       The Committee on Rules (Martin) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 113 - 117
    4  and insert:
    5  department,
    6         (1)The regulation of auxiliary containers is expressly
    7  preempted to the state. A local government, local governmental
    8  government agency, or state governmental agency may not enact or
    9  enforce any rule, regulation, or ordinance regarding the use,
   10  disposition, sale, prohibition, restriction, or tax of such
   11  auxiliary containers unless explicitly permitted by statute.
   12         (2)Rules, regulations, or ordinances restricting the use
   13  of glass auxiliary containers within the boundaries of any
   14  public beach are explicitly permitted.
   15         (3)The Division of Recreation and Parks of the Department
   16  of Environmental Protection may adopt rules regulating auxiliary
   17  containers within state parks consistent with its grant of
   18  authority in s. 258.004,

   22  And the title is amended as follows:
   23         Delete lines 8 - 10
   24  and insert:
   25         update a specified report; preempting the regulation
   26         of auxiliary containers to the state; permitting
   27         rules, regulations, or ordinances restricting the use
   28         of glass auxiliary containers within the boundaries of
   29         a public beach; requiring the Division of Recreation
   30         and Parks to adopt rules regulating auxiliary
   31         containers within state parks; amending ss. 403.706
   32         and
