Subsection (1) of section 316.20655, Florida 7 Statutes, is amended, and subsections (8) and (9) are added to 8 that section, to read: 9 316.20655 Electric bicycle regulations.— 10 (1) Except as otherwise provided in this section, an 11 electric bicycle or an operator of an electric bicycle shall be 12 afforded all the rights and privileges, and be subject to all of 13 the duties, of a bicycle or the operator of a bicycle, including 14 s. 316.2065. An electric bicycle is a vehicle to the same extent 15 as a bicycle. However, this section may not be construed to 16 prevent a local government, through the exercise of its powers 17 under s. 316.008, from adopting an ordinance governing the 18 operation of electric bicycles on streets, highways, sidewalks, 19 and sidewalk areas under or within the local government’s 20 jurisdiction; to prevent a municipality, county, or agency of 21 the state having jurisdiction over a bicycle path, multiuse 22 path, or trail network from restricting or prohibiting the 23 operation of an electric bicycle on a bicycle path, multiuse 24 path, or trail network; or to prevent a municipality, county, or 25 agency of the state having jurisdiction over a beach as defined 26 in s. 161.54(3) or a dune as defined in s. 161.54(4) from 27 restricting or prohibiting the operation of an electric bicycle 28 on such beach or dune. 29 (8) A local government may adopt an ordinance providing one 30 or more minimum age requirements to operate an electric bicycle 31 and may adopt an ordinance requiring an operator of an electric 32 bicycle to possess a government-issued photographic 33 identification while operating the electric bicycle. 34 (9) A local government may provide training on the safe 35 operation of electric bicycles and compliance with the traffic 36 laws of this state that apply to electric bicycles. 37 Section 6. Subsections (7) and (8) are added to section 38 316.2128, Florida Statutes, to read: 39 316.2128 Micromobility devices, motorized scooters, and 40 miniature motorcycles; requirements.— 41 (7) A local government may adopt an ordinance providing one 42 or more minimum age requirements to operate a motorized scooter 43 or micromobility device and may adopt an ordinance requiring a 44 person who operates a motorized scooter or micromobility device 45 to possess a government-issued photographic identification while 46 operating the motorized scooter or micromobility device. 47 (8) A local government may provide training on the safe 48 operation of motorized scooters and micromobility devices and 49 compliance with the traffic laws of this state that apply to 50 motorized scooters and micromobility devices. 51 52 ================= T I T L E A M E N D M E N T ================ 53 And the title is amended as follows: 54 Between lines 507 and 508 55 insert: 56 316.20655, F.S.; authorizing a local government to 57 adopt certain ordinances and provide certain training 58 relating to the safe operation of electric bicycles; 59 amending s. 316.2128, F.S.; authorizing a local 60 government to adopt certain ordinances and provide 61 certain training relating to the safe operation of 62 motorized scooters and micromobility devices; amending 63 s.
