1 A bill to be entitled
2 An act relating to opticianry; amending s. 484.011,
3 F.S.; deleting the ability of an optician to delegate
4 specified acts to unlicensed supportive personnel;
5 amending s. 484.018, F.S.; deleting an exception to
6 optician licensure requirements for employees working
7 under the direct supervision of a physician or
8 optometrist; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 484.011, Florida Statutes, is amended to
13 read:
14 484.011 License required Supportive personnel.—Any No
15 person other than a licensed optician may not engage in the
16 practice of opticianry, except that a licensed optician may
17 delegate to nonlicensed supportive personnel those duties,
18 tasks, and functions which fall within the purview of s.
19 484.002(3). All such delegated acts shall be performed under the
20 direct supervision of a licensed optician, who shall be
21 responsible for all such acts performed by persons under her or
22 his supervision.
23 Section 2. Subsection (2) of section 484.018, Florida
24 Statutes, is amended to read:
25 484.018 Exceptions.—
26 (2) Nothing in this part shall be construed to mean that an
27 employee of a licensed physician or a licensed optometrist shall
28 be required to secure a license under this part, so long as the
29 employee is working exclusively for, and under the direct
30 supervision of, the licensed physician or optometrist and does
31 not hold herself or himself out to the public generally as an
32 optician.
33 Section 3. This act shall take effect July 1, 2025.
