Florida Senate - 2025 SB 1802 By Senator Calatayud 38-02066-25 20251802__ 1 A bill to be entitled 2 An act relating to public records; amending s. 3 381.992, F.S.; providing a public records exemption 4 for information held in the Parkinson’s Disease 5 Research Program Registry which provides background 6 information on individuals served by the Parkinson’s 7 Disease Research Program; providing for future 8 legislative review and repeal of the exemption; 9 providing a statement of public necessity; providing a 10 contingent effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Subsection (7) is added to section 381.992, 15 Florida Statutes, as created by SB 1800, 2025 Regular Session, 16 to read: 17 (7) PUBLIC RECORDS EXEMPTION.—Any information held in the 18 Parkinson’s Disease Research Program Registry created under 19 paragraph (2)(c) which provides background information on 20 individuals served by the program, along with any related 21 information that is derived or created from the information, is 22 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 23 Constitution, except that the information may be shared with 24 another governmental entity in the furtherance of its duties and 25 responsibilities without waiving such exemption. This subsection 26 is subject to the Open Government Sunset Review Act in 27 accordance with s. 119.15 and shall stand repealed on October 2, 28 2030, unless reviewed and saved from repeal through reenactment 29 by the Legislature. 30 Section 2. The Legislature finds that it is a public 31 necessity to make exempt from public records requirements 32 information held in the Parkinson’s Disease Research Program 33 Registry which would identify an individual. Such personal 34 identifying health care information, if publicly available, 35 could be used to invade the personal privacy of the individual 36 identified in the registry. Furthermore, the disclosure of such 37 information could hinder the effective and efficient 38 administration of the registry. Finally, access to such 39 information could be used to solicit or harass an individual 40 identified in the registry. Thus, the Legislature finds that 41 information held in the Parkinson’s Disease Research Program 42 Registry which would identify an individual should be exempt 43 from public records requirements. 44 Section 3. This act shall take effect on the same date that 45 SB 1800 or similar legislation takes effect, if such legislation 46 is adopted in the same legislative session or an extension 47 thereof and becomes a law.
