    1                        A bill to be entitled                      
    2         An act relating to criminal justice; amending s.
    3         827.04, F.S.; providing criminal penalties for persons
    4         who commit any act that causes, tends to cause,
    5         encourages, or contributes to a child committing
    6         offenses of specified severities; providing criminal
    7         penalties for persons who induce or endeavor to
    8         induce, by act, threat, command, or persuasion, a
    9         child to commit offenses of specified severities;
   10         creating s. 827.12, F.S.; providing criminal penalties
   11         for an adult who causes or entices a minor to commit,
   12         or in the presence of a minor commits, a specified
   13         violation of law relating to animal cruelty; amending
   14         s. 921.0022, F.S.; increasing the level on the offense
   15         severity ranking chart for fighting or baiting
   16         animals; ranking an offense created by the act on the
   17         offense severity ranking chart; conforming a cross
   18         reference; amending ss. 39.201, 90.4025, 382.356,
   19         409.2355, and 742.107, F.S.; conforming cross
   20         references; providing an effective date.
   21          
   22  Be It Enacted by the Legislature of the State of Florida:
   23  
   24         Section 1. Present subsections (2) and (3) of section
   25  827.04, Florida Statutes, are redesignated as subsections (3)
   26  and (4), respectively, a new subsection (2) is added to that
   27  section, and subsection (1) of that section is amended, to read:
   28         827.04 Contributing to the delinquency or dependency of a
   29  child; penalty.—
   30         (1) Except as provided in subsection (2), any person who:
   31         (a) Commits any act which causes, tends to cause,
   32  encourages, or contributes to a child becoming a delinquent or
   33  dependent child or a child in need of services; or
   34         (b) Induces or endeavors to induce, by act, threat,
   35  command, or persuasion, a child to commit or perform any act,
   36  follow any course of conduct, or live in a manner that causes or
   37  tends to cause such child to become or to remain a dependent or
   38  delinquent child or a child in need of services,
   39  
   40  commits a misdemeanor of the first degree, punishable as
   41  provided in s. 775.082 or s. 775.083.
   42         (2)(a) A person who commits any act that causes, tends to
   43  cause, encourages, or contributes to a child committing an
   44  offense that is:
   45         1. A felony of the third degree, commits a misdemeanor of
   46  the first degree, punishable as provided in s. 775.082 or s.
   47  775.083.
   48         2. A felony of the second degree, commits a felony of the
   49  third degree, punishable as provided in s. 775.082, s. 775.083,
   50  or s. 775.084.
   51         3. A felony of the first degree, commits a felony of the
   52  second degree, punishable as provided in s. 775.082, s. 775.083,
   53  or s. 775.084.
   54         4. A capital felony, commits a felony of the first degree,
   55  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
   56         (b) A person who induces or endeavors to induce, by act,
   57  threat, command, or persuasion, a child to commit an offense
   58  that is:
   59         1. A felony of the third degree, commits a misdemeanor of
   60  the first degree, punishable as provided in s. 775.082 or s.
   61  775.083.
   62         2. A felony of the second degree, commits a felony of the
   63  third degree, punishable as provided in s. 775.082, s. 775.083,
   64  or s. 775.084.
   65         3. A felony of the first degree, commits a felony of the
   66  second degree, punishable as provided in s. 775.082, s. 775.083,
   67  or s. 775.084.
   68         4. A capital felony, commits a felony of the first degree,
   69  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
   70         Section 2. Section 827.12, Florida Statutes, is created to
   71  read:
   72         827.12Causing or enticing a minor to commit, or committing
   73  in the presence of a minor, animal cruelty; penalty.—An
   74  individual 18 years of age or older commits a felony of the
   75  third degree, punishable as provided in s. 775.082, s. 775.083,
   76  or s. 775.084, if he or she causes or entices a minor to commit,
   77  or in the presence of a minor commits, a violation of s.
   78  828.12(2), s. 828.122, or s. 828.126.
   79         Section 3. Paragraphs (a), (e), (f), and (g) of subsection
   80  (3) of section 921.0022, Florida Statutes, are amended to read:

  400         Section 4. Paragraph (c) of subsection (3) of section
  401  39.201, Florida Statutes, is amended to read:
  402         39.201 Required reports of child abuse, abandonment, or
  403  neglect, sexual abuse of a child, and juvenile sexual abuse;
  404  required reports of death; reports involving a child who has
  405  exhibited inappropriate sexual behavior.—
  406         (3) ADDITIONAL CIRCUMSTANCES RELATED TO REPORTS.—
  407         (c) Abuse involving impregnation of a child.—A report must
  408  be immediately electronically transferred to the appropriate
  409  county sheriff’s office or other appropriate law enforcement
  410  agency by the central abuse hotline if the report is of an
  411  instance of known or suspected child abuse involving
  412  impregnation of a child 15 years of age or younger by a person
  413  21 years of age or older under s. 827.04(4) s. 827.04(3). If the
  414  report is of known or suspected child abuse under s. 827.04(4)
  415  s. 827.04(3), subsection (1) does not apply to health care
  416  professionals or other professionals who provide medical or
  417  counseling services to pregnant children when such reporting
  418  would interfere with the provision of such medical or counseling
  419  services.
  420         Section 5. Section 90.4025, Florida Statutes, is amended to
  421  read:
  422         90.4025 Admissibility of paternity determination in certain
  423  criminal prosecutions.—If a person less than 18 years of age
  424  gives birth to a child and the paternity of that child is
  425  established under chapter 742, such evidence of paternity is
  426  admissible in a criminal prosecution under ss. 794.011, 794.05,
  427  800.04, and 827.04(4) 827.04(3).
  428         Section 6. Section 382.356, Florida Statutes, is amended to
  429  read:
  430         382.356 Protocol for sharing certain birth certificate
  431  information.—In order to facilitate the prosecution of offenses
  432  under s. 794.011, s. 794.05, s. 800.04, or s. 827.04(4) s.
  433  827.04(3), the Department of Health, the Department of Revenue,
  434  and the Florida Prosecuting Attorneys Association shall develop
  435  a protocol for sharing birth certificate information for all
  436  children born to unmarried mothers who are less than 17 years of
  437  age at the time of the child’s birth.
  438         Section 7. Section 409.2355, Florida Statutes, is amended
  439  to read:
  440         409.2355 Programs for prosecution of males over age 21 who
  441  commit certain offenses involving girls under age 16.—Subject to
  442  specific appropriated funds, the Department of Children and
  443  Families is directed to establish a program by which local
  444  communities, through the state attorney’s office of each
  445  judicial circuit, may apply for grants to fund innovative
  446  programs for the prosecution of males over the age of 21 who
  447  victimize girls under the age of 16 in violation of s. 794.011,
  448  s. 794.05, s. 800.04, s. 827.04(4) s. 827.04(3), or s.
  449  847.0135(5).
  450         Section 8. Subsection (4) of section 742.107, Florida
  451  Statutes, is amended to read:
  452         742.107 Determining paternity of child with mother under 16
  453  years of age when impregnated.—
  454         (4) When the information provided by the applicant or
  455  recipient who was impregnated while under age 16 indicates that
  456  such person is the victim of child abuse as provided in s.
  457  827.04(4) s. 827.04(3), the Department of Revenue or the
  458  Department of Children and Families shall notify the county
  459  sheriff’s office or other appropriate agency or official and
  460  provide information needed to protect the child’s health or
  461  welfare.
  462         Section 9. This act shall take effect October 1, 2025.
