Section 794.0116, Florida Statutes, is created 6 to read: 7 794.0116 Sexual offenses by registered sexual offenders or 8 sexual predators; mandatory sentencing.— 9 (1) A person who was previously convicted of or had 10 adjudication withheld for any offense listed in s. 775.21 or s. 11 943.0435 and commits a violation of s. 787.025(2)(c); s. 12 794.011, excluding s. 794.011(10); s. 800.04(4) or (5); s. 13 825.1025(2) or (3); s. 827.071; or s. 847.0145 shall be 14 sentenced to a mandatory minimum term of imprisonment as 15 follows: 16 17 Florida Statute Mandatory minimum 18 787.025(2)(c) 10 years 19 794.011, excluding s. 794.011(10)10 years 20 800.04(4) or (5) 10 years 21 825.1025(2) or (3) 10 years 22 827.071 (victim older than 12 years of age)10 years 23 827.071 (victim 12 years of age or younger)20 years 24 847.0145 10 years 25 26 (2) Notwithstanding s. 775.082(3), chapter 958, any other 27 law, or any interpretation or construction thereof, a person 28 subject to sentencing under this section must be sentenced to 29 the mandatory term of imprisonment provided under this section. 30 If the mandatory minimum term of imprisonment imposed under this 31 section exceeds the maximum sentence authorized under s. 32 775.082, s. 775.084, or chapter 921, the mandatory minimum term 33 of imprisonment under this section must be imposed. If the 34 mandatory minimum term of imprisonment under this section is 35 less than the sentence that could be imposed under s. 775.082, 36 s. 775.084, or chapter 921, the sentence imposed must include 37 the mandatory minimum term of imprisonment under this section. 38 (3) A defendant sentenced to a mandatory minimum term of 39 imprisonment under this section is not eligible for statutory 40 gain-time under s. 944.275 or any form of discretionary early 41 release, other than pardon or executive clemency, or conditional 42 medical release under s. 947.149, before serving the minimum 43 sentence. 44 Section 2. This act shall take effect on October 1, 2025. 45 46 ================= T I T L E A M E N D M E N T ================ 47 And the title is amended as follows: 48 Delete everything before the enacting clause 49 and insert: 50 A bill to be entitled 51 An act relating to sexual offenses by persons 52 previously convicted of sexual offenses; creating s. 53 794.0116, F.S.; providing mandatory minimum terms of 54 imprisonment for specified sexual offenses when 55 committed by registered sexual offenders or sexual 56 predators; providing requirements for such sentences; 57 providing an effective date.
