Florida Senate - 2025 SB 1506 By Senator Davis 5-01461-25 20251506__ 1 A bill to be entitled 2 An act relating to the failure to comply with a time 3 sharing schedule; amending s. 61.13, F.S.; providing a 4 civil cause of action for a parent’s failure or 5 refusal to comply with a court-ordered time-sharing 6 schedule; providing affirmative defenses; providing 7 for retroactivity; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (10) is added to section 61.13, 12 Florida Statutes, to read: 13 61.13 Support of children; parenting and time-sharing; 14 powers of court.— 15 (10) If a parent fails or refuses to honor a court-ordered 16 time-sharing schedule in a parenting plan without proper cause, 17 the nonoffending parent may bring a civil action against the 18 parent who failed or refused to honor the court-ordered schedule 19 for appropriate compensatory and punitive damages. The offending 20 parent may raise an affirmative defense for his or her actions 21 based on the defenses provided in s. 787.03(4). This subsection 22 applies retroactively to January 1, 2014. 23 Section 2. This act shall take effect July 1, 2025.
