    1                        A bill to be entitled                      
    2         An act relating to fleeing or attempting to elude a
    3         law enforcement officer; amending s. 316.1935, F.S.;
    4         revising the law enforcement vehicle marking
    5         requirements for specified offenses; providing
    6         mandatory minimum classification of certain offenses;
    7         amending s. 921.0022, F.S.; reclassifying offenses for
    8         purposes of the offense severity ranking chart of the
    9         Criminal Punishment Code; providing an effective date.
   10          
   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Present subsections (5), (6), and (7) of section
   14  316.1935, Florida Statutes, are redesignated as subsections (6),
   15  (7), and (8), respectively, a new subsection (5) is added to
   16  that section, subsections (2), (3), and (4) of that section are
   17  amended, and subsection (1) of that section is republished, to
   18  read:
   19         316.1935 Fleeing or attempting to elude a law enforcement
   20  officer; aggravated fleeing or eluding.—
   21         (1) It is unlawful for the operator of any vehicle, having
   22  knowledge that he or she has been ordered to stop such vehicle
   23  by a duly authorized law enforcement officer, willfully to
   24  refuse or fail to stop the vehicle in compliance with such order
   25  or, having stopped in knowing compliance with such order,
   26  willfully to flee in an attempt to elude the officer, and a
   27  person who violates this subsection commits a felony of the
   28  third degree, punishable as provided in s. 775.082, s. 775.083,
   29  or s. 775.084.
   30         (2) Any person who willfully flees or attempts to elude a
   31  law enforcement officer in an authorized law enforcement patrol
   32  vehicle, with agency insignia and other jurisdictional markings
   33  prominently displayed on the vehicle, with siren and lights
   34  activated commits a felony of the first third degree, punishable
   35  as provided in s. 775.082, s. 775.083, or s. 775.084.
   36         (3) Any person who willfully flees or attempts to elude a
   37  law enforcement officer in an authorized law enforcement patrol
   38  vehicle, with agency insignia and other jurisdictional markings
   39  prominently displayed on the vehicle, with siren and lights
   40  activated, and during the course of the fleeing or attempted
   41  eluding:
   42         (a) Drives at high speed, or in any manner which
   43  demonstrates a wanton disregard for the safety of persons or
   44  property, commits a felony of the second degree, punishable as
   45  provided in s. 775.082, s. 775.083, or s. 775.084.
   46         (b) Drives at high speed, or in any manner which
   47  demonstrates a wanton disregard for the safety of persons or
   48  property, and causes serious bodily injury or death to another
   49  person, including any law enforcement officer involved in
   50  pursuing or otherwise attempting to effect a stop of the
   51  person’s vehicle, commits a felony of the first degree,
   52  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
   53  Notwithstanding any other provision of law, the court shall
   54  sentence any person convicted of committing the offense
   55  described in this paragraph to a mandatory minimum sentence of 3
   56  years imprisonment in addition to the mandatory minimum sentence
   57  provided under subsection (5). Nothing in This paragraph does
   58  not shall prevent a court from imposing a greater sentence of
   59  incarceration as authorized by law.
   60         (4) Any person who, in the course of unlawfully leaving or
   61  attempting to leave the scene of a crash in violation of s.
   62  316.027 or s. 316.061, having knowledge of an order to stop by a
   63  duly authorized law enforcement officer, willfully refuses or
   64  fails to stop in compliance with such an order, or having
   65  stopped in knowing compliance with such order, willfully flees
   66  in an attempt to elude such officer and, as a result of such
   67  fleeing or eluding:
   68         (a) Causes injury to another person or causes damage to any
   69  property belonging to another person, commits aggravated fleeing
   70  or eluding, a felony of the second degree, punishable as
   71  provided in s. 775.082, s. 775.083, or s. 775.084.
   72         (b) Causes serious bodily injury or death to another
   73  person, including any law enforcement officer involved in
   74  pursuing or otherwise attempting to effect a stop of the
   75  person’s vehicle, commits aggravated fleeing or eluding with
   76  serious bodily injury or death, a felony of the first degree,
   77  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

   79  The felony of aggravated fleeing or eluding and the felony of
   80  aggravated fleeing or eluding with serious bodily injury or
   81  death constitute separate offenses for which a person may be
   82  charged, in addition to the offenses under ss. 316.027 and
   83  316.061, relating to unlawfully leaving the scene of a crash,
   84  which the person had been in the course of committing or
   85  attempting to commit when the order to stop was given.
   86  Notwithstanding any other provision of law, the court shall
   87  sentence any person convicted of committing aggravated fleeing
   88  or eluding with serious bodily injury or death to a mandatory
   89  minimum sentence of 3 years imprisonment in addition to the
   90  mandatory minimum sentence provided under subsection (5).
   91  Nothing in This subsection does not shall prevent a court from
   92  imposing a greater sentence of incarceration as authorized by
   93  law.
   94         (5)Except as otherwise provided, a violation of subsection
   95  (1), subsection (2), subsection (3), or subsection (4):
   96         (a)Upon a first offense, is ranked in level 7 of the
   97  offense severity ranking chart.
   98         (b)Upon a second offense, is ranked in level 8 of the
   99  offense severity ranking chart.
  100         (c)Upon a third or subsequent offense, is ranked in level
  101  9 of the offense severity ranking chart.
  102         Section 2. Paragraphs (a), (c), (d), (g), (h), and (i) of
  103  subsection (3) of section 921.0022, Florida Statutes, are
  104  amended to read:
