13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraphs (k), (n), and (o) of subsection (2),
16 paragraphs (a), (f), and (g) of subsection (6), subsection (8),
17 and paragraph (a) of subsection (10) of section 775.21, Florida
18 Statutes, are amended to read:
19 775.21 The Florida Sexual Predators Act.—
20 (2) DEFINITIONS.—As used in this section, the term:
21 (k) “Permanent residence” means a place where the person
22 abides, lodges, or resides for 3 or more consecutive days that
23 is the person’s home or other place where the person primarily
24 lives. For the purpose of calculating a permanent residence
25 under this paragraph, the first day that a person abides,
26 lodges, or resides at a place is excluded and each subsequent
27 day is counted. A day includes any part of a calendar day.
28 (n)1. “Temporary residence” means a place where the person
29 abides, lodges, or resides, including, but not limited to,
30 vacation, business, or personal travel destinations in or out of
31 this state, for a period of 3 or more days in the aggregate
32 during any calendar year that and which is not the person’s
33 permanent or transient residence. address or, For a person whose
34 permanent residence is not in this state, the term also includes
35 a place where the person is employed, practices a vocation, or
36 is enrolled as a student for any period of time in this state.
37 2. The term includes an “in-state travel residence,” which
38 means a temporary residence in this state established by a
39 person who already has an existing permanent, temporary, or
40 transient residence in this state.

42 For the purpose of calculating a temporary residence under this
43 paragraph, the first day that a person abides, lodges, or
44 resides at a place is excluded and each subsequent day is
45 counted. A day includes any part of a calendar day.
46 (o) “Transient residence” means a county where the person
47 lives, remains, or is located for the purpose of abiding,
48 lodging, or residing for a period of 3 or more days in the
49 aggregate during a calendar year that and which is not the
50 person’s permanent or temporary residence address. The term
51 includes, but is not limited to, a place where the person sleeps
52 or seeks shelter and a location that has no specific street
53 address. For the purpose of calculating a transient residence
54 under this paragraph, the first day that a person lives,
55 remains, or is located in a county for the purpose of abiding,
56 lodging, or residing is excluded and each subsequent day is
57 counted. A day includes any part of a calendar day.
58 (6) REGISTRATION.—
59 (a) A sexual predator shall register with the department
60 through the sheriff’s office by providing the following
61 information to the department:
62 1. Name; social security number; age; race; sex; date of
63 birth; height; weight; tattoos or other identifying marks; hair
64 and eye color; photograph; address of permanent or legal
65 residence and address of any current temporary residence, within
66 this state or out of state, including a rural route address and
67 a post office box; if he or she has no permanent or temporary
68 address, any transient residence within this state; address,
69 location or description, and dates of any current or known
70 future temporary residence within this state or out of state;
71 electronic mail addresses; Internet identifiers and each
72 Internet identifier’s corresponding website homepage or
73 application software name; home telephone numbers and cellular
74 telephone numbers; employment information, including occupation,
75 business name, employment address, and telephone number; the
76 make, model, color, vehicle identification number (VIN), and
77 license tag number of all vehicles owned; date and place of each
78 conviction; fingerprints; palm prints; and a brief description
79 of the crime or crimes committed by the sexual predator
80 offender. A post office box may not be provided in lieu of a
81 physical residential address. The sexual predator shall also
82 produce his or her passport, if he or she has a passport, and,
83 if he or she is an alien, shall produce or provide information
84 about documents establishing his or her immigration status. The
85 sexual predator shall also provide information about any
86 professional licenses he or she has.
87 a. Any change that occurs after the sexual predator
88 registers in person at the sheriff’s office as provided in this
89 subparagraph in any of the following information related to the
90 sexual predator must be reported as provided in paragraphs (g),
91 (i), and (j): permanent, temporary, or transient residence;
92 name; electronic mail addresses; Internet identifiers and each
93 Internet identifier’s corresponding website homepage or
94 application software name; home and cellular telephone numbers;
95 employment information; and status at an institution of higher
96 education.
97 b. If the sexual predator’s place of residence is a motor
98 vehicle, trailer, mobile home, or manufactured home, as those
99 terms are defined in chapter 320, the sexual predator shall also
100 provide to the department written notice of the vehicle
101 identification number (VIN); the license tag number; the
102 registration number; and a description, including color scheme,
103 of the motor vehicle, trailer, mobile home, or manufactured
104 home. If a sexual predator’s place of residence is a vessel,
105 live-aboard vessel, or houseboat, as those terms are defined in
106 chapter 327, the sexual predator shall also provide to the
107 department written notice of the hull identification number; the
108 manufacturer’s serial number; the name of the vessel, live
109 aboard vessel, or houseboat; the registration number of the
110 vessel, live-aboard vessel, or houseboat; and a description,
111 including color scheme, of the vessel, live-aboard vessel, or
112 houseboat.
113 c. If the sexual predator is enrolled or employed, whether
114 for compensation or as a volunteer, at an institution of higher
115 education in this state, the sexual predator shall also provide
116 to the department the name, address, and county of each
117 institution, including each campus attended, and the sexual
118 predator’s enrollment, volunteer, or employment status. The
119 sheriff, the Department of Corrections, or the Department of
120 Juvenile Justice shall promptly notify each institution of
121 higher education of the sexual predator’s presence and any
122 change in the sexual predator’s enrollment, volunteer, or
123 employment status.
124 d. A sexual predator shall report to the department through
125 the department’s online system or in person to the sheriff’s
126 office within 48 hours after any change in vehicles owned to
127 report those vehicle information changes. A sexual predator who
128 is under the supervision of the Department of Corrections, or
129 under the supervision of the Department of Juvenile Justice
130 shall report in person to the sheriff’s office within 48 hours
131 after any change in vehicles owned to report those vehicle
132 information changes.
133 2. Any other information determined necessary by the
134 department, including criminal and corrections records;
135 nonprivileged personnel and treatment records; and evidentiary
136 genetic markers when available.
137 (f) Within 48 hours after the registration required under
138 paragraph (a) or paragraph (e), a sexual predator who is not
139 incarcerated and who resides in the community, including a
140 sexual predator under the supervision of the Department of
141 Corrections, shall report register in person at a driver license
142 office of the Department of Highway Safety and Motor Vehicles
143 and shall present proof of registration unless a driver license
144 or an identification card that complies with the requirements of
145 s. 322.141(3) was previously secured or updated under s.
146 944.607. At the driver license office the sexual predator shall:
147 1. If otherwise qualified, secure a Florida driver license,
148 renew a Florida driver license, or secure an identification
149 card. The sexual predator shall identify himself or herself as a
150 sexual predator who is required to comply with this section,
151 provide his or her place of permanent, temporary, or transient
152 residence, including a rural route address and a post office
153 box, and submit to the taking of a photograph for use in issuing
154 a driver license, a renewed license, or an identification card,
155 and for use by the department in maintaining current records of
156 sexual predators. A post office box may not be provided in lieu
157 of a physical residential address. If the sexual predator’s
158 place of residence is a motor vehicle, trailer, mobile home, or
159 manufactured home, as those terms are defined in chapter 320,
160 the sexual predator shall also provide to the Department of
161 Highway Safety and Motor Vehicles the vehicle identification
162 number (VIN); the license tag number; the registration number;
163 and a description, including color scheme, of the motor vehicle,
164 trailer, mobile home, or manufactured home. If a sexual
165 predator’s place of residence is a vessel, live-aboard vessel,
166 or houseboat, as those terms are defined in chapter 327, the
167 sexual predator shall also provide to the Department of Highway
168 Safety and Motor Vehicles the hull identification number; the
169 manufacturer’s serial number; the name of the vessel, live
170 aboard vessel, or houseboat; the registration number of the
171 vessel, live-aboard vessel, or houseboat; and a description,
172 including color scheme, of the vessel, live-aboard vessel, or
173 houseboat.
174 2. Pay the costs assessed by the Department of Highway
175 Safety and Motor Vehicles for issuing or renewing a driver
176 license or an identification card as required by this section.
177 The driver license or identification card issued to the sexual
178 predator must comply with s. 322.141(3).
179 3. Provide, upon request, any additional information
180 necessary to confirm the identity of the sexual predator,
181 including a set of fingerprints.
182 (g)1.a. Each time a sexual predator’s driver license or
183 identification card is subject to renewal, and, without regard
184 to the status of the sexual predator’s driver license or
185 identification card, within 48 hours after any change of the
186 sexual predator’s residence or change in the sexual predator’s
187 name by reason of marriage or other legal process, the sexual
188 predator shall report in person to a driver license office and
189 is subject to the requirements specified in paragraph (f). The
190 Department of Highway Safety and Motor Vehicles shall forward to
191 the department and to the Department of Corrections all
192 photographs and information provided by sexual predators.
193 Notwithstanding the restrictions set forth in s. 322.142, the
194 Department of Highway Safety and Motor Vehicles may release a
195 reproduction of a color-photograph or digital-image license to
196 the Department of Law Enforcement for purposes of public
197 notification of sexual predators as provided in this section. A
198 sexual predator who is unable to secure or update a driver
199 license or an identification card with the Department of Highway
200 Safety and Motor Vehicles as provided in paragraph (f) and this
201 paragraph shall also report any change in the sexual predator’s
202 permanent, temporary, or transient residence or change in the
203 sexual predator’s name by reason of marriage or other legal
204 process within 48 hours after the change in person to the
205 sheriff’s office in the county where the sexual predator resides
206 or is located and provide confirmation that he or she reported
207 such information to the Department of Highway Safety and Motor
208 Vehicles. The reporting requirements under this sub-subparagraph
209 subparagraph do not negate the requirement for a sexual predator
210 to obtain a Florida driver license or identification card as
211 required by this section. This sub-subparagraph does not apply
212 to an in-state travel residence.
213 b. A sexual predator shall report an in-state travel
214 residence within 48 hours after establishing the residence. The
215 report shall be made through the department’s online system; in
216 person at the sheriff’s office in the county in which the sexual
217 predator is located; in person at the Department of Corrections
218 if the sexual predator is in the custody or control of, or under
219 the supervision of the Department of Corrections; or in person
220 at the Department of Juvenile Justice if the sexual predator is
221 in the custody or control of, or under the supervision of the
222 Department of Juvenile Justice.
223 2.a. A sexual predator who vacates a permanent, temporary,
224 or transient residence and fails to establish or maintain
225 another permanent, temporary, or transient residence shall,
226 within 48 hours after vacating the permanent, temporary, or
227 transient residence, report in person to the sheriff’s office of
228 the county in which he or she is located. The sexual predator
229 shall specify the date upon which he or she intends to or did
230 vacate such residence. The sexual predator shall provide or
231 update all of the registration information required under
232 paragraph (a). The sexual predator shall provide an address for
233 the residence or other place where he or she is or will be
234 located during the time in which he or she fails to establish or
235 maintain a permanent or temporary residence.
236 b. A sexual predator shall report in person at the
237 sheriff’s office in the county in which he or she is located
238 within 48 hours after establishing a transient residence and
239 thereafter must report in person every 30 days to the sheriff’s
240 office in the county in which he or she is located while
241 maintaining a transient residence. The sexual predator must
242 provide the addresses and locations where he or she maintains a
243 transient residence. Each sheriff’s office shall report
244 transient residence information in a manner prescribed by the
245 department and provide notice to transient registrants to report
246 transient residence information as required in this sub
247 subparagraph. Reporting to the sheriff’s office as required by
248 this sub-subparagraph does not exempt registrants from any
249 reregistration requirement. The sheriff may coordinate and enter
250 into agreements with police departments and other governmental
251 entities to facilitate additional reporting sites for transient
252 residence registration required in this sub-subparagraph. The
253 sheriff’s office shall electronically submit to and update with
254 the department all such information within 2 business days after
255 the sexual predator provides it to the sheriff’s office.
256 3. A sexual predator who remains at a permanent, temporary,
257 or transient residence after reporting his or her intent to
258 vacate such residence shall, within 48 hours after the date upon
259 which the sexual predator indicated he or she would or did
260 vacate such residence, report in person to the sheriff’s office
261 to which he or she reported pursuant to subparagraph 2. for the
262 purpose of reporting his or her address at such residence. When
263 the sheriff receives the report, the sheriff shall promptly
264 convey the information to the department. A sexual predator who
265 makes a report as required under subparagraph 2. but fails to
266 make a report as required under this subparagraph commits a
267 felony of the second degree, punishable as provided in s.
268 775.082, s. 775.083, or s. 775.084.
269 4. The failure of a sexual predator who maintains a
270 transient residence to report in person to the sheriff’s office
271 every 30 days as required by sub-subparagraph 2.b. is punishable
272 as provided in subsection (10).
273 5.a. A sexual predator shall register all electronic mail
274 addresses and Internet identifiers, and each Internet
275 identifier’s corresponding website homepage or application
276 software name, with the department through the department’s
277 online system or in person at the sheriff’s office within 48
278 hours after using such electronic mail addresses or Internet
279 identifiers. If the sexual predator is in the custody or
280 control, or under the supervision, of the Department of
281 Corrections, he or she must report all electronic mail addresses
282 and Internet identifiers, and each Internet identifier’s
283 corresponding website homepage or application software name, to
284 the Department of Corrections before using such electronic mail
285 addresses or Internet identifiers. If the sexual predator is in
286 the custody or control, or under the supervision, of the
287 Department of Juvenile Justice, he or she must report all
288 electronic mail addresses and Internet identifiers, and each
289 Internet identifier’s corresponding website homepage or
290 application software name, to the Department of Juvenile Justice
291 before using such electronic mail addresses or Internet
292 identifiers.
293 b. A sexual predator shall register all changes to vehicles
294 owned, all changes to home telephone numbers and cellular
295 telephone numbers, including added and deleted numbers, all
296 changes to employment information, including the creation of a
297 new business if self-employed, and all changes in status related
298 to enrollment, volunteering, or employment at institutions of
299 higher education, through the department’s online system; in
300 person at the sheriff’s office; in person at the Department of
301 Corrections if the sexual predator is in the custody or control,
302 or under the supervision, of the Department of Corrections; or
303 in person at the Department of Juvenile Justice if the sexual
304 predator is in the custody or control, or under the supervision,
305 of the Department of Juvenile Justice. All changes required to
306 be reported in this sub-subparagraph shall be reported within 48
307 hours after the change.
308 c. The department shall establish an online system through
309 which sexual predators may securely access, submit, and update
310 all changes in status to in-state travel residences; all
311 vehicles owned; electronic mail addresses; Internet identifiers
312 and each Internet identifier’s corresponding website homepage or
313 application software name; home telephone numbers and cellular
314 telephone numbers; employment information; and institution of
315 higher education information.
316 (8) VERIFICATION.—The department and the Department of
317 Corrections shall implement a system for verifying the addresses
318 of sexual predators. The system must be consistent with the
319 federal Adam Walsh Child Protection and Safety Act of 2006 and
320 any other federal standards applicable to such verification or
321 required to be met as a condition for the receipt of federal
322 funds by the state. The Department of Corrections shall verify
323 the addresses of sexual predators who are not incarcerated but
324 who reside in the community under the supervision of the
325 Department of Corrections and shall report to the department any
326 failure by a sexual predator to comply with registration
327 requirements. County and local law enforcement agencies, in
328 conjunction with the department, shall verify the addresses of
329 sexual predators who are not under the care, custody, control,
330 or supervision of the Department of Corrections at least four
331 times per calendar year, and may verify the addresses of sexual
332 predators who are under the care, custody, control, or
333 supervision of the Department of Corrections. Local law
334 enforcement agencies shall report to the department any failure
335 by a sexual predator to comply with registration requirements.
336 (a) A sexual predator shall report in person each year
337 during the month of the sexual predator’s birthday and during
338 every third month thereafter to the sheriff’s office in the
339 county in which he or she resides or is otherwise located to
340 reregister. The sheriff’s office may determine the appropriate
341 times and days for reporting by the sexual predator, which must
342 be consistent with the reporting requirements of this paragraph.
343 Reregistration must include any changes to the following
344 information:
345 1. Name; social security number; age; race; sex; date of
346 birth; height; weight; tattoos or other identifying marks; hair
347 and eye color; address of any permanent residence and address of
348 any current temporary residence, within this state or out of
349 state, including a rural route address and a post office box; if
350 he or she has no permanent or temporary address, any transient
351 residence within this state including the address, location or
352 description of the transient residences, and dates of any
353 current or known future temporary residence within this state or
354 out of state; all electronic mail addresses; all Internet
355 identifiers and each Internet identifier’s corresponding website
356 homepage or application software name; all home telephone
357 numbers and cellular telephone numbers; date and place of any
358 employment information, including occupation, business name,
359 employment address, and telephone number; the make, model,
360 color, vehicle identification number (VIN), and license tag
361 number of all vehicles owned; fingerprints; palm prints; and
362 photograph. A post office box may not be provided in lieu of a
363 physical residential address. The sexual predator shall also
364 produce his or her passport, if he or she has a passport, and,
365 if he or she is an alien, shall produce or provide information
366 about documents establishing his or her immigration status. The
367 sexual predator shall also provide information about any
368 professional licenses he or she has.
369 2. If the sexual predator is enrolled or employed, whether
370 for compensation or as a volunteer, at an institution of higher
371 education in this state, the sexual predator shall also provide
372 to the department the name, address, and county of each
373 institution, including each campus attended, and the sexual
374 predator’s enrollment, volunteer, or employment status.
375 3. If the sexual predator’s place of residence is a motor
376 vehicle, trailer, mobile home, or manufactured home, as those
377 terms are defined in chapter 320, the sexual predator shall also
378 provide the vehicle identification number (VIN); the license tag
379 number; the registration number; and a description, including
380 color scheme, of the motor vehicle, trailer, mobile home, or
381 manufactured home. If the sexual predator’s place of residence
382 is a vessel, live-aboard vessel, or houseboat, as those terms
383 are defined in chapter 327, the sexual predator shall also
384 provide the hull identification number; the manufacturer’s
385 serial number; the name of the vessel, live-aboard vessel, or
386 houseboat; the registration number of the vessel, live-aboard
387 vessel, or houseboat; and a description, including color scheme,
388 of the vessel, live-aboard vessel, or houseboat.
389 (b) The sheriff’s office shall electronically submit to and
390 update with the department, in a manner prescribed by the
391 department, all such information within 2 business days after
392 the sexual predator provides it to the sheriff’s office.
393 (10) PENALTIES.—
394 (a) Except as otherwise specifically provided, a sexual
395 predator who fails to register; who fails, after registration,
396 to maintain, acquire, or renew a driver license or an
397 identification card; who fails to provide required location
398 information or change-of-name information; who fails to provide
399 electronic mail addresses, Internet identifiers, and each
400 Internet identifier’s corresponding website homepage or
401 application software name; who fails to provide all home
402 telephone numbers and cellular telephone numbers; who fails to
403 report any changes to employment information, including the
404 addition of new employment, termination of existing employment,
405 and changes to the occupation, business name, employment
406 address, and telephone number of previously reported employment;
407 who fails to report any or changes in status at an institution
408 of higher education; who fails to report any changes to vehicles
409 owned, including the addition of new vehicles and changes to the
410 make, model, color, vehicle identification number (VIN), and
411 license tag numbers of previously reported vehicles; who fails
412 to make a required report in connection with vacating a
413 permanent residence; who fails to reregister as required; who
414 fails to respond to any address verification correspondence from
415 the department or from county or local law enforcement agencies
416 within 3 weeks after the date of the correspondence; who
417 knowingly provides false registration information by act or
418 omission; or who otherwise fails, by act or omission, to comply
419 with the requirements of this section commits a felony of the
420 third degree, punishable as provided in s. 775.082, s. 775.083,
421 or s. 775.084. Each instance of a failure to register or report
422 changes to the required information specified in this paragraph
423 constitutes a separate offense.
424 Section 2. Paragraph (b) of subsection (2), paragraph (b)
425 of subsection (3), paragraphs (a) and (e) of subsection (4),
426 subsection (6), paragraph (a) of subsection (9), and paragraph
427 (c) of subsection (14) of section 943.0435, Florida Statutes,
428 are amended to read:
429 943.0435 Sexual offenders required to register with the
430 department; penalty.—
431 (2) Upon initial registration, a sexual offender shall:
432 (b) Provide his or her name; date of birth; social security
433 number; race; sex; height; weight; tattoos or other identifying
434 marks; hair and eye color; fingerprints; palm prints;
435 photograph; employment information, including occupation,
436 business name, employment address, and telephone number; address
437 of permanent or legal residence and or address of any current
438 temporary residence, within this state or out of state,
439 including a rural route address and a post office box; if he or
440 she has no permanent or temporary address, any transient
441 residence within this state; address, location or description,
442 and dates of any current or known future temporary residence
443 within this state or out of state; the make, model, color,
444 vehicle identification number (VIN), and license tag number of
445 all vehicles owned; home telephone numbers and cellular
446 telephone numbers; electronic mail addresses; Internet
447 identifiers and each Internet identifier’s corresponding website
448 homepage or application software name; date and place of each
449 conviction; and a brief description of the crime or crimes
450 committed by the sexual offender. A post office box may not be
451 provided in lieu of a physical residential address. The sexual
452 offender shall also produce his or her passport, if he or she
453 has a passport, and, if he or she is an alien, shall produce or
454 provide information about documents establishing his or her
455 immigration status. The sexual offender shall also provide
456 information about any professional licenses he or she has.
457 1. If the sexual offender’s place of residence is a motor
458 vehicle, trailer, mobile home, or manufactured home, as those
459 terms are defined in chapter 320, the sexual offender shall also
460 provide to the department through the sheriff’s office written
461 notice of the vehicle identification number (VIN); the license
462 tag number; the registration number; and a description,
463 including color scheme, of the motor vehicle, trailer, mobile
464 home, or manufactured home. If the sexual offender’s place of
465 residence is a vessel, live-aboard vessel, or houseboat, as
466 those terms are defined in chapter 327, the sexual offender
467 shall also provide to the department through the sheriff’s
468 office written notice of the hull identification number; the
469 manufacturer’s serial number; the name of the vessel, live
470 aboard vessel, or houseboat; the registration number of the
471 vessel, live-aboard vessel, or houseboat; and a description,
472 including color scheme, of the vessel, live-aboard vessel, or
473 houseboat.
474 2. If the sexual offender is enrolled or employed, whether
475 for compensation or as a volunteer, at an institution of higher
476 education in this state, the sexual offender shall also provide
477 to the department the name, address, and county of each
478 institution, including each campus attended, and the sexual
479 offender’s enrollment, volunteer, or employment status. The
480 sheriff, the Department of Corrections, or the Department of
481 Juvenile Justice shall promptly notify each institution of
482 higher education of the sexual offender’s presence and any
483 change in the sexual offender’s enrollment, volunteer, or
484 employment status.
485 3. A sexual offender shall report with the department
486 through the department’s online system or in person to the
487 sheriff’s office within 48 hours after any change in vehicles
488 owned to report those vehicle information changes.

490 When a sexual offender reports at the sheriff’s office, the
491 sheriff shall take a photograph, a set of fingerprints, and palm
492 prints of the offender and forward the photographs, palm prints,
493 and fingerprints to the department, along with the information
494 the sexual offender is required to provide pursuant to this
495 section. The sheriff shall promptly provide to the department
496 the information received from the sexual offender.
497 (3) Within 48 hours after the report required under
498 subsection (2), a sexual offender shall report in person at a
499 driver license office of the Department of Highway Safety and
500 Motor Vehicles, unless a driver license or identification card
501 that complies with the requirements of s. 322.141(3) was
502 previously secured or updated under s. 944.607. At the driver
503 license office the sexual offender shall:
504 (b) Pay the costs assessed by the Department of Highway
505 Safety and Motor Vehicles for issuing or renewing a driver
506 license or identification card as required by this section. The
507 driver license or identification card issued must comply be in
508 compliance with s. 322.141(3).
509 (4)(a)1. Each time a sexual offender’s driver license or
510 identification card is subject to renewal, and, without regard
511 to the status of the offender’s driver license or identification
512 card, within 48 hours after any change in the sexual offender’s
513 permanent, temporary, or transient residence or change in the
514 sexual offender’s name by reason of marriage or other legal
515 process, the sexual offender shall report in person to a driver
516 license office, and is subject to the requirements specified in
517 subsection (3). The Department of Highway Safety and Motor
518 Vehicles shall forward to the department all photographs and
519 information provided by sexual offenders. Notwithstanding the
520 restrictions set forth in s. 322.142, the Department of Highway
521 Safety and Motor Vehicles may release a reproduction of a color
522 photograph or digital-image license to the Department of Law
523 Enforcement for purposes of public notification of sexual
524 offenders as provided in this section and ss. 943.043 and
525 944.606. A sexual offender who is unable to secure or update a
526 driver license or an identification card with the Department of
527 Highway Safety and Motor Vehicles as provided in subsection (3)
528 and this subsection shall also report any change in the sexual
529 offender’s permanent, temporary, or transient residence or
530 change in the offender’s name by reason of marriage or other
531 legal process within 48 hours after the change in person to the
532 sheriff’s office in the county where the offender resides or is
533 located and provide confirmation that he or she reported such
534 information to the Department of Highway Safety and Motor
535 Vehicles. The reporting requirements under this sub-subparagraph
536 paragraph do not negate the requirement for a sexual offender to
537 obtain a Florida driver license or an identification card as
538 required in this section. This sub-subparagraph does not apply
539 to an in-state travel residence.
540 2. A sexual offender shall report an in-state travel
541 residence within 48 hours after establishing the residence. The
542 report shall be made through the department’s online system; in
543 person at the sheriff’s office in the county in which the sexual
544 offender is located; in person at the Department of Corrections
545 if the sexual offender is in the custody or control of, or under
546 the supervision of the Department of Corrections; or in person
547 at the Department of Juvenile Justice if the sexual offender is
548 in the custody or control of, or under the supervision of the
549 Department of Juvenile Justice.
550 (e)1. A sexual offender shall register all electronic mail
551 addresses and Internet identifiers, and each Internet
552 identifier’s corresponding website homepage or application
553 software name, with the department through the department’s
554 online system or in person at the sheriff’s office within 48
555 hours after using such electronic mail addresses or Internet
556 identifiers. If the sexual offender is in the custody or
557 control, or under the supervision, of the Department of
558 Corrections, he or she must report all electronic mail addresses
559 and Internet identifiers, and each Internet identifier’s
560 corresponding website homepage or application software name, to
561 the Department of Corrections before using such electronic mail
562 addresses or Internet identifiers. If the sexual offender is in
563 the custody or control, or under the supervision, of the
564 Department of Juvenile Justice, he or she must report all
565 electronic mail addresses and Internet identifiers, and each
566 Internet identifier’s corresponding website homepage or
567 application software name, to the Department of Juvenile Justice
568 before using such electronic mail addresses or Internet
569 identifiers.
570 2. A sexual offender shall register all changes to vehicles
571 owned, all changes to home telephone numbers and cellular
572 telephone numbers, including added and deleted numbers, all
573 changes to employment information, including the creation of a
574 new business if self-employed, and all changes in status related
575 to enrollment, volunteering, or employment at institutions of
576 higher education, through the department’s online system; in
577 person at the sheriff’s office; in person at the Department of
578 Corrections if the sexual offender is in the custody or control,
579 or under the supervision, of the Department of Corrections; or
580 in person at the Department of Juvenile Justice if the sexual
581 offender is in the custody or control, or under the supervision,
582 of the Department of Juvenile Justice. All changes required to
583 be reported under this subparagraph must be reported within 48
584 hours after the change.
585 3. The department shall establish an online system through
586 which sexual offenders may securely access, submit, and update
587 all changes in status to in-state travel residences; vehicles
588 owned; electronic mail addresses; Internet identifiers and each
589 Internet identifier’s corresponding website homepage or
590 application software name; home telephone numbers and cellular
591 telephone numbers; employment information; and institution of
592 higher education information.
593 (6) County and local law enforcement agencies, in
594 conjunction with the department, shall verify the addresses of
595 sexual offenders who are not under the care, custody, control,
596 or supervision of the Department of Corrections at least one
597 time per calendar year, and may verify the addresses of sexual
598 offenders who are under the care, custody, control, or
599 supervision of the Department of Corrections. The system for
600 verifying addresses of sexual offenders must be, in a manner
601 that is consistent with the provisions of the federal Adam Walsh
602 Child Protection and Safety Act of 2006 and any other federal
603 standards applicable to such verification or required to be met
604 as a condition for the receipt of federal funds by the state.
605 Local law enforcement agencies shall report to the department
606 any failure by a sexual offender to comply with registration
607 requirements.
608 (9)(a) Except as otherwise specifically provided, a sexual
609 offender who fails to register; who fails, after registration,
610 to maintain, acquire, or renew a driver license or an
611 identification card; who fails to provide required location
612 information or change-of-name information; who fails to provide
613 electronic mail addresses, Internet identifiers, and each
614 Internet identifier’s corresponding website homepage or
615 application software name; who fails to provide all home
616 telephone numbers and cellular telephone numbers; who fails to
617 report any changes to employment information, including the
618 addition of new employment, termination of existing employment,
619 and changes to the occupation, business name, employment
620 address, and telephone number of previously reported employment;
621 who fails to report any or changes in status at an institution
622 of higher education; who fails to report any changes to vehicles
623 owned, including the addition of new vehicles and changes to the
624 make, model, color, vehicle identification number (VIN), and
625 license tag numbers of previously reported vehicles; who fails
626 to make a required report in connection with vacating a
627 permanent residence; who fails to reregister as required; who
628 fails to respond to any address verification correspondence from
629 the department or from county or local law enforcement agencies
630 within 3 weeks after the date of the correspondence; who
631 knowingly provides false registration information by act or
632 omission; or who otherwise fails, by act or omission, to comply
633 with the requirements of this section commits a felony of the
634 third degree, punishable as provided in s. 775.082, s. 775.083,
635 or s. 775.084. Each instance of a failure to register or report
636 changes to the required information specified in this paragraph
637 constitutes a separate offense.
638 (14)
639 (c) The sheriff’s office may determine the appropriate
640 times and days for reporting by the sexual offender, which must
641 be consistent with the reporting requirements of this
642 subsection. Reregistration must include any changes to the
643 following information:
644 1. Name; social security number; age; race; sex; date of
645 birth; height; weight; tattoos or other identifying marks; hair
646 and eye color; address of any permanent residence and address of
647 any current temporary residence, within this state or out of
648 state, including a rural route address and a post office box; if
649 he or she has no permanent or temporary address, any transient
650 residence within this state; address, location or description,
651 and dates of any current or known future temporary residence
652 within this state or out of state; all electronic mail addresses
653 or Internet identifiers and each Internet identifier’s
654 corresponding website homepage or application software name; all
655 home telephone numbers and cellular telephone numbers;
656 employment information, including occupation, business name,
657 employment address, and telephone number; the make, model,
658 color, vehicle identification number (VIN), and license tag
659 number of all vehicles owned; fingerprints; palm prints; and
660 photograph. A post office box may not be provided in lieu of a
661 physical residential address. The sexual offender shall also
662 produce his or her passport, if he or she has a passport, and,
663 if he or she is an alien, shall produce or provide information
664 about documents establishing his or her immigration status. The
665 sexual offender shall also provide information about any
666 professional licenses he or she has.
667 2. If the sexual offender is enrolled or employed, whether
668 for compensation or as a volunteer, at an institution of higher
669 education in this state, the sexual offender shall also provide
670 to the department the name, address, and county of each
671 institution, including each campus attended, and the sexual
672 offender’s enrollment, volunteer, or employment status.
673 3. If the sexual offender’s place of residence is a motor
674 vehicle, trailer, mobile home, or manufactured home, as those
675 terms are defined in chapter 320, the sexual offender shall also
676 provide the vehicle identification number (VIN); the license tag
677 number; the registration number; and a description, including
678 color scheme, of the motor vehicle, trailer, mobile home, or
679 manufactured home. If the sexual offender’s place of residence
680 is a vessel, live-aboard vessel, or houseboat, as those terms
681 are defined in chapter 327, the sexual offender shall also
682 provide the hull identification number; the manufacturer’s
683 serial number; the name of the vessel, live-aboard vessel, or
684 houseboat; the registration number of the vessel, live-aboard
685 vessel, or houseboat; and a description, including color scheme,
686 of the vessel, live-aboard vessel, or houseboat.
687 Section 3. This act shall take effect October 1, 2025.
