       The Committee on Fiscal Policy (DiCeglie) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Subsection (3) is added to section 366.075,
    6  Florida Statutes, to read:
    7         366.075 Experimental and transitional rates; experimental
    8  mechanisms.—
    9         (3)(a) The commission shall establish an experimental
   10  mechanism to facilitate energy infrastructure investments in gas
   11  consistent with a similar structure as set forth in s.
   12  366.99(2)-(6) and with the intent of s. 366.91(1). Such gas
   13  infrastructure investments may include only such investments
   14  that collect, prepare, clean, process, transport, or inject gas
   15  as a transportation fuel or for pipeline distribution. In an
   16  annual proceeding, the commission shall have the discretion to
   17  determine whether such mechanism shall be implemented. As used
   18  in this subsection, the term “gas” means anaerobically generated
   19  biogas, landfill gas, or wastewater treatment gas produced and
   20  collected in this state and refined to a methane content of 90
   21  percent or greater which may be used as a transportation fuel or
   22  for pipeline distribution.
   23         (b)The commission shall adopt rules to implement and
   24  administer this subsection and shall propose such rules for
   25  adoption as soon as practicable but no later than January 1,
   26  2026. Such rules must provide for the allocation to public
   27  utility customers of the benefit of any tradeable energy credits
   28  and tax savings associated with gas infrastructure investments
   29  made pursuant to this subsection and must address the treatment
   30  of revenues from sales of gas from such investments for
   31  transportation purposes.
   32         Section 2. This act shall take effect July 1, 2025.

   40         amending s. 366.075, F.S.; requiring the Public
   41         Service Commission to establish an experimental
   42         mechanism that meets certain requirements to
   43         facilitate certain energy infrastructure investments
   44         in gas; providing requirements for gas infrastructure
   45         investments; authorizing the commission to make
   46         certain determinations; defining the term “gas”;
   47         requiring the commission to adopt rules and propose
   48         such rules for adoption by a specified date; providing
   49         requirements for such rules; providing an effective
   50         date.
