       The Committee on Rules (Gruters) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 116 - 147
    4  and insert:
    5         (2)Except as provided in subsection (5), beginning July 1,
    6  2026, cosmetics manufactured, sold, offered or distributed for
    7  sale, or distributed for use in this state must provide notice
    8  on such cosmetics’ single-use packaging of the following
    9  intentionally added chemicals or chemical classes:
   10         (a)Ortho-phthalates.
   11         (b)PFAS.
   12         (c)Formaldehyde as identified in CAS 50-00-0.
   13         (d)Methylene glycol as identified in CAS 463-57-0.
   14         (e)Mercury as identified in CAS 7439-97-6.
   15         (f)Triclosan as identified in CAS 3380-34-5.
   16         (g)M-phenylenediamine or its salt derivatives as
   17  identified in CAS 108-45-2.
   18         (h)O-phenylenediamine or its salt derivatives as
   19  identified in CAS 95-54-5.
   20         (3)Except as provided in subsection (5), beginning July 1,
   21  2026, cosmetics manufactured, sold, offered or distributed for
   22  sale, or distributed for use in this state must provide notice
   23  on such cosmetics’ single-use packaging of any lead or lead
   24  compounds as identified by CAS 7439-92-1, whether intentionally
   25  added or naturally occurring, at 10 parts per million or more,
   26  or as otherwise determined by department rule.
   27         (4) Except as provided in subsection (5), beginning July 1,
   28  2026, cosmetics manufactured, sold, offered or distributed for
   29  sale, or distributed for use in this state may not release
   30  formaldehyde as identified in paragraph (2)(c) unless it is a
   31  natural byproduct with no functional or technical purpose.
   32         (5)A retailer in possession of cosmetics that do not
   33  comply with the requirements of this section as of July 1, 2026,
   34  may exhaust its existing stock through sales to the public until
   35  July 1, 2027.
   36         (6)A violation of this section is subject to the penalties
   37  and remedies provided in s. 499.066.
   38         (7)This section does not apply to cosmetic products
   39  regulated as drugs by the United States Food and Drug
   40  Administration.
   41         (8)The department shall adopt rules necessary to implement
   42  this section.
