       The Committee on Criminal Justice (Burgess) recommended the
       following:
       
    1         Senate Substitute for Amendment (479542) (with title
    2  amendment)
    3  
    4         Delete everything after the enacting clause
    5  and insert:
    6         Section 1. Subsection (5) of section 782.04, Florida
    7  Statutes, is renumbered as subsection (6), respectively, and
    8  subsection (5) is added to that section, to read:
    9         782.04 Murder.—
   10         (5) The unlawful killing of a human being, when perpetrated
   11  without any design to effect death, by a person engaged in the
   12  perpetration of, or in the attempt to perpetrate the unlawful
   13  distribution of any substance listed in sub-subparagraphs
   14  (1)(a)3.a.-j. by a person less than 18 years of age, when such
   15  substance is proven to have caused, or is proven to have been a
   16  substantial factor in producing, the death of the user, is
   17  murder in the third degree and constitutes a felony of the
   18  second degree, punishable as provided in s. 775.082, s. 775.083,
   19  or s. 775.084.
   20         Section 2. This act shall take effect on July 1, 2025.

   23  And the title is amended as follows:
   24         Delete everything before the enacting clause
   25  and insert:
   26                        A bill to be entitled                      
   27         An act relating to murder; amending s. 782.04, F.S.;
   28         creating an offense of third degree murder; providing
   29         penalties; providing an effective date.
