    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 468.404, F.S.;
    3         requiring agents wishing to represent student athletes
    4         to pay a specified application fee to the Department
    5         of Business and Professional Regulation; requiring
    6         such agents to pay a specified renewal fee annually to
    7         the department; providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Present subsections (2), (3), and (4) of section
   12  468.404, Florida Statutes, are redesignated as subsections (3),
   13  (4), and (5), respectively, a new subsection (2) is added to
   14  that section, and subsection (1) of that section is amended, to
   15  read:
   16         468.404 License; fees; renewals.—
   17         (1) Except as provided in subsection (2), the department
   18  shall establish biennial fees for initial licensing, renewal of
   19  license, and reinstatement of license, none of which fees may
   20  shall exceed $400. The department may establish a delinquency
   21  fee of no more than $50. The fees must shall be adequate to
   22  proportionately fund the expenses of the department which are
   23  allocated to the regulation of talent agencies and are shall be
   24  based on the department’s estimate of the revenue required to
   25  administer this part.
   26         (2) Notwithstanding subsection (1), an agent wishing to
   27  represent a student athlete shall pay to the department an
   28  initial application fee not to exceed $2,500. Thereafter, an
   29  agent representing a student athlete shall pay to the department
   30  an annual renewal fee not to exceed $2,500.
   31         Section 2. This act shall take effect on the same date that
   32  SB 1584 or similar legislation takes effect, if such legislation
   33  is adopted in the same legislative session or an extension
   34  thereof and becomes a law.
