       The Appropriations Committee on Pre-K - 12 Education (Smith)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Paragraph (q) is added to subsection (3) of
    6  section 1002.20, Florida Statutes, to read:
    7         1002.20 K-12 student and parent rights.—Parents of public
    8  school students must receive accurate and timely information
    9  regarding their child’s academic progress and must be informed
   10  of ways they can help their child to succeed in school. K-12
   11  students and their parents are afforded numerous statutory
   12  rights including, but not limited to, the following:
   13         (3) HEALTH ISSUES.—
   14         (q)Anaphylaxis policy.
   15         1.Each district school board and charter school governing
   16  board shall require each school that serves students in
   17  kindergarten through grade 8 to provide training to an adequate
   18  number of school personnel and contracted personnel in
   19  preventing and responding to allergic reactions, including
   20  anaphylaxis. This training must include recognizing the signs of
   21  an anaphylactic reaction and administering an epinephrine auto
   22  injector. Each district school board and charter school
   23  governing board shall also require that, for each student in
   24  kindergarten through grade 8 who has an emergency action plan
   25  for anaphylaxis, such plan must be in effect and accessible at
   26  all times when the student is on school grounds during the
   27  school day or participating in school-sponsored activities. This
   28  includes extracurricular activities, athletics, school dances,
   29  and contracted before-school or after-school programs at the
   30  student’s school.
   31         2.The State Board of Education, in consultation with the
   32  Department of Health, shall adopt rules to implement this
   33  paragraph, including identifying an approved training
   34  curriculum, by October 1, 2025.
   35         Section 2. This act shall take effect July 1, 2025.

   42         An act relating to anaphylaxis in public and charter
   43         schools; amending s. 1002.20, F.S.; requiring each
   44         district school board and charter school governing
   45         board to require that a school that serves students in
   46         kindergarten through grade 8 provide specified
   47         training to an adequate number of personnel; requiring
   48         that the training include recognizing the signs of an
   49         anaphylactic reaction and administering an epinephrine
   50         auto injector; requiring each district school board
   51         and charter school governing board to require that a
   52         student’s emergency action plan remain effective at
   53         all times while the student is on school grounds;
   54         requiring the State Board of Education, in
   55         consultation with the Department of Health, to adopt
   56         rules by a specified date; providing an effective
   57         date.
