Florida Senate - 2025 SB 1376 By Senator Collins 14-00797-25 20251376__ 1 A bill to be entitled 2 An act relating to state purchasing; requiring the 3 Department of Management Services to prepare an 4 inventory of all state agency-owned motor vehicles, 5 maintenance facilities, and fuel depots by a specified 6 date; requiring the department to submit the inventory 7 to the Governor and the Legislature; providing 8 requirements for the inventory; requiring state 9 agencies to cooperate with the department in compiling 10 the inventory; creating the Bulk Vehicle Purchase 11 Pilot Program within the department for a specified 12 purpose; requiring the department annually to complete 13 a report to submit to the Governor and the 14 Legislature; providing requirements for the report; 15 requiring the department to work with state agencies 16 and other branches of state government to define 17 certain specifications for vehicle categories; 18 requiring the department to competitively procure 19 vehicles, subject to certain requirements and 20 limitations; authorizing the department to either 21 terminate or accelerate implementation of the pilot 22 program if certain conditions exist; authorizing the 23 department to adopt rules; creating the Fleet 24 Operations Management Pilot Program within the 25 department for a specified purpose; requiring the 26 department to competitively procure and contract with 27 a vendor or contractor for certain fleet operations 28 services, subject to requirements and limitations; 29 requiring certain actions by the department and other 30 participating state entities in the administration of 31 the pilot program; requiring the department annually 32 to compile a report and evaluation regarding the pilot 33 program to submit to the Governor and the Legislature; 34 authorizing the department to either terminate or 35 accelerate implementation of the pilot program if 36 certain conditions exist; providing an effective date. 37 38 Be It Enacted by the Legislature of the State of Florida: 39 40 Section 1. Statewide inventory.— 41 (1) The Department of Management Services shall prepare an 42 inventory of all state agency-owned motor vehicles, maintenance 43 facilities, and fuel depots. By December 31, 2025, the 44 department shall submit the inventory to the Governor, the 45 President of the Senate, and the Speaker of the House of 46 Representatives. 47 (2) The inventory must, at a minimum, provide the 48 following: 49 (a) The entity that owns each state-owned motor vehicle, 50 maintenance facility, and fuel depot. 51 (b) The entity in possession of each state-owned motor 52 vehicle, maintenance facility, and fuel depot. 53 (c) The estimated annual operating and other costs of all 54 state-owned motor vehicles, maintenance facilities, and fuel 55 depots. 56 (d) The number of full-time equivalent and other-personal 57 services positions assigned to operate and maintain each state 58 owned maintenance facility and fuel depot. 59 (e) The physical address for the location of all state 60 owned motor vehicles, maintenance facilities, and fuel depots. 61 (3) Each state agency shall provide any information 62 requested by the Department of Management Services necessary to 63 complete the inventory. 64 Section 2. Bulk Vehicle Purchase Pilot Program.— 65 (1) There is created within the Department of Management 66 Services the Bulk Vehicle Purchase Pilot Program. The purpose of 67 the pilot program is to assess, in practice, the cost savings 68 through a direct bulk purchase program for the acquisition of 69 state motor vehicles. 70 (2) The Department of Management Services shall administer 71 the Bulk Vehicle Purchase Pilot Program. 72 (3) The Department of Management Services shall identify 73 and report the projected vehicle purchasing needs of state 74 agencies, the Legislature, and the judicial branch over the 75 subsequent 5 years. The report must be submitted to the 76 Governor, the President of the Senate, and the Speaker of the 77 House of Representatives by December 31, 2025, and by each 78 December 31 thereafter for the duration of the pilot program. 79 The report must, at a minimum, include the following: 80 (a) The category of each vehicle; 81 (b) The agency requesting each vehicle; 82 (c) The specifications for each vehicle category and subset 83 thereof, at the discretion of the Department of Management 84 Services; and 85 (d) The expected useful life of each vehicle as stated in 86 the Minimum Equipment Replacement Criteria set forth by the 87 Department of Management Services. 88 (4) The Department of Management Services shall work with 89 state agencies, the Legislature, and the judicial branch to 90 define a common set of specifications for each vehicle category 91 and, in the department’s discretion after consultation with 92 state agencies, the Legislature, and the judicial branch, may 93 define subsets of vehicle categories with common specifications 94 to meet agency needs. 95 (5) Notwithstanding s. 320.645, Florida Statutes, the 96 Department of Management Services shall competitively procure, 97 either through dealerships or direct from motor vehicle 98 manufacturers, the vehicles identified in the report in 99 subsection (3) in accordance with the specifications agreed to 100 pursuant to subsection (4). The department shall consider a 101 variety of factors, such as price, vehicle quality, timeliness 102 of delivery, residual value, and discounts offered, to assess 103 the value to the state. Purchases must be carried out by budget 104 transfers from each participating state agency, the Legislature, 105 and the judicial branch to the Department of Management 106 Services, which shall make a single purchase for each set of 107 vehicles. 108 (6) The Department of Management Services may terminate the 109 pilot program if its findings or economic models indicate the 110 pilot program will not result in significant cost savings to the 111 state by July 1, 2028. The department may also accelerate the 112 implementation of the pilot program if cost savings justify an 113 accelerated implementation. 114 (7) The Department of Management Services may adopt any 115 rules necessary to administer the pilot program. 116 Section 3. Fleet Operations Management Pilot Program.— 117 (1) There is created within the Department of Management 118 Services the Fleet Operations Management Pilot Program. The 119 purpose of the pilot program is to assess the potential for cost 120 savings through a contract with a vendor or contractor for 121 privatizing the management and maintenance of state-owned motor 122 vehicles, maintenance facilities, and fuel operations. 123 (2) The Department of Management Services shall administer 124 the pilot program. The department shall competitively procure 125 and contract with a vendor or contractor for privatizing state 126 owned motor vehicle management and maintenance, maintenance 127 facilities, and fuel operations for selected state entities. Any 128 contract with a vendor or contractor for the pilot program must 129 be competitively bid every 5 years. Any data that relates to the 130 contract must be stored in at least one common format approved 131 by the department, and such data remains the property of the 132 state. Any vehicle-monitoring hardware installed in a state 133 owned motor vehicle must, to the extent feasible, be based on 134 cost and value to the state relative to proprietary technologies 135 that are specific to a vendor or contractor. 136 (3) For each state entity selected by the Department of 137 Management Services for inclusion in the pilot program, the 138 department shall establish an average baseline of costs 139 associated with state-owned motor vehicles, motor vehicle 140 acquisitions and disposition, maintenance facilities, and fuel 141 operations using the previous 3 fiscal years for the state 142 entity. 143 (4) By October 1, 2026, the Department of Management 144 Services and three state entities selected by the department 145 shall use the competitively procured contract selected by the 146 department for privatizing the management and maintenance of 147 state-owned motor vehicles, maintenance facilities, and fuel 148 operations. Each state entity selected shall provide any 149 information requested by the department necessary for 150 privatizing the management and maintenance of existing state 151 owned motor vehicles, maintenance facilities, fuel operations, 152 and any full-time equivalent and other-personal-services 153 positions assigned to operate and maintain each state-owned 154 maintenance facility and fuel operation. 155 (5) By October 1, 2027, the Department of Management 156 Services shall evaluate and identify additional state entities 157 to use the competitively procured contract selected by the 158 department for privatizing the management and maintenance of 159 state-owned motor vehicles, maintenance facilities, and fuel 160 operations. Each state entity selected shall provide any 161 information requested by the department necessary for 162 privatizing the management and maintenance of existing state 163 owned motor vehicles, maintenance facilities, fuel operations, 164 and any full-time equivalent and other-personal-services 165 positions assigned to operate and maintain each state-owned 166 maintenance facility and fuel operation. 167 (6) By October 1, 2028, the Department of Management 168 Services shall evaluate and identify additional state entities 169 who shall use the competitively procured contract selected by 170 the department for privatizing the management and maintenance of 171 state-owned motor vehicles, maintenance facilities, and fuel 172 operations. Each state entity shall provide any information 173 requested by the department necessary for privatizing the 174 management of existing state-owned motor vehicles, motor vehicle 175 acquisitions and disposition, maintenance facilities, fuel 176 operations, and any full-time equivalent and other-personal 177 services positions assigned to operate and maintain each state 178 owned maintenance facility and fuel operation. 179 (7) Beginning September 1, 2027, and each year thereafter 180 for the duration of the pilot program, the Department of 181 Management Services shall compile a report and evaluation 182 detailing the status of the program, including an assessment of 183 its successes and failures, impact to full-time equivalent and 184 other-personal-services positions, and cost savings, if any, and 185 submit such report, along with a list of its findings and 186 recommendations regarding the pilot program, to the Governor, 187 the President of the Senate, and the Speaker of the House of 188 Representatives. 189 (8) The Department of Management Services may terminate the 190 pilot program and any vendor or contractor contracts if its 191 findings or economic models indicate the pilot program will not 192 result in cost savings to the state greater than the cost of the 193 management and maintenance contract by July 1, 2028. The 194 department may also accelerate the implementation of the pilot 195 program if cost savings justify an accelerated implementation. 196 Section 4. This act shall take effect upon becoming a law.
