    1                        A bill to be entitled                      
    2         An act relating to alcohol consumption; amending s.
    3         561.706, F.S.; requiring the Division of Alcoholic
    4         Beverages and Tobacco of the Department of Business
    5         and Professional Regulation to consider a vendor’s use
    6         of an electronic identification scanner in mitigation
    7         of certain administrative penalties; amending s.
    8         562.11, F.S.; authorizing the division to require a
    9         vendor found to have violated certain provisions of
   10         law to use an electronic identification scanner to
   11         check driver licenses or identification cards to
   12         verify the age of a person; creating s. 562.114, F.S.;
   13         requiring state and local law enforcement agencies to
   14         refer to the division all relevant reports of
   15         investigations and arrests concerning drivers under
   16         the influence of alcohol whose crashes contributed to
   17         serious bodily injury or death; providing an effective
   18         date.

   20  Be It Enacted by the Legislature of the State of Florida:
   21  
   22         Section 1. Subsection (2) of section 561.706, Florida
   23  Statutes, is amended to read:
   24         561.706 Exemption from license suspension or revocation;
   25  mitigation for certain beverage law violations; records of
   26  arrests.—
   27         (2)(a) The division shall consider qualification as a
   28  responsible vendor in mitigation of administrative penalties for
   29  an employee’s illegal sale or service of an alcoholic beverage
   30  to a person who is not of lawful drinking age and if the vendor
   31  has administered the applicable courses for controlled
   32  substances, for an employee’s engaging in the illegal sale, use
   33  of, or trafficking in controlled substances.
   34         (b) The division shall consider the vendor’s use of an
   35  electronic identification scanner to check the driver license or
   36  identification card of a person and verify his or her age in
   37  mitigation of administrative penalties for an employee’s illegal
   38  sale or service of an alcoholic beverage to a person who is not
   39  of lawful drinking age.
   40         Section 2. Subsection (5) is added to section 562.11,
   41  Florida Statutes, to read:
   42         562.11 Selling, giving, or serving alcoholic beverages to
   43  person under age 21; providing a proper name; misrepresenting or
   44  misstating age or age of another to induce licensee to serve
   45  alcoholic beverages to person under 21; penalties.—
   46         (5) In addition to any other penalty authorized under the
   47  Beverage Law, the division may require a vendor found to have
   48  violated paragraph (1)(a) or paragraph (1)(b) to use an
   49  electronic identification scanner to check the driver license or
   50  identification card of a person and verify his or her age.
   51         Section 3. Section 562.114, Florida Statutes, is created to
   52  read:
   53         562.114 State and local law enforcement reporting
   54  requirement.—State and local law enforcement agencies shall
   55  refer to the division all relevant reports of investigations and
   56  arrests concerning the driver of a vehicle involved in a crash
   57  on public or private property while driving under the influence
   58  of alcoholic beverages which contributed in whole or in part to
   59  serious bodily injury or the death of a person.
   60         Section 4. This act shall take effect July 1, 2025.
