       Senator Burgess moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 974 and 975
    4  insert:
    5         Section 16. Subsection (4) is added to section 373.423,
    6  Florida Statutes, to read:
    7         373.423 Inspection.—
    8         (4)(a) For purposes of this subsection the term:
    9         1. “MS4” means a municipal separate storm sewer system as
   10  defined in 40 C.F.R. s. 122.26(b).
   11         2. “MS4 entity” means an MS4 permittee.
   12         (b) Each MS4 entity shall conduct an inspection of all
   13  permitted stormwater management systems owned or operated by the
   14  MS4 entity in accordance with the inspection schedule required
   15  by the MS4 permit. As part of such inspection, the MS4 entity
   16  shall identify any infrastructure within the MS4, or any
   17  component thereof, which:
   18         1. Has a significant vulnerability to obstruction,
   19  blockage, deterioration, failure, or other deficiencies; and
   20         2. Upon operational failure, would result in flooding and
   21  property damage.
   22         (c) Any infrastructure identified in the inspection that
   23  satisfies the conditions in subparagraph (b)1. or subparagraph
   24  (b)2. must be observed and reviewed by the MS4 entity annually
   25  by June 1 thereafter.
   26         (d) The MS4 entity shall complete the stormwater facility
   27  inspection checklist developed by the department each time an
   28  MS4 inspection is conducted pursuant to this subsection.
   29  Following each inspection, a completed checklist must be
   30  submitted to the department and the Division of Emergency
   31  Management.
   32         (e) This subsection does not apply to the Department of
   33  Transportation or to any entity that operates a toll facility in
   34  this state.

   47         requiring each MS4 entity to complete a stormwater
   48         facility inspection checklist for inspections of such
   49         systems; requiring that such checklist be submitted to
   50         specified entities; providing applicability; amending
