Senator Rouson moved the following:
1 Senate Amendment to Amendment (319966) (with title

4 Delete lines 5 - 20
5 and insert:
6 Section 1. Subsection (5) is added to section 782.07,
7 Florida Statutes, to read:
8 782.07 Manslaughter; aggravated manslaughter of an elderly
9 person or disabled adult; aggravated manslaughter of a child;
10 aggravated manslaughter of an officer, a firefighter, an
11 emergency medical technician, or a paramedic.—
12 (5)(a) As used in this subsection, the term:
13 1. “Dangerous fentanyl or fentanyl analogs” means any
14 controlled substance described in s. 893.135(1)(c)4.a.(I)–(VII).
15 2. “Distribute” has the same meaning as in s. 893.02.
16 (b) The unlawful killing of a human being, when perpetrated
17 without any design to effect death, which resulted from the
18 unlawful distribution by a person younger than 18 years of age
19 of any substance or mixture that he or she knew or reasonably
20 should have known contained dangerous fentanyl or fentanyl
21 analogs when such substance or mixture is proven to have caused,
22 or is proven to have been a substantial factor in producing, the
23 death of the user, is manslaughter,

26 And the title is amended as follows:
27 Delete lines 31 - 35
28 and insert:
29 substances resulting in death; amending s. 782.07,
30 F.S.; defining the terms “dangerous fentanyl or
31 fentanyl analogs” and “distribute”; creating an
32 offense of manslaughter, a felony of the second
33 degree; providing criminal penalties; providing an
34 effective date.
