       Senator Martin moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 15 - 81
    4  and insert:
    5         Section 1. Section 810.091, Florida Statutes, is created to
    6  read:
    7         810.091 Trespass at a large-scale ticketed event.—
    8         (1) As used in this section, the term:
    9         (a) “Covered event” means a ticketed event where attendance
   10  exceeds 15,000 persons. The duration of such event includes the
   11  period from the time when a venue is held open to the public for
   12  such an event until the event ends and the venue is secured.
   13         (b) “Person authorized” means any owner or lessee, or his
   14  or her agent, or any law enforcement officer whose department
   15  has received written authorization from the owner or lessee, or
   16  his or her agent, to communicate an order to depart the covered
   17  event in the case of a threat to public safety or welfare.
   18         (c) “Restricted area” means any area designated for access
   19  by ticketed persons.
   20         (2) A person who, without being authorized, licensed, or
   21  invited, willfully enters or remains in any restricted area
   22  during a covered event, or having been authorized, licensed, or
   23  invited, is warned by the owner or lessee of the venue hosting
   24  the covered event, or by a person authorized by the owner or
   25  lessee, to depart and refuses to do so commits a felony of the
   26  third degree, punishable as provided in s. 775.082, s. 775.083,
   27  or s. 775.084.
