an effective date.

    8         WHEREAS, the Legislature wishes to extend the life of the
    9  Resilient Florida Trust Fund within the Department of
   10  Environmental Protection, which is otherwise scheduled to be
   11  terminated pursuant to constitutional mandate, and
   12         WHEREAS, the Legislature has reviewed the trust fund before
   13  its scheduled termination date and has found that it continues
   14  to meet an important public purpose, and
   15         WHEREAS, the Legislature has found that existing public
   16  policy concerning the trust fund sets adequate parameters for
   17  its use, NOW, THEREFORE,

   19  Be It Enacted by the Legislature of the State of Florida:
   20  
   21         Section 1. The Resilient Florida Trust Fund within the
   22  Department of Environmental Protection, FLAIR number 20-2-055,
   23  which is to be terminated pursuant to s. 19(f), Article III of
   24  the State Constitution on July 1, 2025, is re-created.
   25         Section 2. Subsection (3) of section 380.0935, Florida
   26  Statutes, is amended to read:
   27         380.0935 Resilient Florida Trust Fund.—
   28         (3) In accordance with s. 19(f)(2), Art. III of the State
   29  Constitution, the Resilient Florida Trust Fund shall, unless
   30  terminated sooner, be terminated on July 1, 2025. Before its
   31  scheduled termination, the fund shall be reviewed as provided in
   32  s. 215.3206(1) and (2).
   33         Section 3. This act shall take effect July 1, 2025.
