       Senator Simon moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. This act may be cited as the “Rafe Maccarone
    6  Act.
    7         Section 2. Subsection (3) of section 1003.453, Florida
    8  Statutes, is amended to read:
    9         1003.453 School wellness and physical education policies;
   10  nutrition guidelines.—
   11         (3) School districts shall are encouraged to provide basic
   12  training in first aid, including cardiopulmonary resuscitation,
   13  once in middle school in a physical education or health class
   14  and once in high school in a physical education or health class.
   15  Instruction in the use of cardiopulmonary resuscitation must:
   16         (a) Allow students to practice the psychomotor skills
   17  associated with performing cardiopulmonary resuscitation; and
   18         (b) Include the use of an automated external defibrillator
   19  for all students in grade 6 and grade 8. School districts are
   20  required to provide basic training in first aid, including
   21  cardiopulmonary resuscitation, for all students in grade 9 and
   22  grade 11. Instruction in the use of cardiopulmonary
   23  resuscitation must be based on a one-hour, nationally recognized
   24  program that uses the most current evidence-based emergency
   25  cardiovascular care guidelines. The instruction must allow
   26  students to practice the psychomotor skills associated with
   27  performing cardiopulmonary resuscitation and use an automated
   28  external defibrillator when a school district has the equipment
   29  necessary to perform the instruction. Private and public
   30  partnerships for providing training or necessary funding are
   31  encouraged.
   32         Section 3. Section 1003.457, Florida Statutes, is created
   33  to read:
   34         1003.457 Cardiac emergencies and automated external
   35  defibrillators on school grounds.
   36         (1) Each public school shall develop a cardiac emergency
   37  response plan (CERP) that addresses the appropriate use of
   38  school personnel to respond to incidents involving an individual
   39  experiencing sudden cardiac arrest or a similar life-threatening
   40  emergency while on school grounds. Each CERP must integrate
   41  evidence-based core elements.
   42         (2) School officials shall work directly with local
   43  emergency service providers to integrate the CERP into the
   44  community’s emergency responder protocols.
   45         (3)(a)No later than July 1, 2027, each public school,
   46  including charter schools, shall have at least one operational
   47  automated external defibrillator on school grounds. The
   48  defibrillator must be available in a clearly marked and
   49  publicized location. Schools shall maintain the defibrillator
   50  according to the manufacturer’s recommendations and maintain all
   51  verification records for such defibrillators.
   52         (b) Appropriate school staff must be trained in first aid,
   53  cardiopulmonary resuscitation, and defibrillator use.
   54         (c) The location of each defibrillator must be registered
   55  with a local emergency medical services medical director.
   56         (d) The use of defibrillators by school employees and
   57  volunteers is covered under ss. 768.13 and 768.1325.
   58         (4) Compliance with the requirements of s. 1006.165 does
   59  not constitute compliance with this section.
   60         (5) The State Board of Education shall adopt rules to
   61  administer this section.
   62         Section 4. This act shall take effect July 1, 2025.

   69         An act relating to cardiac emergencies; providing a
   70         short title; amending s. 1003.453, F.S.; revising
   71         requirements for instruction on cardiopulmonary
   72         resuscitation and the use of an automated external
   73         defibrillator; creating s. 1003.457, F.S.; requiring
   74         each public school to develop a cardiac emergency
   75         response plan (CERP); requiring school officials to
   76         work with local emergency service providers to
   77         integrate the CERP into emergency responder protocols;
   78         requiring public schools, including charter schools,
   79         to have at least one operational automated external
   80         defibrillator on school grounds by a specified date;
   81         providing requirements for the placement and
   82         maintenance of the defibrillators; requiring that
   83         certain school staff receive specified training;
   84         providing immunity from liability for school employees
   85         and volunteers under the Good Samaritan Act and the
   86         Cardiac Arrest Survival Act; providing construction;
   87         requiring the State Board of Education to adopt rules;
   88         providing an effective date.
