The Committee on Criminal Justice (Arrington) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Present subsections (2) and (3) of section
6 827.04, Florida Statutes, are redesignated as subsections (3)
7 and (4), respectively, a new subsection (2) is added to that
8 section, and subsection (1) of that section is amended, to read:
9 827.04 Contributing to the delinquency or dependency of a
10 child; penalty.—
11 (1) Except as provided in subsection (2), any person who:
12 (a) Commits any act which causes, tends to cause,
13 encourages, or contributes to a child becoming a delinquent or
14 dependent child or a child in need of services; or
15 (b) Induces or endeavors to induce, by act, threat,
16 command, or persuasion, a child to commit or perform any act,
17 follow any course of conduct, or live in a manner that causes or
18 tends to cause such child to become or to remain a dependent or
19 delinquent child or a child in need of services,
20
21 commits a misdemeanor of the first degree, punishable as
22 provided in s. 775.082 or s. 775.083.
23 (2)(a) A person who commits any act that causes, tends to
24 cause, encourages, or contributes to a child committing an
25 offense that is:
26 1. A felony of the third degree, commits a misdemeanor of
27 the first degree, punishable as provided in s. 775.082 or s.
28 775.083.
29 2. A felony of the second degree, commits a felony of the
30 third degree, punishable as provided in s. 775.082, s. 775.083,
31 or s. 775.084.
32 3. A felony of the first degree, commits a felony of the
33 second degree, punishable as provided in s. 775.082, s. 775.083,
34 or s. 775.084.
35 4. A capital felony, commits a felony of the first degree,
36 punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
37 (b) A person who induces or endeavors to induce, by act,
38 threat, command, or persuasion, a child to commit an offense
39 that is:
40 1. A felony of the third degree, commits a misdemeanor of
41 the first degree, punishable as provided in s. 775.082 or s.
42 775.083.
43 2. A felony of the second degree, commits a felony of the
44 third degree, punishable as provided in s. 775.082, s. 775.083,
45 or s. 775.084.
46 3. A felony of the first degree, commits a felony of the
47 second degree, punishable as provided in s. 775.082, s. 775.083,
48 or s. 775.084.
49 4. A capital felony, commits a felony of the first degree,
50 punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
51 Section 2. Section 827.12, Florida Statutes, is created to
52 read:
53 827.12 Causing or enticing a minor to commit, or committing
54 in the presence of a minor, animal cruelty; penalty.—An
55 individual 18 years of age or older commits a felony of the
56 third degree, punishable as provided in s. 775.082, s. 775.083,
57 or s. 775.084, if he or she causes or entices a minor to commit,
58 or in the presence of a minor commits, a violation of s.
59 828.12(2), s. 828.122, or s. 828.126.
60 Section 3. Paragraphs (a), (e), (f), and (g) of subsection
61 (3) of section 921.0022, Florida Statutes, are amended to read:

384 39.201 Required reports of child abuse, abandonment, or
385 neglect, sexual abuse of a child, and juvenile sexual abuse;
386 required reports of death; reports involving a child who has
387 exhibited inappropriate sexual behavior.—
388 (3) ADDITIONAL CIRCUMSTANCES RELATED TO REPORTS.—
389 (c) Abuse involving impregnation of a child.—A report must
390 be immediately electronically transferred to the appropriate
391 county sheriff’s office or other appropriate law enforcement
392 agency by the central abuse hotline if the report is of an
393 instance of known or suspected child abuse involving
394 impregnation of a child 15 years of age or younger by a person
395 21 years of age or older under s. 827.04(4) s. 827.04(3). If the
396 report is of known or suspected child abuse under s. 827.04(4)
397 s. 827.04(3), subsection (1) does not apply to health care
398 professionals or other professionals who provide medical or
399 counseling services to pregnant children when such reporting
400 would interfere with the provision of such medical or counseling
401 services.
402 Section 5. Section 90.4025, Florida Statutes, is amended to
403 read:
404 90.4025 Admissibility of paternity determination in certain
405 criminal prosecutions.—If a person less than 18 years of age
406 gives birth to a child and the paternity of that child is
407 established under chapter 742, such evidence of paternity is
408 admissible in a criminal prosecution under ss. 794.011, 794.05,
409 800.04, and 827.04(4) 827.04(3).
410 Section 6. Section 382.356, Florida Statutes, is amended to
411 read:
412 382.356 Protocol for sharing certain birth certificate
413 information.—In order to facilitate the prosecution of offenses
414 under s. 794.011, s. 794.05, s. 800.04, or s. 827.04(4) s.
415 827.04(3), the Department of Health, the Department of Revenue,
416 and the Florida Prosecuting Attorneys Association shall develop
417 a protocol for sharing birth certificate information for all
418 children born to unmarried mothers who are less than 17 years of
419 age at the time of the child’s birth.
420 Section 7. Section 409.2355, Florida Statutes, is amended
421 to read:
422 409.2355 Programs for prosecution of males over age 21 who
423 commit certain offenses involving girls under age 16.—Subject to
424 specific appropriated funds, the Department of Children and
425 Families is directed to establish a program by which local
426 communities, through the state attorney’s office of each
427 judicial circuit, may apply for grants to fund innovative
428 programs for the prosecution of males over the age of 21 who
429 victimize girls under the age of 16 in violation of s. 794.011,
430 s. 794.05, s. 800.04, s. 827.04(4) s. 827.04(3), or s.
431 847.0135(5).
432 Section 8. Subsection (4) of section 742.107, Florida
433 Statutes, is amended to read:
434 742.107 Determining paternity of child with mother under 16
435 years of age when impregnated.—
436 (4) When the information provided by the applicant or
437 recipient who was impregnated while under age 16 indicates that
438 such person is the victim of child abuse as provided in s.
439 827.04(4) s. 827.04(3), the Department of Revenue or the
440 Department of Children and Families shall notify the county
441 sheriff’s office or other appropriate agency or official and
442 provide information needed to protect the child’s health or
443 welfare.
444 Section 9. This act shall take effect October 1, 2025.
