       The Committee on Criminal Justice (Truenow) recommended the
       following:
       
    1         Senate Amendment to Amendment (742930) (with directory and
    2  title amendments)
    3  
    4         Between lines 117 and 118
    5  insert:
    6         (3) PROHIBITED USE OF DRONES.—
    7         (b)1. A person, a state agency, or a political subdivision
    8  as defined in s. 11.45 may not use a drone equipped with an
    9  imaging device to record an image of privately owned real
   10  property or of the owner, tenant, occupant, invitee, or licensee
   11  of such property with the intent to conduct surveillance on the
   12  individual or property captured in the image in violation of
   13  such person’s reasonable expectation of privacy without his or
   14  her written consent. For purposes of this section, a person is
   15  presumed to have a reasonable expectation of privacy on his or
   16  her privately owned real property if he or she is not observable
   17  by persons located at ground level in a place where they have a
   18  legal right to be, regardless of whether he or she is observable
   19  from the air with the use of a drone.
   20         2. A person who has a reasonable expectation of privacy on
   21  his or her privately owned real property may use reasonable
   22  force to prohibit a drone from conducting surveillance in
   23  violation of this paragraph, if such drone is operating under
   24  500 ft. over such property.
