2 An act relating to expedited service fees; amending s.
3 607.0122, F.S.; authorizing a person to request
4 expedited services from the Department of State in a
5 specified manner; amending s. 610.104, F.S.;
6 conforming a cross-reference; providing a contingent
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 607.0122, Florida Statutes, is amended
12 to read:
13 607.0122 Fees for filing documents and issuing
14 certificates.—
15 (1) The department shall collect the following fees when
16 the documents described in this section are delivered to the
17 department for filing:
18 (a)(1) Articles of incorporation: $35.
19 (b)(2) Application for registered name: $87.50.
20 (c)(3) Application for renewal of registered name: $87.50.
21 (d)(4) Corporation’s statement of change of registered
22 agent or registered office or both if not included on the annual
23 report: $35.
24 (e)(5) Designation of and acceptance by registered agent:
25 $35.
26 (f)(6) Agent’s statement of resignation from a corporation
27 that has not been dissolved: $87.50.
28 (g)(7) Agent’s statement of resignation from a dissolved
29 corporation or a composite statement of resignation from two or
30 more dissolved corporations pursuant to s. 607.0502(6): $35.
31 (h)(8) Amendment of articles of incorporation: $35.
32 (i)(9) Restatement of articles of incorporation with
33 amendment of articles: $35.
34 (j)(10) Articles of merger or share exchange for each party
35 thereto: $35.
36 (k)(11) Articles of dissolution: $35.
37 (l)(12) Articles of revocation of dissolution: $35.
38 (m)(13) Application for reinstatement following
39 administrative dissolution: $600.
40 (n)(14) Application for certificate of authority to
41 transact business in this state by a foreign corporation: $35.
42 (o)(15) Application for amended certificate of authority:
43 $35.
44 (p)(16) Application for certificate of withdrawal by a
45 foreign corporation: $35.
46 (q)(17) Annual report: $61.25.
47 (r)(18) Articles of correction: $35.
48 (s)(19) Application for certificate of status: $8.75.
49 (t)(20) Certificate of domestication of a foreign
50 corporation: $50.
51 (u)(21) Certified copy of document: $52.50.
52 (v)(22) Serving as agent for substitute service of process:
53 $87.50.
54 (w)(23) Supplemental corporate fee: $88.75.
55 (x)(24) Any other document required or permitted to be
56 filed by this chapter: $35.
57 (2) A person may request expedited services by submitting
58 to the department an expedited service request form. A request
59 for expedited services must be made in person or through an
60 electronic transmission. A request for expedited services may
61 not be requested through mail.
62 Section 2. Subsection (12) of section 610.104, Florida
63 Statutes, is amended to read:
64 610.104 State authorization to provide cable or video
65 service.—
66 (12) Beginning 5 years after approval of the
67 certificateholder’s initial certificate of franchise issued by
68 the department, and every 5 years thereafter, the
69 certificateholder shall update the information contained in the
70 original application for a certificate of franchise. At the time
71 of filing the information update, the certificateholder shall
72 pay a processing fee of $1,000. Any certificateholder that fails
73 to file the updated information and pay the processing fee on
74 the 5-year anniversary dates shall be subject to cancellation of
75 its state-issued certificate of franchise authority if, upon
76 notice given to the certificateholder at its last address on
77 file with the department, the certificateholder fails to file
78 the updated information and pay the processing fee within 30
79 days after the date notice was mailed. The application and
80 processing fees imposed in this section shall be paid to the
81 Department of State for deposit into the Clearing Funds Trust
82 Fund for immediate transfer by the Chief Financial Officer to
83 the General Inspection Trust Fund of the Department of
84 Agriculture and Consumer Services. The Department of Agriculture
85 and Consumer Services shall maintain a separate account within
86 the General Inspection Trust Fund to distinguish cable franchise
87 revenues from all other funds. The application, any amendments
88 to the certificate, or information updates must be accompanied
89 by a fee to the Department of State equal to that for filing
90 articles of incorporation pursuant to s. 607.0122(1)(a) s.
91 607.0122(1).
92 Section 3. This act shall take effect upon becoming a law
93 if SB 1616 or similar legislation is adopted in the same
94 legislative session or an extension thereof and becomes a law.
