Florida Senate - 2025 SB 1436 By Senator McClain 9-01475-25 20251436__ 1 A bill to be entitled 2 An act relating to sanitary and stormwater system 3 standards; creating ss. 125.5695 and 166.04815, F.S.; 4 requiring that all sanitary and stormwater systems in 5 counties and municipalities, respectively, comply with 6 specified state Department of Transportation standards 7 for certain elements; providing inspection 8 requirements for such systems; specifying that certain 9 local standards are superseded; providing a finding of 10 an important state interest; providing an effective 11 date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 125.5695, Florida Statutes, is created 16 to read: 17 125.5695 Standards for sanitary and stormwater systems.— 18 (1) All sanitary and stormwater systems, including 19 laterals, sewer pipe, storm pipe, and manhole covers in counties 20 in this state, when installing new or repairing existing 21 laterals, sewer pipe, storm pipe, and manhole covers, must 22 follow the annual state Department of Transportation’s Standard 23 Specifications for Road and Bridge Construction contained in the 24 sections “Pipe Culverts” and “Pipe Liner.” 25 (2) All final inspections for all laterals, sewer pipe, 26 storm pipe, and manhole covers in counties must be performed by 27 a licensed engineer, general contractor, or third-party 28 inspection company that is not the current licensed operator for 29 the job being inspected. 30 (3) The standards for installation and inspection in 31 subsections (1) and (2) supersede all existing and local 32 standards in counties. 33 Section 2. Section 166.04815, Florida Statutes, is created 34 to read: 35 166.04815 Standards for sanitary and stormwater systems.— 36 (1) All sanitary and stormwater systems, including 37 laterals, sewer pipe, storm pipe, and manhole covers in 38 municipalities in this state, when installing new or repairing 39 existing laterals, sewer pipe, storm pipe, and manhole covers, 40 must follow the annual state Department of Transportation’s 41 Standard Specifications for Road and Bridge Construction 42 contained in the sections “Pipe Culverts” and “Pipe Liner.” 43 (2) All final inspections for all laterals, sewer pipe, 44 storm pipe, and manhole covers in municipalities must be 45 performed by a licensed engineer, general contractor, or third 46 party inspection company that is not the current licensed 47 operator for the job being inspected. 48 (3) The standards for installation and inspection in 49 subsections (1) and (2) supersede all existing and local 50 standards in municipalities. 51 Section 3. Pursuant to s. 18, Art. VII of the State 52 Constitution, the Legislature hereby determines and declares 53 that this act fulfills an important state interest. 54 Section 4. This act shall take effect July 1, 2025.
