39 and supervisors of elections; requiring a supervisor
40 of elections to remove certain persons from the
41 statewide voter registration system; amending s.
42 97.0575, F.S.; requiring a third-party voter
43 registration organization to provide a certain
44 affirmation to the Division of Elections; amending s.
45 97.058, F.S.; requiring voter registration agencies to
46 provide certain applicants the opportunity to register
47 to vote or update their voter registration record at
48 the time of certain applications; revising the list of
49 questions certain voter registration agencies must
50 include on a certain form; amending s. 97.0585, F.S.;
51 providing that certain information is not exempt from
52 public records requirements; amending s. 97.1031,
53 F.S.; requiring a supervisor of elections to verify an
54 elector’s eligibility status using all available data

65 department to adopt rules; conforming a cross
66 reference; amending s. 98.065, F.S.; requiring a
67 supervisor of elections to conduct certain bulk list
68 maintenance at least quarterly; requiring a supervisor
69 of elections to at least quarterly analyze the voter
70 registration database for a certain purpose and to
71 take certain actions; amending s. 98.075, F.S.;
72 requiring a supervisor of elections to remove certain
73 names from the statewide voter registration system
74 after certain verification using Department of Highway
75 Safety and Motor Vehicles records; requiring a
76 supervisor of elections to take certain actions upon
77 receipt of, access to, or knowledge of certain
78 information from a credible source; specifying, for
79 the purpose of determining elector eligibility,
80 credible sources of certain information; requiring a
81 supervisor of elections to send an address
82 confirmation and an address confirmation final notice
83 in certain circumstances; amending s. 98.093, F.S.;
84 requiring state and local government agencies to
85 facilitate the provision of certain information and
86 data access to the Department of State and supervisors
87 of elections; amending s. 98.255, F.S.; requiring the
88 Department of State to adopt rules relating to a
89 revised list of standards for nonpartisan voter
90 education; requiring a county supervisor to provide
91 certain education; amending s. 101.043, F.S.;
92 requiring that an elector be allowed to vote a
93 provisional ballot under specified conditions;
94 amending s. 101.6921, F.S.; revising the items that
95 are enclosed with each ballot sent by the supervisor
96 of elections to voters; revising the voter’s
97 certificate to conform to changes made by the act;
98 amending s. 101.6923, F.S.; revising the instructions
99 sent to certain voters to conform to changes made by
100 the act; amending s. 322.08, F.S.; requiring
101 applicants to present a social security card;
102 requiring that the department note the type of social
103 security card presented in the applicant’s record;
104 amending s. 322.14, F.S.; requiring that driver
105 licenses include a certain denotation under specified
106 conditions; amending s. 322.141, F.S.; requiring that
107 Florida identification card include a certain
108 denotation under specified conditions; providing an
109 effective date.

111 Be It Enacted by the Legislature of the State of Florida:
112
113 Section 1. Section 97.026, Florida Statutes, is amended to
114 read:
115 97.026 Forms to be available in alternative formats and via
116 the Internet.—
117 (1) It is the intent of the Legislature that all forms
118 required to be used in chapters 97-106 shall be made available
119 upon request, in alternative formats. Such forms must shall
120 include vote-by-mail ballots if as alternative formats for such
121 ballots become available and the Division of Elections is able
122 to certify systems that provide them. Whenever possible, such
123 forms, with the exception of vote-by-mail ballots, must shall be
124 made available by the Department of State via the Internet.
125 Sections that contain such forms include, but are not limited
126 to, ss. 97.051, 97.052, 97.053, 97.057, 97.058, 97.0583, 97.071,
127 97.073, 97.1031, 98.075, 99.021, 100.361, 100.371, 101.045,
128 101.171, 101.20, 101.6103, 101.62, 101.64, 101.65, 101.657,
129 105.031, 106.023, and 106.087.
130 (2) Instructions on how to cancel voter registration must
131 be prominently displayed on any website that instructs voters on
132 how to update their voter registration information.
133 Section 2. Paragraph (n) of subsection (2) and paragraph
134 (f) of subsection (3) of section 97.052, Florida Statutes, are
135 amended to read:
136 97.052 Uniform statewide voter registration application.—
137 (2) The uniform statewide voter registration application
138 must be designed to elicit the following information from the
139 applicant:
140 (n) Florida driver license number or the identification
141 number from a Florida identification card issued under s.
142 322.051, and the last four digits of the applicant’s social
143 security number.
144 (3) The uniform statewide voter registration application
145 must also contain:
146 (f) A statement informing an applicant who has not been
147 issued a Florida driver license, a Florida identification card,
148 or a social security number that, if the application is
149 submitted by mail and the applicant is registering for the first
150 time in this state, the applicant will be required to provide
151 identification before prior to voting the first time.
152 Section 3. Subsection (6) of section 97.053, Florida
153 Statutes, is amended to read:
154 97.053 Acceptance of voter registration applications.—
155 (6)(a) A voter registration application, including an
156 application with a change in name, address, or party
157 affiliation, may be accepted as valid only after the department
158 has verified the authenticity or nonexistence of the driver
159 license number, the Florida identification card number, or the
160 last four digits of the social security number provided by the
161 applicant.
162 1. If the voter registration applicant applies using a
163 driver license or Florida identification card number, the
164 department and the supervisor of elections must also verify that
165 the driver license number or Florida identification card number
166 was not obtained using non-United States citizen documentation
167 and that the applicant is classified as a United States citizen
168 in Department of Highway Safety and Motor Vehicles records. If
169 the driver license was obtained using non-United States citizen
170 documentation, every possible means must be used to determine
171 whether the applicant became a naturalized citizen after
172 obtaining his or her driver license. The department may not
173 accept as valid a voter registration application if non-United
174 States citizen status is indicated and must document the result
175 of checks completed to confirm that none of the supplied
176 credentials indicate non-United States citizen status.
177 2. If the voter registration applicant applies using the
178 last four digits of his or her social security number, the
179 department must use all possible means to verify citizenship
180 status and the applicant is required to present his or her
181 social security card before voting for the first time in this
182 state. A voter who, at the polling place, presents a social
183 security card that contains a work restriction must vote on a
184 provisional ballot and provide proof of citizenship before his
185 or her vote may be counted.
186 3. If the voter registration applicant applies without a
187 driver license number, Florida identification card number, or
188 social security number, all possible means must be used to
189 verify citizenship status, including data from the courts, the
190 Department of Corrections, the Department of Children and
191 Families, or any other governmental agency that collects
192 citizenship data. If there are no findings that indicate that
193 the applicant is not a United States citizen, the application
194 may be accepted as valid.
195 4. The voter registration applicant’s eligibility to vote
196 pursuant to s. 97.041 must be verified by comparing information
197 from all available sources, including the department’s records,
198 to determine whether the applicant’s driver license is currently
199 classified by the department as a non-United States citizen
200 license, a surrendered license of a person who moved out of
201 state, or a license of a person who is deceased.
202 5. If a supervisor of elections determines that false
203 affirmations have been knowingly made on a voter registration
204 application, the matter must be referred to the Office of
205 Election Crimes and Security.
206 (b) If a completed voter registration application has been
207 received by the book-closing deadline but the driver license
208 number, the Florida identification card number, or the last four
209 digits of the social security number provided by the applicant
210 cannot be verified, the applicant must shall be notified that
211 the number cannot be verified and that the applicant must
212 provide evidence to the supervisor sufficient to verify the
213 authenticity of the applicant’s driver license number, Florida
214 identification card number, or last four digits of the social
215 security number. If the applicant provides the necessary
216 evidence, the supervisor must shall place the applicant’s name
217 on the registration rolls as an active voter. If the applicant
218 has not provided the necessary evidence or the number has not
219 otherwise been verified before prior to the applicant presents
220 presenting himself or herself to vote, the applicant must shall
221 be provided a provisional ballot. The provisional ballot may
222 shall be counted only if the number is verified by the end of
223 the canvassing period or if the applicant presents evidence to
224 the supervisor of elections sufficient to verify the
225 authenticity of the applicant’s driver license number, Florida
226 identification card number, or last four digits of the social
227 security number no later than 5 p.m. of the second day following
228 the election.
229 Section 4. Section 97.0535, Florida Statutes, is amended to
230 read:
231 97.0535 Special requirements for certain applicants.—
232 (1) Each applicant who registers by any method other than
233 at an office of the Department of Highway Safety and Motor
234 Vehicles mail and who has never previously voted in this the
235 state and who the department has verified has not been issued a
236 current and valid Florida driver license or, Florida
237 identification card, or social security number shall be required
238 to provide a copy of a current and valid identification, as
239 provided in subsection (3), or indicate that he or she is exempt
240 from the requirements before prior to voting. Such
241 identification or indication may be provided at the time of
242 registering, or at any time before prior to voting for the first
243 time in the state. If the voter registration application clearly
244 provides information from which a voter registration official
245 can determine that the applicant meets at least one of the
246 exemptions in subsection (4), the voter registration official
247 must shall make the notation on the registration records of the
248 statewide voter registration system and the applicant is shall
249 not be required to provide the identification required by this
250 section.
251 (2) The voter registration official shall, upon accepting
252 the voter registration application submitted pursuant to
253 subsection (1), determine whether if the applicant provided the
254 required identification at the time of registering. If the
255 required identification was not provided, the supervisor must
256 shall notify the applicant that he or she must provide one of
257 the following forms of identification before prior to voting the
258 first time in this the state.
259 (3)(a) The following forms of identification shall be
260 considered current and valid if they contain the name and
261 photograph of the applicant and have not expired:
262 1. United States passport.
263 2. United States birth certificate, accompanied by an
264 acceptable form of identification that contains the name and
265 photograph of the applicant.
266 3. United States naturalization papers, accompanied by an
267 acceptable form of identification that contains the name and
268 photograph of the applicant.
269 4. A consular report of birth abroad provided by the United
270 States Department of State, accompanied by an acceptable form of
271 identification that contains the name and photograph of the
272 applicant.
273 5. A social security card that does not contain a work
274 restriction, accompanied by an acceptable form of identification
275 that contains the name and photograph of the applicant.
276 (b) Acceptable forms of identification for purposes of
277 subparagraphs (a)1.-5. include the following:
278 1.2. Debit or credit card.
279 2.3. Military identification.
280 3.4. Student identification.
281 4.5. Retirement center identification.
282 6. Neighborhood association identification.
283 5.7. Public assistance identification.
284 6.8. Veteran health identification card issued by the
285 United States Department of Veterans Affairs.
286 7.9. A license to carry a concealed weapon or firearm
287 issued pursuant to s. 790.06.
288 8.10. Employee identification card issued by any branch,
289 department, agency, or entity of the Federal Government, the
290 state, a county, or a municipality.
291 (c)(b) The following forms of identification shall be
292 considered proof of residential address current and valid if
293 they are dated within the last 2 months and contain the name and
294 current residence address of the applicant as provided in the
295 voter registration application:
296 1. Utility bill.
297 2. Bank statement.
298 3. Government check.
299 4. Paycheck.
300 5. Other government document, (excluding voter
301 identification card).
302 (4) The following persons are exempt from the
303 identification requirements of this section:
304 (a) Persons 65 years of age or older.
305 (a)(b) Persons with a temporary or permanent physical
306 disability, as documented by a doctor’s note provided to a voter
307 registration official.
308 (b)(c) Members of the uniformed service on active duty, as
309 documented by a current military identification provided to a
310 voter registration official, who, by reason of such active duty,
311 are absent from the county on election day.
312 (c)(d) Members of the Merchant Marine, as documented by a
313 current Merchant Marine identification provided to a voter
314 registration official, who, by reason of service in the Merchant
315 Marine, are absent from the county on election day.
316 (d)(e) The spouse or dependent of a member referred to in
317 paragraph (b) (c) or paragraph (c), as documented by a uniformed
318 services dependent identification, (d) who, by reason of the
319 active duty or service of the member, is absent from the county
320 on election day.
321 (5)(f) A person Persons currently residing outside the
322 United States who is are eligible to vote in Florida and who is
323 not exempt from the identification requirements of this section
324 under subsection (4) must meet the requirements of subsection
325 (3) except that he or she may provide one of the following items
326 in lieu of a document listed in paragraph (3)(c):
327 (a) A document listed in paragraph (3)(c) which is not
328 current, accompanied by an equivalent document providing his or
329 her residential address outside the United States.
330 (b) A consular report of birth abroad provided by the
331 United States Department of State, accompanied by proof that his
332 or her parents previously resided in this state.
333 (6) Identification required under this section may be
334 submitted in the same manner as provided in s. 101.68(4)(d).
335 Section 5. Present subsections (3) through (5) and (6)
336 through (13) of section 97.057, Florida Statutes, are
337 redesignated as subsections (4) through (6) and (8) through
338 (15), respectively, subsections (1) and (2) and present
339 subsections (5) and (10) are amended, and new subsections (3)
340 and (7) and subsections (16) and (17) are added to that section,
341 to read:
342 97.057 Voter registration by the Department of Highway
343 Safety and Motor Vehicles.—
344 (1) The Department of Highway Safety and Motor Vehicles
345 shall provide the opportunity to register to vote or to update a
346 voter registration record to each individual classified in
347 Department of Highway Safety and Motor Vehicles records as a
348 United States citizen who comes to an office of the Department
349 of Highway Safety and Motor Vehicles that department to:
350 (a) Apply for or renew a driver license;
351 (b) Apply for or renew an identification card pursuant to
352 chapter 322; or
353 (c) Change an address on an existing driver license or
354 identification card.
355 (2) The Department of Highway Safety and Motor Vehicles
356 shall:
357 (a) Notify each individual who is classified in Department
358 of Highway Safety and Motor Vehicles records as a United States
359 citizen, orally or in writing, that:
360 1. Information gathered for the completion of a driver
361 license or identification card application, renewal, or change
362 of address can be automatically transferred to a voter
363 registration application;
364 2. If additional information and a signature are provided,
365 the voter registration application will be completed and sent to
366 the proper election authority;
367 3. Information provided can also be used to update a voter
368 registration record, except that party affiliation will not be
369 changed unless the individual designates a change in party
370 affiliation and separately consents to such change in writing;
371 4. All declinations will remain confidential and may be
372 used only for voter registration purposes; and
373 5. The particular driver license office in which the person
374 applies to register to vote or updates a voter registration
375 record will remain confidential and may be used only for voter
376 registration purposes.
377 (b) Require a driver license examiner to inquire orally or,
378 if the applicant is hearing impaired, inquire in writing whether
379 the applicant wishes to register to vote or update a voter
380 registration record during the completion of a driver license or
381 identification card application, renewal, or change of address.
382 1. If the applicant chooses to register to vote or to
383 update a voter registration record:
384 a. All applicable information received by the Department of
385 Highway Safety and Motor Vehicles in the course of filling out
386 the forms necessary under subsection (1) must be transferred to
387 a voter registration application.
388 b. The additional necessary information must be obtained by
389 the driver license examiner and must not duplicate any
390 information already obtained while completing the forms required
391 under subsection (1).
392 c. A voter registration application with all of the
393 applicant’s voter registration information required to establish
394 the applicant’s eligibility pursuant to s. 97.041 must be
395 presented to the applicant to review and verify the voter
396 registration information received and to provide a wet signature
397 and an electronic signature affirming the accuracy of the
398 information provided.
399 d. The voter registration application may not be used to
400 change the party affiliation of the applicant unless the
401 applicant designates a change in party affiliation and provides
402 a separate signature consenting to the party affiliation change.
403 e. After verifying the voter registration information and
404 providing his or her electronic signature, the applicant must be
405 provided with a printed receipt that includes such information
406 and documents any change in party affiliation.
407 2. If the applicant declines to register to vote, update
408 the applicant’s voter registration record, or change the
409 applicant’s address by either orally declining or by failing to
410 sign the voter registration application, the Department of
411 Highway Safety and Motor Vehicles must note such declination on
412 its records and shall forward the declination to the statewide
413 voter registration system.
414 (3) The Department of Highway Safety and Motor Vehicles
415 shall offer an individual identified as not being a United
416 States citizen the opportunity to update his or her driver
417 license classification upon becoming a United States citizen.
418 Upon updating his or her driver license classification to
419 reflect United States citizenship, the individual must be
420 offered the opportunity to register to vote.
421 (6)(5) The Department of Highway Safety and Motor Vehicles
422 shall must send, with each driver license renewal issued
423 extension application authorized pursuant to s. 322.18(8) and
424 sent to any individual classified in the Department of Highway
425 Safety and Motor Vehicles records as a United States citizen,
426 include a uniform statewide voter registration application, the
427 voter registration application prescribed under paragraph (4)(a)
428 (3)(a), or a voter registration application developed especially
429 for the purposes of this subsection by the Department of Highway
430 Safety and Motor Vehicles, with the approval of the Department
431 of State, which must meet the requirements of s. 97.052.
432 (7) The Department of Highway Safety and Motor Vehicles
433 shall, with each driver license renewal issued pursuant to s.
434 322.18(8) and sent to an individual classified in the Department
435 of Highway Safety and Motor Vehicles records as a non-United
436 States citizen, include instructions on how he or she may update
437 his or her driver license classification upon becoming a United
438 States citizen.
439 (12)(10) The department shall provide the Department of
440 Highway Safety and Motor Vehicles with an electronic database of
441 street addresses valid for use as the address of legal residence
442 as required in s. 97.053(5). The Department of Highway Safety
443 and Motor Vehicles shall compare the address provided by the
444 applicant against the database of valid street addresses. If the
445 address provided by the applicant does not match a valid street
446 address in the database, the applicant will be asked to verify
447 the address provided. The Department of Highway Safety and Motor
448 Vehicles may shall not reject any application for voter
449 registration for which a valid match cannot be made; however,
450 the department shall inform the voter that he or she may be
451 required to vote in person until the address is corrected.
452 (16)(a) The Department of Highway Safety and Motor Vehicles
453 shall notify the Department of State when a driver license has
454 been made invalid due to the issuance of a driver license in
455 another state or due to notification of death. The Department of
456 State shall report each such change to the appropriate
457 supervisor of elections, who shall remove the registered voter
458 from the statewide voter registration system in accordance with
459 s. 98.075(3)(a) or (7), as applicable.
460 (b) The Department of Highway Safety and Motor Vehicles
461 shall make driver license surrendered and death reports
462 available in weekly reports to the Department of State and make
463 driver license surrendered and death status available by means
464 of online or written query and customized reports to the
465 Department of State and supervisors of elections.
466 (17)(a) The Department of Highway Safety and Motor Vehicles
467 shall notify the Department of State when a Florida
468 identification card or driver license has been obtained with
469 documentation that indicates that the applicant is not a United
470 States citizen. Documentation deemed to indicate that an
471 individual is not a United States citizen includes social
472 security cards that contain a work restriction, alien
473 registration receipt cards, employment authorization cards
474 issued by the United States Department of Homeland Security, and
475 proof of nonimmigrant classification provided by the United
476 States Department of Homeland Security.
477 (b) The Department of Highway Safety and Motor Vehicles
478 shall make non-United States citizen status available in weekly
479 reports to the Department of State and available by means of
480 online or written query and customized reports to the Department
481 of State and supervisors of elections. An individual identified
482 as a non-United States citizen from such reports by a supervisor
483 of elections must be removed by the supervisor from the
484 statewide voter registration system in accordance with s.
485 98.075(7).
486 Section 6. Paragraph (g) is added to subsection (1) of
487 section 97.0575, Florida Statutes, to read:
488 97.0575 Third-party voter registration organizations.—
489 (1) Before engaging in any voter registration activities, a
490 third-party voter registration organization must register and
491 provide to the division, in an electronic format, the following
492 information:
493 (g) An affirmation that each person collecting voter
494 registration applications on behalf of the third-party voter
495 registration organization:
496 1. Will not knowingly solicit persons who are not United
497 States citizens to register to vote;
498 2. Will incorporate citizenship status and other
499 eligibility requirements listed in s. 97.041 in screening
500 questions; and
501 3. Will provide any individual who indicates that he or she
502 is not a United States citizen or who displays a driver license
503 indicating that he or she is not a United States citizen with
504 instructions on how to register to vote upon becoming a United
505 States citizen.
506 Section 7. Subsection (1) and paragraph (a) of subsection
507 (2) of section 97.058, Florida Statutes, are amended to read:
508 97.058 Voter registration agencies.—
509 (1) Each voter registration agency shall must provide each
510 applicant who states that he or she is a United States citizen
511 on their application or presents a current and valid Florida
512 driver license or Florida identification card indicating he or
513 she is a United States citizen, the opportunity to register to
514 vote or to update a voter registration record, at the time the
515 applicant applies for services or assistance from that agency,
516 for renewal of such services or assistance, or for a change of
517 address required with respect to the services or assistance.
518 (2) Each voter registration agency, other than a public
519 library, must develop and provide each applicant with a form
520 approved by the department containing all of the following:
521 (a) The questions:
522 1. “Are you a United States citizen? If yes, continue.”
523 2. “If you are not registered to vote where you live now,
524 would you like to apply to register to vote today?”
525 3.2. “If you are registered to vote where you live now,
526 would you like to update your voter registration record?”
527 Section 8. Paragraphs (b) and (c) of subsection (1) of
528 section 97.0585, Florida Statutes, are amended to read:
529 97.0585 Public records exemption; information regarding
530 voters and voter registration; confidentiality.—
531 (1) The following information held by an agency, as defined
532 in s. 119.011, and obtained for the purpose of voter
533 registration is confidential and exempt from s. 119.07(1) and s.
534 24(a), Art. I of the State Constitution and may be used only for
535 purposes of voter registration:
536 (b) Information relating to the place where a person
537 registered to vote or where a person updated a voter
538 registration, except for information relating to the method of
539 registration.
540 (c) The social security number, driver license number, and
541 Florida identification number of a voter registration applicant
542 or voter, except for information relating to the type of number
543 provided.
544 Section 9. Paragraph (a) of subsection (1) of section
545 97.1031, Florida Statutes, is amended to read:
546 97.1031 Notice of change of residence, change of name, or
547 change of party affiliation.—
548 (1)(a) When an elector changes his or her residence
549 address, the elector must notify the supervisor of elections and
550 the supervisor shall verify the elector’s eligibility status
551 using all available data sources. Except as provided in
552 paragraph (b), an address change must be submitted using a voter
553 registration application.
554 Section 10. Subsection (1) and paragraphs (a) and (b) of
555 subsection (4) of section 98.045, Florida Statutes, are amended,
556 and paragraph (c) is added to subsection (2) of that section, to
557 read:
558 98.045 Administration of voter registration.—
559 (1) ELIGIBILITY OF APPLICANT.—The supervisor must ensure
560 that any eligible applicant for voter registration is registered
561 to vote and that each application for voter registration is
562 processed in accordance with law. The supervisor shall, using
563 all available data sources, determine whether a voter
564 registration applicant is ineligible based on any of the
565 following:
566 (a) The failure to complete a voter registration
567 application as specified in s. 97.053.
568 (b) The applicant is deceased.
569 (c) The applicant has been convicted of a felony for which
570 his or her voting rights have not been restored.
571 (d) The applicant has been adjudicated mentally
572 incapacitated with respect to the right to vote and such right
573 has not been restored.
574 (e) The applicant does not meet the age requirement
575 pursuant to s. 97.041.
576 (f) The applicant is not a United States citizen.
577 (g) The applicant is a fictitious person.
578 (h) The applicant has provided an address of legal
579 residence that is not his or her legal residence.
580 (i) The applicant has provided a driver license number,
581 Florida identification card number, or the last four digits of a
582 social security number that is not verifiable by the department.
583 (2) REMOVAL OF REGISTERED VOTERS.—
584 (c) Information received from the Department of Highway
585 Safety and Motor Vehicles indicating that a registered voter in
586 this state has obtained a driver license in another state is
587 considered a written request from the voter to have the voter’s
588 name removed from the statewide voter registration system.
589 (4) STATEWIDE ELECTRONIC DATABASE OF VALID RESIDENTIAL
590 STREET ADDRESSES.—
591 (a) The department shall compile and maintain a statewide
592 electronic database of valid residential street addresses from
593 the information provided by the supervisors of elections
594 pursuant to s. 98.015. The department shall evaluate the
595 information provided by the supervisors of elections to identify
596 any duplicate addresses and any address that may overlap county
597 boundaries. The department shall include in the database the
598 maximum number of occupants in accordance with the applicable
599 zoning regulations at each address. The department and
600 supervisors of elections shall use all available data sources
601 and methods to update mailing and registration addresses to be
602 accurate and CASS-compliant residential addresses. The
603 department shall adopt rules that specify such sources and
604 methods.
605 (b) The department shall make the statewide database of
606 valid street addresses available to the Department of Highway
607 Safety and Motor Vehicles as provided in s. 97.057(12) s.
608 97.057(10). The Department of Highway Safety and Motor Vehicles
609 shall use the database for purposes of validating the legal
610 residential addresses provided in voter registration
611 applications received by the Department of Highway Safety and
612 Motor Vehicles.
613 Section 11. Present subsection (7) of section 98.065,
614 Florida Statutes, is redesignated as subsection (9), and a new
615 subsection (7) and subsection (8) are added to that section, to
616 read:
617 98.065 Registration list maintenance programs.—
618 (7) The supervisor of elections shall at least quarterly
619 conduct bulk list maintenance by comparing the county voter roll
620 to customized reports from the Department of Highway Safety and
621 Motor Vehicles, the Department of Children and Families, and
622 other sources that may identify persons who are not United
623 States citizens, persons who have moved out of state, persons
624 who are deceased, and persons who are otherwise ineligible.
625 (8) The supervisor of elections shall at least quarterly
626 analyze the voter registration database to determine whether any
627 addresses have more registered voters than allowed by applicable
628 zoning regulations. If the number of registered voters exceeds
629 the number allowed by the applicable zoning regulations, all
630 available sources must be used to determine whether any voters
631 at that addresses have moved or become ineligible. If a voter is
632 determined to have moved, the supervisor of elections must
633 adhere to the procedures provided in subsection (4). If a voter
634 is determined to be ineligible, the supervisor of elections must
635 adhere to the procedures for removal pursuant to s. 98.075(7).
636 Section 12. Paragraph (b) of subsection (3) and subsection
637 (6) of section 98.075, Florida Statutes, are amended to read:
638 98.075 Registration records maintenance activities;
639 ineligibility determinations.—
640 (3) DECEASED PERSONS.—
641 (b) The supervisor shall remove the name of a deceased
642 registered voter from the statewide voter registration system
643 within 7 days after receipt of a copy of a death certificate
644 issued by a governmental agency authorized to issue death
645 certificates or verified with information from Department of
646 Highway Safety and Motor Vehicles records that the registered
647 voter is deceased.
648 (6) OTHER BASES FOR INELIGIBILITY.—Subsections (2)-(5) do
649 not limit or restrict the department or the supervisor in his or
650 her duty to act upon direct receipt of, access to, or knowledge
651 of information from any credible source governmental entity that
652 identifies a registered voter as potentially ineligible. If the
653 department or supervisor receives information from any credible
654 source governmental entity other than those identified in
655 subsections (2)-(5) that a registered voter is ineligible
656 because the voter is deceased, adjudicated a convicted felon
657 without having had his or her voting rights restored,
658 adjudicated mentally incapacitated without having had his or her
659 voting rights restored, does not meet the age requirement
660 pursuant to s. 97.041, is not a United States citizen, is a
661 fictitious person, has surrendered his or her driver license to
662 another state, or has listed an address that is not his or her
663 address of legal residence, the supervisor must adhere to the
664 procedures set forth in subsection (7) before the removal of the
665 name of a registered voter who is determined to be ineligible
666 from the statewide voter registration system.
667 (a) The following are deemed credible sources from which
668 the department or a supervisor may determine whether an elector
669 is ineligible and subject to the procedures for removal set
670 forth in subsection (7) or has had a change of address and is
671 subject to the procedures required under s. 98.065(4):
672 1. An affidavit from a rental or group living facility
673 manager, verified with information from the Department of
674 Highway Safety and Motor Vehicles records, county tax records,
675 or other credible sources.
676 2. An affidavit from a homeowner association manager,
677 verified with information from the Department of Highway Safety
678 and Motor Vehicles records, county tax records, or other
679 credible sources.
680 3. An affidavit from a county resident, verified with
681 information from the Department of Highway Safety and Motor
682 Vehicles records, county tax records, or other credible sources.
683 4. Social security death index licensees, provided that the
684 social security number matches the registered voter’s social
685 security number and the information is verified by the
686 department or Department of Highway Safety and Motor Vehicles
687 personnel with direct access to the social security death index
688 file.
689 (b) If the information from such an affidavit or a licensee
690 cannot be verified using a second credible source, the
691 supervisor must send an address confirmation to the registered
692 voter. If the registered voter does not respond to the address
693 confirmation within 30 days, the supervisor must send an address
694 confirmation final notice to the registered voter.
695 Section 13. Subsection (1) of section 98.093, Florida
696 Statutes, is amended to read:
697 98.093 Duty of officials to furnish information relating to
698 deceased persons, persons adjudicated mentally incapacitated,
699 persons convicted of a felony, and persons who are not United
700 States citizens.—
701 (1) DUTIES.—In order to identify ineligible registered
702 voters and maintain accurate and current voter registration
703 records in the statewide voter registration system pursuant to
704 procedures in s. 98.065 or s. 98.075, it is necessary for the
705 department and supervisors of elections to receive or access
706 certain information from state and federal officials and
707 entities in the format prescribed. To the maximum extent
708 feasible, state and local government agencies shall facilitate
709 provision of information and access to data to the department
710 and supervisors of elections, including, but not limited to,
711 databases and customized reports in a format that can be used by
712 election officials to compare with voter registration data to
713 identify registered voters who are ineligible due to that
714 contain reliable criminal records, and records of deceased
715 status, surrendered driver licenses, a change of address, or
716 citizenship status persons. State and local government agencies
717 that provide such data must do so without charge if the direct
718 cost incurred by those agencies is not significant.
719 Section 14. Subsections (1) and (2) of section 98.255,
720 Florida Statutes, are amended to read:
721 98.255 Voter education programs.—
722 (1) The Department of State shall adopt rules prescribing
723 minimum standards for nonpartisan voter education. The standards
724 must shall, at a minimum, address all of the following:
725 (a) Voter registration.;
726 (b) Balloting procedures, by mail and polling place.;
727 (c) Voter rights and responsibilities.;
728 (d) Distribution of sample ballots.; and
729 (e) The importance of and method for updating voter
730 registration information and a voter’s mailing address.
731 (f) The importance of and method for canceling a voter
732 registration upon moving out of state.
733 (g)(e) Public service announcements.
734 (2) Each county supervisor shall implement the minimum
735 voter education standards, and shall conduct additional
736 nonpartisan education efforts as necessary to ensure that voters
737 have a working knowledge of the voting process. A county
738 supervisor shall provide equal education on all methods of
739 voting.
740 Section 15. Subsection (2) of section 101.043, Florida
741 Statutes, is amended to read:
742 101.043 Identification required at polls.—
743 (2) If the elector fails to furnish the required
744 identification or presents a Florida driver license or Florida
745 identification card with a non-citizen designation, the elector
746 must shall be allowed to vote a provisional ballot. The
747 canvassing board shall determine the validity of the ballot
748 pursuant to s. 101.048(2).
749 Section 16. Section 101.6921, Florida Statutes, is amended
750 to read:
751 101.6921 Delivery of special vote-by-mail ballot to certain
752 first-time voters.—
753 (1) The provisions of this section apply to voters who are
754 subject to the provisions of s. 97.0535 and who have not
755 provided the identification or certification required by s.
756 97.0535 by the time the vote-by-mail ballot is mailed.
757 (2) The supervisor shall enclose with each vote-by-mail
758 ballot two three envelopes: a secrecy envelope, into which the
759 absent elector will enclose his or her marked ballot; an
760 envelope containing the Voter’s Certificate, into which the
761 absent elector shall place the secrecy envelope; and a mailing
762 envelope, which shall be addressed to the supervisor and into
763 which the absent elector will place the envelope containing the
764 Voter’s Certificate and a copy of the required identification.
765 (3) The Voter’s Certificate must shall be in substantially
766 the following form:

821 Section 17. Subsection (2) of section 101.6923, Florida
822 Statutes, is amended to read:
823 101.6923 Special vote-by-mail ballot instructions for
824 certain first-time voters.—
825 (2) A voter covered by this section must be provided with
826 printed instructions with his or her vote-by-mail ballot in
827 substantially the following form:

833 1. In order to ensure that your vote-by-mail ballot will be
834 counted, it should be completed and returned as soon as possible
835 so that it can reach the supervisor of elections of the county
836 in which your precinct is located no later than 7 p.m. on the
837 date of the election. However, if you are an overseas voter
838 casting a ballot in a presidential preference primary or general
839 election, your vote-by-mail ballot must be postmarked or dated
840 no later than the date of the election and received by the
841 supervisor of elections of the county in which you are
842 registered to vote no later than 10 days after the date of the
843 election. Note that the later you return your ballot, the less
844 time you will have to cure signature deficiencies, which is
845 authorized until 5 p.m. local time on the 2nd day after the
846 election.
847 2. Mark your ballot in secret as instructed on the ballot.
848 You must mark your own ballot unless you are unable to do so
849 because of blindness, disability, or inability to read or write.
850 3. Mark only the number of candidates or issue choices for
851 a race as indicated on the ballot. If you are allowed to “Vote
852 for One” candidate and you vote for more than one, your vote in
853 that race will not be counted.
854 4. Place your marked ballot in the enclosed secrecy
855 envelope and seal the envelope.
856 5. Insert the secrecy envelope into the enclosed envelope
857 bearing the Voter’s Certificate. Seal the envelope and
858 completely fill out the Voter’s Certificate on the back of the
859 envelope.
860 a. You must sign your name on the line above (Voter’s
861 Signature).
862 b. If you are an overseas voter, you must include the date
863 you signed the Voter’s Certificate on the line above (Date) or
864 your ballot may not be counted.
865 c. A vote-by-mail ballot will be considered illegal and
866 will not be counted if the signature on the Voter’s Certificate
867 does not match the signature on record. The signature on file at
868 the start of the canvass of the vote-by-mail ballots is the
869 signature that will be used to verify your signature on the
870 Voter’s Certificate. If you need to update your signature for
871 this election, send your signature update on a voter
872 registration application to your supervisor of elections so that
873 it is received before your vote-by-mail ballot is received.
874 6. If you have registered to vote without a Florida driver
875 license or a Florida identification card and have not previously
876 provided one of the following identification documents to an
877 election official Unless you meet one of the exemptions in Item
878 7., you must make a copy of one of the following forms of
879 identification:
880 a. United States passport.
881 b. A birth certificate issued by a state, territory, or
882 other jurisdiction of the United States along with an acceptable
883 form of photo identification containing your name and
884 photograph. Acceptable forms of photo identification include:
885 a. Identification which must include your name and
886 photograph: United States passport;
887 (I) Debit or credit card.;
888 (II) Military identification.;
889 (III) Student identification.
890 (IV); Retirement center identification.;
891 (V) Neighborhood association identification; Public
892 assistance identification.;
893 (VI) Veteran health identification card issued by the
894 United States Department of Veterans Affairs.;
895 (VII) A Florida license to carry a concealed weapon or
896 firearm issued pursuant to s. 790.06, Florida Statutes.; or
897 (VIII) An employee identification card issued by any
898 branch, department, agency, or entity of the Federal Government,
899 the state, a county, or a municipality.
900 c. United States naturalization papers, plus an acceptable
901 form of photo identification.
902 d. A consular report of birth abroad provided by the United
903 States Department of State, plus an acceptable photo
904 identification.
905 e. Social security card, plus an acceptable photo
906 identification.; or
907 7.b. If you registered to vote without a Florida driver
908 license or a Florida identification card, you must also make a
909 copy of the following documents that must be dated within the
910 last 2 months and contain the name and residence address listed
911 on your voter registration application to provide proof of
912 Florida residency Identification which shows your name and
913 current residence address:
914 a. current Utility bill.,
915 b. Bank statement.,
916 c. Government check.,
917 d. Paycheck., or
918 e. Other government document (excluding voter information
919 card).
920 8. If you have registered to vote without a Florida driver
921 license or Florida identification card and meet one of the
922 exemptions in Item 10., you may provide the following as proof
923 of prior Florida residence instead of the documents listed in
924 Item 7.:
925 a. Documents listed in Item 7. that are not current, plus a
926 current equivalent document listing your residence outside the
927 United States.
928 b. A consular report of birth abroad provided by the United
929 States Department of State, plus proof that your parents
930 previously resided in the state of Florida.
931 9.7. The identification requirements of Item 6., 7., or 8.
932 do not apply if you meet one of the following requirements:
933 a. You are 65 years of age or older.
934 b. You have a temporary or permanent physical disability,
935 documented by a doctor’s note provided to a voter registration
936 official.
937 b.c. You are a member of a uniformed service on active
938 duty, as documented by a current military identification
939 provided to a voter registration official, who, by reason of
940 such active duty, will be absent from the county on election
941 day.
942 c.d. You are a member of the Merchant Marine, as documented
943 by a current Merchant Marine identification, who, by reason of
944 service in the Merchant Marine, will be absent from the county
945 on election day.
946 d.e. You are the spouse or dependent of a member referred
947 to in paragraph c. or paragraph d., as documented by a uniformed
948 services dependent identification, who, by reason of the active
949 duty or service of the member, will be absent from the county on
950 election day.
951 e.f. If you are currently residing outside the United
952 States, you must provide one of the documents listed in Item 8.
953 10. The documents listed in Item 6., 7., 8., or 10. may be
954 submitted using the same methods allowed under s. 101.68,
955 Florida Statutes, or by mail, e-mail, or fax.
956 11.8. Place the envelope bearing the Voter’s Certificate
957 into the mailing envelope addressed to the supervisor. Insert a
958 copy of your identification in the mailing envelope. DO NOT PUT
959 YOUR IDENTIFICATION INSIDE THE SECRECY ENVELOPE WITH THE BALLOT
960 OR INSIDE THE ENVELOPE WHICH BEARS THE VOTER’S CERTIFICATE OR
961 YOUR BALLOT WILL NOT COUNT.
962 12.9. Mail, deliver, or have delivered the completed
963 mailing envelope. Be sure there is sufficient postage if mailed.
964 13.10. FELONY NOTICE. It is a felony under Florida law to
965 accept any gift, payment, or gratuity in exchange for your vote
966 for a candidate. It is also a felony under Florida law to vote
967 in an election using a false identity or false address, or under
968 any other circumstances making your ballot false or fraudulent.
969 Section 18. Paragraph (a) of subsection (2) of section
970 322.08, Florida Statutes, is amended to read:
971 322.08 Application for license; requirements for license
972 and identification card forms.—
973 (2) Each such application shall include the following
974 information regarding the applicant:
975 (a) Full name (first, middle or maiden, and last), gender,
976 proof of social security card number satisfactory to the
977 department by presenting a social security card, which may
978 include a military identification card, county of residence,
979 mailing address, proof of residential address satisfactory to
980 the department, country of birth, and a brief description. The
981 department shall note in the applicant’s record the type of
982 social security card presented.
983 Section 19. Paragraph (g) is added to subsection (1) of
984 section 322.14, Florida Statutes, to read:
985 322.14 Licenses issued to drivers.—
986 (1)
987 (g) Licenses issued to individual who submitted any of the
988 documents required pursuant to s. 322.08(2)(c)5., 7., or 8., or
989 presented a type 2 or type 3 social security card pursuant to s.
990 322.08(2)(a) must include “NC” to denote that such individual is
991 a noncitizen.
992 Section 20. Subsection (5) is added to section 322.141,
993 Florida Statutes, to read:
994 322.141 Color or markings of certain licenses or
995 identification cards.—
996 (5) Identification cards issued to individuals who
997 submitted any of the documents required pursuant to s.
998 322.08(2)(c)5., 7., or 8., or presented a type 2 or type 3
999 social security card pursuant to s. 322.08(2)(a) must include
1000 “NC” to denote that such individual is a noncitizen.
1001 Section 21. This act shall take effect July 1, 2025.
