Florida Senate - 2025 SB 1636 By Senator Sharief 35-01673-25 20251636__ 1 A bill to be entitled 2 An act relating to nurse registries; creating s. 3 400.507, F.S.; providing that certain health care 4 practitioners under contract with a nurse registry are 5 deemed independent contractors for purposes of 6 provider reimbursements under the Medicaid program; 7 providing that such practitioners are not eligible for 8 overtime or holiday pay; providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 400.507, Florida Statutes, is created to 13 read: 14 400.507 Nurse registries; independent contractors. 15 Notwithstanding any other state or federal law, for purposes of 16 reimbursement under the state Medicaid program, registered 17 nurses, licensed practical nurses, and certified nursing 18 assistants under contract with a nurse registry for the 19 provision of health care services are deemed independent 20 contractors and not employees, and are therefore ineligible for 21 overtime or holiday pay from the nurse registry under the 22 federal Fair Labor Standards Act or any other state or federal 23 law applicable to employees. 24 Section 2. This act shall take effect July 1, 2025.
